I just got back from this. The judge did not make a final decision. CA's attorneys did a great job and it seemed like the prosecutor was having a tough time getting his point across. The judge will alow them to operate until he releases his decision. He can wait as long as he wants to make a decision.

Nice find. The ruling in the case will make for some interesting groundwork, however it will be appealed regardless of where it comes down. This case will join the backlog of other mmj cases already sitting in the appeals docket.

 

I think the prosecutor may have done a huge favor to the movement with the position he argued. As the law clearly allows for patient to patient and caregiver to patient and caregiver to caregiver transfers. Further, there is a huge window in the law that allows for acquiring marijuana for medical uses without putting limits on the where it can be obtained by a patient or caregiver; my understanding is that would even include the black market.

 

Definitely something to watch.

can't wait to see how this all goes down when the judge decides to shut them down. lots of pressure is going to be on that guy. so can he just NOT make a decision and leave this thing alone?

 

as for the guys at CA... you have my support. good luck and don't give up without a fight. you are the heroes of my day right now. :goodjob::goodjob::goodjob:

hey everybody... post ANYTHING to do with the court dealings of compassionate apothecary in this thread. there are already a couple of threads griping about these guys so if you want to complain put it where it belongs... on one of those threads.

Burdick said the law sets a framework that allows patients to grow their own medical marijuana or they can obtain the drug from their registered caretakers, but does not address a third party providing the drug, Burdick said. "

 

Alas, we are allowed but one caregiver, who under the law, are permitted to provide to A registered qualifying patient, not His registered qualifying patient: 333.26423 Definitions.

 

(e) "Medical use" means the acquisition, possession, cultivation, manufacture, use, internal possession, delivery, transfer, or transportation of marihuana or paraphernalia relating to the administration of marihuana to treat or alleviate a registered qualifying patient's debilitating medical condition or symptoms associated with the debilitating medical condition.

 

Why does a dispensary not fall under those criteria?

....hmm how do u spell loud baby crying noises? Im gonna puke if i hear oner more person take up for these greedy types.... ya they take a risk, no dif than what i take. i sell my patient stuff for around 75 a half... no one screams about how brave care givers are.... hell if u peeps wanna pay me 20 a gram ill stand on the corner and sell it lol
