Man claims growing medical marijuana cost him his home

A Tuscola County man has a warning for all medical marijuana patients. If you don’t follow the rules, you could lose your home.

 

“I don’t think they should take my house,” says Patrick McDonald.

 

The Cass City man says police showed up at his home several weeks ago and told him he had to move.

 

The reason? The medical marijuana patient is accused of growing and selling marijuana out of the home. Police have the right to seize property if they believe it is linked to criminal activity.

 

McDonald denies selling marijuana, but admits that when police raided his home he had too many plants. He had only had clearance to grow medical marijuana for about 18 days, and says he had three medium sized plants, and 14 plants just days old. Under the law he says he was allowed 12, but thought some of the new plants would die.

 

“You’re gonna take my house for plants two inches tall?” asks McDonald.

 

Tuscola County Prosecutor Mark Reene says this should send a message to medical marijuana users and caregivers. They need to follow the rules.

 

He says his office is charging McDonald because there is solid evidence he was dealing drugs. He also says McDonald didn’t appear in court to challenge the seizure of his home. McDonald claims he never got notice of the hearing.

 

McDonald is scheduled to go on trial before a jury on December 16, 2010.

So riddle me this batman... If the law allows you to have enough to ensure an uninterrupted supply of meds, why is this even gone this far? He hasn't been charged with anything, yet they take his freaking home?!? What happened to unreasonable searches and seizures? How can the police decide that someone is guilty before even taking them before the judge, and steal their property? Seems they taught us in school how the American dream is supposed to be, but in reality it's all bullshat. This should not be happening over a medicinal plant. They admit this guy was using for medical reasons, yet they still are pursuing this? What a complete waste of money. Did anyone see the story this morning on NBC local news? It's not like he had a corvette in the driveway, or a million dollar home, yet going after the sick and disabled is easy pickens for the police. They show up, take everything you own, and your screwed. So they didn't send this guy notice that he had to go to court to fight for his property, his house?? Why the hell should he have to fight in court for his house when he HASN"T EVEN BEEN CONVICTED OR PROVED GUILTY IN A COURT OF LAW!?? I need to log off, this is just senseless prosecution, cruel and unusual punishment carried out against the sick and dying all in the guise of doing good, when in reality they are destroying lives.

Civil Forfeiture laws are one of the most disgusting consequences of the "war on drugs." How they've been ruled constitutional is beyond me. Seems pretty clearly antithetical to the spirit AND letter of the 4th amendment, but who am I to say? I'm just a lowly citizen, not a fancy constitutional or legal scholar who can "interpret" plain language to mean whatever they feel like.

What ever happened to due process does it even exist any more and the concept of innocent until proven guilty what happened to that oh that was when america was a free country and when we had rights but the fact is freedom and civil rights no longer exist in this country or should I say they only exist for the people that can afford it.

I know this site and it's admins do not espouse violence, but I'd applaud anyone who decided to snipe a rotten gentleman like this PA, not that I advocate it... Too bad Mark Reene hasn't met up with a psychopath in a dark alley, he's the kind of guy you throw a "Glad you're dead" party for. Take a man's home for a few finger high plants??? And think your smarmy self did a good job? These right wingers - I wish these guys knew in their hearts they are destined to a special hell all for themselves.

My uncle was the chief leo in X city Ariz. I know personally that undercover's would board huge party boats (the bigger the better) on the Colorado river as spring breakers. As soon as someone would spark up a doobie they'd bust the barge thus resulting in confiscation of their home, boat, cars...anything of value. It wasn't the pot they were after, it was the funds they made from the property they took. That's how they made their fun money for new cop toys. It was and is a total scam.

My great Uncle lived next to a piece officer in Saginaw. One day my Uncle's TV broke and he was complaining to his neighbor/LEO. So the officer told him to come over and pick out a TV, he had plenty. When my uncle went down to the officer's basement is was loaded with TVs, bikes, speakers, radios, art, small appliances, guitars, and much more. All taken from Saginaw citizens.

What are these people missing here 12 plants = 12 plants not 12 plants and 3 in case some of my 12 die and unless someone can verify that this guy wasnt selling cannabis to unregistered patients then he dug his own grave by being over his plant count they may not be able to prove hes a dealer but they sure are going to prosecute and take your stuff if your breaking the law .

By law 1 plant makes you drug dealer, no proof needed. The problem is the $180,000 fine he got and has not been found guilty of being over his plant count yet. Police usually bolster their case with embellishments.

I agree but look at it like driving over the speed limit. 5 miles above the lawful speed is breaking the law and subject to a penalty. Is it just to fine the law breaker the same amount for 5 mi over as one would be fined for doing 50 mi over the speed limit? I didn't mean to get off the point but part of the issue, as far as I am concerned, is the double standards by which LEO operates AND how non-violent offenders are treated AND the means by which they are addressed. The later point is referencing breaking down doors, shooting dogs, traumatizing children, financially castrating citizens, stealing property, taking personal/medical records, destroying property...

 

Point made and agreed...STAY LEGAL. In addition ...the fine should fit the crime.

The question I have is still how can they call a cutting a plant? Was it rooted? I still believe it should be defined. Because seriously a cop gets a pair of scissors and starts cutting he can make as many as he wants. Why is a cutting a plant or am I wrong. I thought that trimmings and roots and stalks don't count towards your counts only live plants and usable marijuana?

i think the rules need to change i think their should be a Major infarction and a mirror infarction

 

 

i agree..... they could call one ..........a mistake............one a crime. one involves criminal intent....if i have to :growl: o many pills, if i have expired pills..... the cops dont even notice. well it used to apply to weeed.....but hey burn em if you got em. least they wont sell your house and use it to fund the war against you.
