		<description><![CDATA[My latest thoughts on the discussion around finally adding new conditions to the Michigan Medical Marihuana Act's registry, from the The Huffington Post<br /><br /><br />Last August, the state began assembling a medical marihuana review panel, with the ultimate goal of finally hearing arguments to add new conditions to the Michigan Medical Marihuana registry. Now, with the<br />help of that panel, more than four years after Michigan residents approved the Michigan Medical Marihuana Act (MMMA), the registry is close to adding its first new condition -- Parkinson's disease.<br />On Friday, January 25, the state's Department of Licensing and Regulatory Affairs review panel heard from the community about why Parkinson's should be added to the registry and the direct benefits of medical marihuana.<br />This is one of the most important parts of the MMMA, empowering residents to petition and garner support to add new conditions to the registry. Considering new conditions like Parkinson's and Post-Traumatic Stress Disorder (PTSD) is a major step for advancing medical marihuana in Michigan and ensuring the state's residents have access to the best medical care for their condition. One could say this is the first time in four years the discussion between the Government and the medical marihuana community was focused on patient health issues instead of political and legal issues. For medical marihuana supporters, hard work and advocacy is paying off as they see the state truly recognize the medical benefits of cannabis.<br />Initially, the panel met in December to hear marihuana supporters and detractors voice their opinions on Parkinson's and PTSD, both of which were up for debate for potential addition to the registry. With the review panel accepting Parkinson's but denying PTSD, it's a start and reason for hope for thousands of Michiganders looking to use medical marihuana to improve the quality of their lives. While PTSD didn't make the cut, advocates continue to make their push, receiving support from the community and displaying the same strength that helped pass the MMMA initially.<br />Advocates and PTSD sufferers have until March for their arguments, written and orally, to be heard by Michigan's Bureau of Health Services. 		<description><![CDATA[August 2, 2012 at 1:00 am<br /><strong class='bbc'>	Appeals court blocks ordinances that ban medical marijuana growing</strong><ul class='bbc'><li>By Chad Livengood</li><li>Detroit News Lansing Bureau</li></ul><br /><br /><br /><em class='bbc'>Lansing</em>— Medical marijuana ordinances in three Metro Detroit municipalities could get scrapped after the Michigan Court of Appeals ruled cities cannot enact local laws that criminalize patients' legal use of the drug.<br />In a ruling issued Wednesday, a three-judge panel overturned an ordinance enacted by the city of Wyoming — a Grand Rapids suburb — that sought to prohibit cultivation of medical marijuana based on federal prohibitions against manufacturing and distributing cannabis.<br />"Defendant's ordinance is void and unenforceable to the extent that it purports to sanction the medical use of marijuana in conformity with" the Michigan Medical Marihuana Act, appeals judges Joel P. Hoekstra, Douglas B. Shapiro and William C. Whitbeck wrote in an opinion handed down Tuesday and released Wednesday.<br />The ruling could have broad implications for communities seeking to regulate medical marijuana growing and distribution through zoning ordinances in the legal battles over the 2008 voter-enacted law.<br />The ACLU of Michigan has challenged similar ordinances in Birmingham, Bloomfield Hills and Livonia.<br />"This really will put an end to those ordinances, as well," said Dan Korobkin, staff attorney with the ACLU of Michigan.<br />Wyoming's ordinance was based upon Livonia's law, Livonia City Attorney Don Knapp said.<br />"Obviously, this is not good for us," Knapp said.<br />John Ter Beek, a 60-year-old diabetic from Wyoming, has been a registered medical marijuana patient since May 2009 and grows his own cannabis at home, as permitted under the law. He sued to challenge a Wyoming ordinance implemented in November 2010 that made marijuana cultivation a zoning violation.<br />The appellate court ruled the Michigan Medical Marihuana Act gives qualified patients immunity from municipal zoning sanctions. The judges also concluded the state medical marijuana law's limited immunity for patients does not interfere with federal enforcement of controlled substances laws.<br />"It will keep other communities from banning medical marijuana," Ter Beek told The Detroit News.<br />It's unclear whether Wyoming will appeal the ruling to the Michigan Supreme Court, which ruled in May that patients are protected from prosecution even if they have not obtained a state medical marijuana card. Wyoming officials could not be reached for comment.<br />Last summer, a separate appeals panel ruled the sale of marijuana at dispensaries was not allowed under the law. That case, involving a Mount Pleasant medical marijuana dispensary, is expected to be argued before the Supreme Court later this year.<br />"If there's any sort of good news in all of this, I don't think you're going to see medical marijuana dispensaries pop up (in Livonia)," Knapp said.]]></description>

The highest court in the state, in reviewing two cases -- <em class='bbc'>Larry King in Shiawassee County</em> and<em class='bbc'>Alexander Kolanek in Oakland County</em> -- ruled that registered and unregistered medical marijuana patients and caregivers are entitled to a medical marijuana defense, so long as they meet the requirement of Section 8 of the MMMA.*</p><br /><br /><p class='bbc_left'><span style='color: #000000'><span style='font-family: Georgia, Century, Times, serif'><span style='font-size: 12px;'>The court relied heavily on ballot language, notably to, "<a href='http://www.senate.michigan.gov/sfa/publications%5Cballotprops%5Cproposal08-1.pdf' class='bbc_url' title='External link' rel='nofollow external'>permit registered and unregistered</a>patients and primary caregivers to assert medical reasons for using marijuana as a defense to any prosecution involving marijuana." Michigan voters overwhelmingly approved the Act in November 2008.</span></span></span></p><br /><br /><p class='bbc_left'><span style='color: #000000'><span style='font-family: Georgia, Century, Times, serif'><span style='font-size: 12px;'>This admittedly broader interpretation of the law finally follows what many courts have failed to do since the MMMA was enacted -- listen to the will of the people and truly understand the intent of the law. Voters approved the MMMA as a means to help patients and caregivers, protect them from arrest and allow them to achieve a higher quality of life through the use of medical marijuana.</span></span></span></p><br /><br /><p class='bbc_left'><span style='color: #000000'><span style='font-family: Georgia, Century, Times, serif'><span style='font-size: 12px;'>In the last two years since the Court of Appeals decision, patients and caregivers have suffered greatly because of such a narrow interpretation of the law. Many of those cases will undoubtedly be revisited, with patients being properly defended and allowed to rely on a law some judges disallowed in their courtrooms because of personal bias.</span></span></span></p><br /><br /><p class='bbc_left'><span style='color: #000000'><span style='font-family: Georgia, Century, Times, serif'><span style='font-size: 12px;'>Beyond the aforementioned cases and potential appeals, this decision has a huge impact moving forward for patients, caregivers and law enforcement.</span></span></span></p><br /><br /><p class='bbc_left'><span style='color: #000000'><span style='font-family: Georgia, Century, Times, serif'><span style='font-size: 12px;'>With several bills being debated in the Michigan Senate that could change the MMMA, including one that would provide the names of registered patients to law enforcement officials, the Supreme Court's decision has the power to render them obsolete before being voted on. While many politicians are working diligently to pick apart the MMMA by drafting and sponsoring bills to further restrict access and patient protections, the state's highest legal authority is essentially saying their efforts are wrong.</span></span></span></p><br /><br /><p class='bbc_left'><span style='color: #000000'><span style='font-family: Georgia, Century, Times, serif'><span style='font-size: 12px;'>If HB 4834 were to be passed, providing patient medical information to law enforcement, new and re-applying patients can avoid potential conflict by simply not sending their paperwork in to the state. The Court's decision allows for those with an established doctor-patient relationship to present a medical marijuana defense, regardless of status with the state.</span></span></span></p><br /><br /><p class='bbc_left'><span style='color: #000000'><span style='font-family: Georgia, Century, Times, serif'><span style='font-size: 12px;'>Currently, the MMMA protects patients in <a href='http://www.legislature.mi.gov/(S(bo4sso55m4vlka5521uzss55))/mileg.aspx?page=GetObject&objectname=mcl-333-26426' class='bbc_url' title='External link' rel='nofollow external'>Section 6h</a> by guaranteeing confidentiality and exemption from the Freedom of Information Act. Imagine being pulled over, and instead of being issued a warning or a ticket, the officer has access to your entire medical history, and uses it against you. The medical marihuana registry must remain confidential in order for the MMMA to work, and for patients to trust in it.</span></span></span></p><br /><br /><p class='bbc_left'><span style='color: #000000'><span style='font-family: Georgia, Century, Times, serif'><span style='font-size: 12px;'>The bill passing could encourage patients to no longer apply to the state, but still go through the registration and medical processes to protect themselves, resulting in fewer applications and less money for the state. Politicians may not realize it now, but the bills they are attempting to pass are not doing anything to regulate medical marijuana, only making it more dangerous for already scared patients trying to find relief.</span></span></span></p><br /><br /><p class='bbc_left'><span style='color: #000000'><span style='font-family: Georgia, Century, Times, serif'><span style='font-size: 12px;'>The timing of the Supreme Court's decision also couldn't be more poetic, and comes when the state's patients and caregivers are being harassed more than ever. 		<description><![CDATA[<strong class='bbc'>	A Ruling By The Michigan Supreme Court Has Big Implications For Medical Marijuana</strong><br /><br /><br />By Rick Thompson<br /><br />There have been many developments in the field of medical marijuana since my last blog, both here in Michigan and nationally, material enough for a half-dozen lengthy columns easily. Science news about cannabis’ therapeutic effects in people with autism, a big article in a national paper about the Veteran’s Administration and using marijuana to treat PTSD, the Michigan Supreme Court reversing the Court of Appeals on two medical marijuana cases, the K2 crisis, HB 5681, it goes on and on.<br /><br />The single thread that makes all these stories relevant and related is the mindset of the powerful. Contain and control has become big business, and our government is in that business. The prohibition of marijuana in America, my America, is being perpetuated by a system financially predicated on the revenue and expenditures created through the war on drugs. There is a better way.<br /><br />Occasionally we see a light shined on the issue by neutral observers. These quotes come courtesy of the Michigan Supreme Court, who UNANIMOUSLY held that the Court of Appeals, District and Circuit Courts across the state, have been improperly denying citizens their rights.<br /><br />“Under the Court of Appeals’ construction, which the prosecution urges we adopt…a defendant (must) satisfy all the requirements of Section 4 in order to establish the Section 8 affirmative defense. Principles of statutory construction do not support this conclusion… The plain language of Section 8 does not require compliance with the requirements of Section 4.” Pg 17<br /><br />“Thus, Sections 4 and 7(a) have no bearing on the requirements of Section 8, and the requirements of Section 4 cannot logically be imported into the requirements of Section 8 by means of Section 7(a).” pg. 18<br /><br />You don’t have to understand what Sections 4, 7(a) and 8 are to understand what the Supreme Court is saying. The Court of Appeals, the Attorney General and the prosecutors have forced a judicial model upon legally registered patients that the Supreme Justices are saying is not logical, contradicts the plain language of the Act, and is not supported by standard interpretations of law. Unanimously, they said that. You can’t get seven people to agree on what color red is, but these seven strong personalities made these equally strong statements.<br /><br />There’s more. They explain why the Appeals Judges and prosecutors have been doing this to people.<br /><br />“…unregistered patients would never be eligible for the affirmative defense under Section 8. The result would be to effectively abolish the differing protections extended to registered and unregistered patients. This interpretation is internally inconsistent, renders the affirmative defense in Section 8 a nullity, and is contrary to the electors’ intent to permit both registered and unregistered patients to assert medical reasons for using marijuana as a defense…” pgs 18-19<br /><br />Would never be eligible… contrary to the electors’ intent… internally inconsistent… and yet, this is how prosecutions involving medical marijuana patients have been conducted for the last three years. By improperly denying a jury the right to know that a person is a patient, and that patients are people, prosecutors have forced plea bargains from licensed and registered patients who should have had an affirmative defense available to them. It is an expedient way to push patients through the system without the judicial inconvenience of a jury trial.<br /><br />The Supreme Court even included an Appendix which lists out the 10 conclusions the Court reached when deciding the two cases before them. A ten-point cheat sheet- really? That should make the Court’s message very clear- do not misunderstand what we have decided here today. And to whom is that message intended? Legislators, take note of the message contained herein. The invalid interpretations of what the Medical Marihuana Act means extends into your halls as well, Reps. Walsh, LeBlanc, Liss, Senators Jones, Marleau, Schuitmacher. Focus on these phrases- internally inconsistent… plain language… contrary to the voter’s intent. Science is on my side. The people are on my side. The Supreme Court is on my side. Do not be on the other side or we will un-elect you.<br /><br />Who do we hold accountable for this wrong? Who takes the lash for this transgression against humanity? I wish I could say it was our current Attorney General, but this is a symptom of a system that was created before he achieved the top office. He perpetuates the problem, fosters unfounded fear in the citizenry and has persecuted the sick and injured; for that he will have to answer to God. The real issue is one of the status quo, the reluctance to adapt and change because change is uncomfortable- or should I say, unprofitable. Revenues created from forfeitures, court costs and fines, governmental drug war grants to local police departments, sale of surplus military gear and the training that comes with it are all the rewards for keeping the system intact. Change means an interruption in the revenue stream and that will always be a tough sell to agents of the government.<br /><br />Change is upon us, whether we want it to be or not. In times past, Michigan was the agent of change. Our innovations were reported internationally and were imitated in every industrialized nation. Under Attorney General Frank Kelly we had the best consumer protections in the nation. Now, not so much. City Councilmembers, County Commissioners, elected officials at all levels of government can look to the Supreme Court’s rulings and understand that the old ways are dying and it is good to embrace the new. They are now before the Senate, and await the same process before a final vote on the Senate floor.<br /><br />Operation We Didn't Vote For This: our objective is a full scale, grass roots, community response to this specific package of bills. It is aimed at reaching the House Democrats and Republicans that have overlooked the medical cannabis community, and for the Democrats and Republicans of the Senate who have the final vote to pass this bill.&nbsp;&nbsp;Before the Senate votes on this bill they need to hear the voice of this community's opposition in large numbers.<br /><br />Please join us in making a difference by contacting the Representatives and Senators listed below via phone, email, letter, and visiting them in person. Especially encouraged is a face-to-face meeting at every coffee hour scheduled by your Representative and Senator. Each one of them has the power to stop these bills from advancing. We have provided a form letter addressing the bills directly, but please feel free to write your own using the talking points provided. We would encourage those involved to forward the suggested letters as well as the responses and experiences they receive from their interactions.<br /><br />Please let your voice be heard by:<br /><br />Cutting and pasting the letter below (or your own) into an email, and then sending it to each of the email addresses listed below or printing the letter and mailing it via US mail. And most importantly call, call, call these government employees (see telephone numbers listed below) and explain to them why the bills are unacceptable.<br /><br />The bills that have advanced, intending to amend the MMMA, fail to address the real concerns of patients and caregivers, and not one of the medical cannabis organizations in Michigan has supported any of the bills. In light of People v. Koon, HB 4834 subjects every patient who drives to liability, and this is not acceptable. 140,000 patients were promised that their registry status would be kept private, and now four years into the program, we have learned that we have been lied to.<br /><br />Up to this point our community has lacked leverage in the process, and we have been subject to a political and judicial circus act. The ruling by the Supreme Court this past week, in People v. King and People v. Kolanek, expressly reaffirmed what many in our community have known all along: the unregistered patient is protected under section 8 of the MMMA. For the first time, a recognized right to be protected under the MMMA has been codified, giving patients the choice to not register, and still have a defense under the Act. It is without question that the premise of all the bills was based upon a faulty interpretation of the Act. It is now obvious that the passing of these bills failed to consider the unregistered patient protection, amongst other things, and the choice that now exists provides a chance for this community to act strategically.<br /><br />I am certain that the People who passed these bills never considered being asked the following question: "If you Mrs. Legislator were advising your loved one suffering from a debilitating condition and they chose to treat their condition with cannabis, would they be more protected if they registered or kept their medical information private?"<br /><br />I would like to believe that in what seems like an attempt to control the registry through law enforcement access, the most direct way to oppose this bill is the threat of the registry program being abandoned. Join me and the MMMA in letting the Legislature know that their failure to implement the voters' initiative as intended by the people of the state of Michigan, has caused our community to take pause and consider these options. They need to know we have legitimate legal options, and their behavior cannot be tolerated any more.<br /><br />Below is a list of talking point to utilize in your calls, conversations, letters, and meetings as you go forward and interact with the Legislature. Many would have bet against the medical marijuana community when 18 bills were introduced by a Republican-dominated Legislature in June of 2011, but to date, more than one year later, the MMMA of 2008 remains unchanged. This is due to the hard work of our grass roots lobby and its dedicated advocates like you.<br /><br />We are on our last lap, and need to finish strong.&nbsp;&nbsp;Please let your voice be heard, and let this government understand that they cannot get away with treating its citizens this way.<br /><br /><br /><br /><br />***************************************************************************<br /><br /><br />I am writing today to let you know that the medical cannabis community still remains firmly opposed to the package of bills recently passed by the House and now waiting for review by the Senate Judiciary committee, HB 4834, 4851, 4853, and 4856. My position on the bills remains unchanged by amendments that were made from the House floor prior to passage.<br /><br />While you may have heard representatives comment before the House vote that the bills were supported by patient groups, no approval was asked for, nor granted. All of the patient groups still oppose the package, and in light of the recently published Supreme Court decisions in King and Kolanek, they are seen as unnecessary legislation. They do not bring clarity to the Act, but instead, reduce the protections that the voters intended when they voted 63% in favor of the Michigan Medical Marihuana Act. These bills will implement new technical violations for patients and their caregivers, and are clearly against the intent of the electorate.<br /><br />The Michigan Supreme Court has recently reaffirmed the rights of registered and unregistered medical marijuana patients and caregivers to a defense in court. In light of that decision a patient now has more privacy of their medical records than they would by registering in a database that is to be shared with law enforcement. Michigan’s Attorney General has shown a willingness since entering office to disregard the wishes of Michigan voters and make private medical information in the registry available to law enforcement despite the protections expressed in within the Act.&nbsp;&nbsp;When abuses of this new, invasive police power happen, we must have an organization in place to investigate, prosecute and punish any offenders.<br /><br />Participating in the medical marijuana registry program is intended to guarantee protection against arrest and prosecution. HB 4834 increases the risk of arrest by making private medical information available to law enforcement officers in a way that offers no remedy for inevitable abuses. THIS SUB-SUBPARAGRAPH DOES NOT REQUIRE THE<br />OFFICER OR OFFICIAL TO OBTAIN A SEARCH WARRANT TO OBTAIN ACCESS TO<br />THE REGISTRY INFORMATION.<br /><br />(4) A person, including an employee, CONTRACTOR, or official<br />of the department or another state agency or local unit of government, who discloses confidential information in violation of this act ACCESSES, USES, OR DISCLOSES NONPUBLIC INFORMATION GOVERNED UNDER THIS ACT FOR PERSONAL USE OR GAIN OR IN A MANNER THAT IS NOT AUTHORIZED BY LAW is guilty of a misdemeanor, punishable by imprisonment for not more than 6 months, or a fine of not more than $1, 000.00, or both. Notwithstanding this provision, department employees may notify law enforcement about falsified or fraudulent information submitted to the department.<br /><br />The act provides protections and penalties for the release of confidential information, for the reason that abuses were anticipated.<br /><br />The Bill fails to provide for any real remedies to patients and caregivers if law enforcement violates the probable cause requirements set out in HB 4834.<br /><br />The Bill fails to protect the registry from overzealous or abusive law enforcement.<br /><br />The Bill fails to provide a mechanism to investigate these violations, and more importantly, a procedure for prosecuting them. 		<title><![CDATA[Hitchhiker's Guide To Relying On The Aff. D...]]></title>

		<description><![CDATA[Think you're in the clear to rely on just a cetification or recommendation and employ the affirmative defense after the recent Sup Ct opinions in King and Kolanek?&nbsp;&nbsp;Thing again!<br /><br />If that is your plan, to rely on your certification or recommendation, then you may be in for some trouble and a rude awakening.&nbsp;&nbsp;So let's clear this up so you make an informed decision.<br /><br />First off, if you don't have a card and are relying on your certification only then plan on being arrested.&nbsp;&nbsp;Plan on spending up to 48 hours in jail before be arraigned and bond being set.&nbsp;&nbsp;Then plan on either getting a court appointed attorney or spending a lot on a retained attorney.<br /><br />Then what?&nbsp;&nbsp;Well, if it's a felony you're charged with, then expect to go to your preliminary examination.&nbsp;&nbsp;If the judge there will hear your aff def then maybe s/he will dismiss the case.&nbsp;&nbsp;But maybe not.&nbsp;&nbsp;If not, then plan on going to circuit court.&nbsp;&nbsp;It is there that your attorney will file and argue the aff def.&nbsp;&nbsp;Expect to either subpoena your doctor to testify (and tinkle him off) or expect to pay him as an expert witness.&nbsp;&nbsp;Also expect to be able to prove that you needed x ounces (or plants) to ensure a continuing supply.<br /><br />Lastly, and <strong class='bbc'>most importantly</strong>, be prepared for proving the heightened requirements of the sec 8 defense.&nbsp;&nbsp;Keep in mind that the administrative rules require less of a dr for the certification than sec 8 requires for an aff def.&nbsp;&nbsp;What does that mean?&nbsp;&nbsp;It means that you could end up in circuit court with a signed cert or card and still be convicted.<br /><br />The administrative rules state:<br /><br />(22) “Written certification” means a document signed by a physician stating the patient’s debilitating medical condition and stating that, in the physician’s professional opinion, the patient is likely to receive therapeutic or palliative benefit from the medical use of marihuana to treat or alleviate the patient’s debilitating medical condition or symptoms associated with the debilitating medical condition.<br /><br />That written certification is what is needed for a card under section 4.<br /><br />On the other hand, Section 8 requires:<br /><br />(1) A physician has stated that, in the physician's professional opinion, after having completed a full assessment of the patient's medical history and current medical condition made in the course of a bona fide physician-patient relationship, the patient is likely to receive therapeutic or palliative benefit from the medical use of marihuana to treat or alleviate the patient's serious or debilitating medical condition or symptoms of the patient's serious or debilitating medical condition;<br /><br />So section 8 requires a<strong class='bbc'> f<strong class='bbc'>ull </strong>assessment of the patient's history </strong>whereas the rules don't require that for a card. Section 8 also requires the bona fide dr/pt relationship but that seems a foregone conclusion if a dr signs the certification.<br /><br />At any rate a bare bones section 4 certification probably isn't adequate to cover for a section 8 defense.&nbsp;&nbsp;So if you have your card and are relying on that, or a recommendation or certification, make darn sure that your Dr made a <strong class='bbc'>full assessment of your history</strong>.&nbsp;&nbsp;In other words, a few months of medical records may be adequate for a card but not so much for a sec 8 defense.<br /><br />So what does all this mean?&nbsp;&nbsp;It means you should make sure you get that full assessment of your history and make sure you have a bona fide relationship (don't buy a cert. from the back of an appliance store!)<br /><br />Lastly, to qualify all of this, I will concede that sec 4f requires the same thing as sec 8 in order for a doctor to be immune from prosecution but those elements in sec 8 are not all required to get the card anywhere else.&nbsp;&nbsp;So, a doc may lose his immunity from prosecution for not conducting a full assessment of your history BUT that doesn't mean you wouldn't be entitled to a card.&nbsp;&nbsp;In other words there is a hypothetical situation where a doc could certify you and you get your card and your card is valid but the doc isn't immune from prosecution.<br /><br />The point here is don't be tricked into thinking you are safe and able to utilize sec 8 just because you have a card or a cert.&nbsp;&nbsp;I can easily see this being the next bone that the prosecutors pick if we start seeing sec 8 defenses!<br /><br />Lastly, don't be naive and think that you can scream sec 8 and the prosecutors will drop everything.&nbsp;&nbsp;I personally have seen prosecutors continue to pursue cases that were bound to be dismissed due to constitutional violations.&nbsp;&nbsp;They won't come out and say it but I think it is clear that they feel if they make the defendant pay through the nose to the atty by drawing out the case then that is punishment in itself even if the case <strong class='bbc'>is</strong> later dismissed.<br /><br />There is more than sec 8 than the issues presented here but you need to be mindful of the presented issues in particular.&nbsp;&nbsp;Will prosecutors accept the card or a cert or recommendation as fulfilling the medical and dr requirements of sec 8?&nbsp;&nbsp;Maybe.&nbsp;&nbsp;In fact I'm sure a lot would but don't be the one fighting this exact issue and left holding the bag for 3 years as it is appealed up to the Sup Ct.<br /><br />If you have your card and think it wouldn't hurt to grow 2 more plants and expect your card will cover for you in regard to the medical requirements of sec 8 then at least be sure you have covered yourself in regard to ALL of the elements required in sec 8.<br /><br /><br />Be safe. Do smart things.]]></description>

Committee. Very soon these bills will be on the House floor for further<br />
amendments with the final vote requiring a 75% super majority.<br />
<br />
Operation 26%'s&nbsp;&nbsp;objective is designed as a full scale, grass roots,<br />
community response aimed at reaching the Democrats that are split,<br />
undecided or ununiformed on this issue and blocking a super majority yes<br />
vote. The Democrats in both the House and Senate will be asked to<br />
advance these bills; they need to hear the voice of this communities'<br />

Talking points for conversations with the Representatives:<br />

1.	The Judiciary Committee said that they were working with different<br />
medical marihuana groups but not a single medical marihuana advocacy<br />
group approves of the bills. Watch the tapes from the hearings.<br />
<br />
2.	Patients and Caregivers are being denied the right to present a<br />
medical marihuana defense, despite very clear language in the<br />
initiative.&nbsp;&nbsp;During the hearings one of the committee members was quoted<br />
as saying "that seems un-American."<br />
<br />
3.	Nearly three years after it was passed, the Act still has not been<br />
properly implemented, with registration cards showing up late and no new<br />
conditions having been added despite multiple submissions and petitions.<br />
<br />
4.	When I signed up for the program, I believed that law enforcement<br />
would not have access to the registry. HB 4834 violates our most basic<br />
rights to privacy, as outlined in the act. It is unfair to change the<br />
rules in such a drastic way after the program has begun.<br />
<br />
5.	Legislators and law enforcement continue to fail to realize this<br />
is a medical issue, protected by HIPAA and aimed at helping the people<br />
of Michigan experience relief.<br />
<br />
6.	HB 4856 criminalizes behavior that that is the norm for a<br />
possessing and transferring any other medication including prescription<br />
narcotics.<br />
<br />
7.	HB 4853- which should require a 75% vote criminalizes patients'<br />
safe access for acquiring medicine and limits the protections set out in<br />
the initiative.<br />
<br />
8.	HB 4851 is unneeded because Lara has recently published its<br />
guidelines for medical marihuana certification, addressing this issue as<br />
a private health issue and not a public safety issue. The issue of<br />
locked enclosed facility is before the Michigan Supreme Court and<br />
additionally effectively makes the transportation of any cannabis plant<br />
illegal.<br />
<br />
9.	Additionally and for unknown reasons the amendment to guarantee a<br />
right to present a medical marihuana defense to a jury, was amended,<br />
quoting a Representative "this seems so un-American."<br />
<br />
10.	HB 4834 is the most horrifying allowing access by the loosely<br />
defined "law enforcement official" access to the registry. Over 130,000<br />
patients and numerous caregivers had been promised and believed that<br />
their registry information would be kept private.&nbsp;&nbsp;To honestly ensure<br />
these protections "law enforcement officials" should instead be required<br />
to get a warrant signed by a neutral and detached magistrate. This is<br />
the procedure for obtaining a warrant for the search of someone's home,<br />
and stands as a more acceptable approach. Additionally Law Enforcement<br />
Officers can already verify the validity of a medical marijuana<br />
patient's registry ID card through the Department of Licensing and<br />
Regulatory Affairs.<br />
<br />
11.	In early March of 2012, LARA announced it had purchased a new<br />
printer which would be installed by the end of the month. We have yet to<br />
see it put into use, if it even exists. It has been 4 years and more<br />
empty promises.<br />
<br />
12.	What's more patients and caregivers are no safer than they were<br />
prior to 2008, when 63 percent of the voters in Michigan mandated a<br />
change.<br />
<br />
13.	Based on the above factors and a lack of effort to keep Michigan<br />
residents, namely patients and caregivers, safe under the current law, I<br />
strongly urge you to vote no on all House bills relating to medical<br />
marijuana.]]></description>

WHAT GIVES MARIJUANA ITS SIGNATURE SCENT? <br />

From Harborside to Halent Labs, Experts Now Know Way More About What Makes Bud Reek <br />
<br />
Sacramento cannabis enthusiasts have yet another thing to be snobs about in 2012: terpenes, the building blocks that make up the unique smell of cannabis, which are beginning to waft into the mainstream. <br />
<br />
Drug companies are researching the therapeutic properties of these simple organic molecules, and at least two California medical-cannabis labs have begun testing for their presence in dispensary weed. <br />
<br />
According to Donald Land, a UC Davis chemistry professor who cofounded Halent Laboratories, which tests for terpenes and conducts occasional smelling classes, "Terpenes are a set of relatively simple organic molecules that are present in all living organisms." He noted that most of the flavors and aromas of plants comes from terpenes. <br />
<br />
"The name terpene is derived from the main ingredient in a certain type of pine pitch called turpentine," Land explained.&nbsp;&nbsp;"That piney smell that comes along with turpentine comes from terpenes.&nbsp;&nbsp;There are lots of others." <br />
<br />
Herbalists have recognized the power of terpenes for decades.&nbsp;&nbsp;"Cannabis and other plants share a lot of the same terpenes, so terpenes have been legal for many decades," Land said.&nbsp;&nbsp;"There's been quite a bit of research on them in the U.S.&nbsp;&nbsp;and abroad, including many well-documented medicinal effects." <br />
<br />
Rick Pfrommer, manager at Harborside Health Center in Oakland, said that as head buyer for the popular dispensary, he has smelled countless numbers of bags and glass jars full of the sticky ick, and that a lot of the odors he detects aren't actually coming from the weed. <br />
<br />
"You can smell everything from bat guano to heavy salt-hydroponic fertilizers," Pfrommer said during an interview inside Harborside's buyer's room.&nbsp;&nbsp;The space is dominated by an examination counter, shelves of pot-strain reference books and expensive computers.&nbsp;&nbsp;Pfrommer has been selling ganja for about 25 years. <br />
<br />
Pfrommer insists that if one boasts an acute sense of smell, you can smell chlorophyll in a bud that hasn't been cured well, and even molds.&nbsp;&nbsp;"Once you've smelled multiple thousands of samples of cannabis," he explained, "when something is off, it's apparent that it's off, like, as soon as you crack the bag open." <br />
<br />
Like a wine sommelier or a buyer for a boutique coffee roaster, Pfrommer smells each potential new addition to Harborside's menu using a specific ritual.&nbsp;&nbsp;First, he pops open a glass jar of coffee beans and takes a big sniff.&nbsp;&nbsp;Like ginger before sushi, coffee beans reset the palate, he said.&nbsp;&nbsp;Then he takes a big whiff from a sample cannabis bag, fishes out a single nug, cracks it open, and inhales deeply. <br />

"All you really want to smell is the terpenes," he said. <br />
<br />
According to a literature review by the medical-cannabis journal O'Shaughnessy's: "Limonene ( also found in lemon ) is an antidepressant and immune-stimulant in humans; alpha-pinene ( also found in pine needles ) is an anti-inflammatory, a bronchodilator, and a wide-spectrum antibiotic; nerolidol ( also found in oranges ) is a sedative; linalool ( also found in lavender ) has an anti-anxiety effect; and myrcene ( also found in hops ) is a sedative, a muscle relaxant, a sleep aid, and an anti-inflammatory." <br />
<br />
Trainers teach drug dogs to hunt for beta-caryophyllene, a terpene in cannabis that also is an anti-inflammatory.&nbsp;&nbsp;Terpenes are also the chemical precursors to the euphoric ingredient in pot, tetrahydrocannabinol, or THC, making them a proxy for potency. <br />
<br />
Researchers like Ethan Russo, senior medical director at GW Pharmaceuticals, believe that terpenes contribute to the "entourage effect" that lies at the core of medical cannabis's efficacy in treating nausea, inflammation, chronic pain and more.&nbsp;&nbsp;GW Pharmaceuticals has started growing terpene-only pot-sans THC-to better investigate the effects of terpenes, O'Shaughnessy's reported. <br />
<br />
And, unlike the THC pill Marinol, new prescription throat spray Sativex contains THC, its therapeutic peer CBD, and terpenes. <br />
<br />
Terpenes also enable pot snobs to make outlandish yet credible claims that they smell chocolate, mango, diesel or lavender in their bag.&nbsp;&nbsp;The five to 10 main terpenes in cannabis have about 25 more rare peers, but cannabis has been found to contain more than 200 different types of them.&nbsp;&nbsp;The combinations are infinite. <br />
<br />
Cannabis lab data from Halent and The Werc Shop near Los Angeles is helping to elevate breeding to a science.&nbsp;&nbsp;It's also giving patients a first-ever ingredients list for that dubious doobie, said Jeffrey Rabe, director of The Werc Shop. <br />
<br />
Pfrommer envisions legal OG Kush deodorizers or Agent Orange floor cleaners.&nbsp;&nbsp;"I think, along with CBD, terpenes are one of the two most exciting things going on in cannabis," Pfrommer said.&nbsp;&nbsp;"We're just scratching the surface now." <br />

		<description><![CDATA[Paul Campaign: We’re Winning The Battle For Delegates<br /> 						<br />GOP strategist predicts Paul will be on the Republican ticket<br /><br />Steve Watson<br />Prisonplanet.com<br />February 9, 2012<br /><br />The Ron Paul campaign issued a press release yesterday announcing that the Congressman was winning the battle for delegates in the lead up to the Republican National Convention, with Paul himself adding that he believes he has unlocked the secret to winning the GOP nomination.<br />“We are thrilled with the yesterday’s results.” Ron Paul 2012 National Campaign Manager John Tate stated, “Our campaign to Restore America continues to gain ground, and we are poised to pick up even more delegates from Minnesota and Colorado adding to our delegates in Iowa, New Hampshire, and Nevada.”<br /><br />“As people across the country view the results of yesterday’s contests, it is important to consider a few facts that have not been clearly reported. Not one single delegate was awarded yesterday, instead the caucuses in Minnesota and Colorado were the very first step in the delegate selection process. And there are still over 40 states left to go. The Ron Paul campaign plans to continue to vie for delegates nationwide.” Tate added.<br />Tate pointed out that the caucuses were essentially “non-binding beauty contests”, and that the Paul campaign is poised to pick up many more delegates in Missouri, Colorado and Nevada than the straw poll numbers indicate.<br />Tate also stated that following a strong second place showing in Minnesota, “the Paul campaign is well-organized to win the bulk of delegates there.”<br /><br />“We are confident in gaining a much larger share of delegates than even our impressive showing yesterday indicates. The Board of Medicine and the Board of Osteopathic Medicine and Surgery has<br />
adopted the following statement to clarify the standard of care applicable to the<br />
evaluation of an individual for the purpose of certification to use marihuana for any<br />
medical condition:<br />
<br />
Generally accepted components of a full medical evaluation to determine<br />
suitabitity and appropriateness for recommending treatment of any kind, including<br />
certification for medical marihuana, include:<br />
<br />
- a hands-on physician patient encounter<br />
- full assessment and recording of patient's medical history<br />
- relevant physical examination<br />
- review of prior records of relevant examinations, treatments and treatment<br />
response including substance abuse history<br />
- receipt and review of relevant diagnostic test results<br />
- discussion of advantages, disadvantages, alternatives, potential adverse<br />
effects and expected response to treatment<br />
- development of plan of care with state goals of therapy<br />
monitoring of the response to treatment and possible adverse effects<br />
- creation and maintenance of patient records documenting the information<br />
above<br />
- communication with patient's primary care physician when applicable<br />
<br />
The Boards expect that these medical encounters would be completed at permanent<br />
locations that enable the patient to retum for follow-up, consultation or assistance as<br />
needed.<br />

A physician failing to meet generally accepted standards of practice when certifying a<br />
patient to use marihuana for a medical condition may be found to be practicing below<br />
the acceptable standard of care and therefore may be subject to disciplinary action.]]></description>
