Please join us tonight for a very Special 2 hour Episode of Planet GreenTrees, hosted by:

It is our intent to provide a safe comfortable environment for the medical marihuana community to discuss the on going complex issues that are influencing our community.

Calling in Live to discuss all that is happening on the West Side of Michigan, as it relates to the Medical Marihuana Act, will be friend and fellow attorney warrior:

John Targowski

John Targowski is a criminal defense attorney from Kalamazoo. He's with the firm of Targowski & Grow, PLLC, a criminal defense and civil firm with an emphasis on cannabis legal issues. In 2009, John won West Michigan's first medical marijuana affirmative defense hearing, including getting the court to return the patient's wrongfully seized cannabis (he keeps a picture of the police returning the cannabis on his iphone) and he has litigated cannabis issues in the Michigan Court of Appeal concerning the MMMA's affirmative defense statute. John is a Michigan grad and went to law school at UCLA. He practiced criminal defense and disability rights in southern California before returning to his home town in 2007, where he set up a private practice.Since then, he has been NORML's Hunter S Thompson cannabis scholar as well as an advocate and activist on cannabis issues throughout the state, partnering with Daniel Grow at the beginning of the year.

John has been fighting for Patients rights and the implementation of this act as it was intended to be. We are looking forward to discussing his experiences representing patients and caregivers, and his thoughts on the past, present and future of the Medical Marihuana Act.

If you tune in for the show you will have 2 lawyers ( in case you have gotten sick of hearing from me) discussing the act, and providing some guidance of how to take steps to protect yourself from negative police encounters.

Also we are going to attempt to discuss some of the recent Court of Appeal cases (King, Kolanek, Reden) dealing with the MMMA, and what impact if any they will have on future litigation.

Also we are going to get the inside scoop on the Joseph Casias v. Wall mart case.

If you have a specific question legal question, please post it in this thread and both John and I will make some attempts to answer them on the show.

Are medical marijuana records at the MDCH protected by HIPPA laws? How about at dispensaries?

 

Will the transfer of responsibility for the MMP out of the MDCH through executive order effect us?

 

What is the best way to protect ourselves directly after cutting a plant that the leaves and flowers will be over our limit, until it can be processed into usable medicine and brought under the limit?

 

Since some courts are blocking medical marijuana defenses, what can we do to insure a fare trial? Would labels on the plants or medicine allow the jury to be aware of the type of trial?

If we are a cpl holder or sportsman, is there a way to protect our firearms from being seized and being charged with felony firearms? Or is there a best practice in storing our guns that would give us the best chance at a trial?

 

 

very good Question i know a lot of people that are inn court right now for just that it's sad to no that if you have a gun they are going to puss for the 2 years inn jail of plea to growing and they will drop it i here this all the time inn the court room but am no Lawyer i just play one on here

Michael K, For the radio show:

Are patient records kept by a dispensary, "safe" if mintained out of state? How about the patient records held by a a certification center if kept out of state (say, in Oregon?)(The practice of THCF, a certification center operated in Eastern Michigan, by a Foundation)

Michael, one of the most pressing issues that myself, and my patients have, is what is going to be the outcome of outdoor grows.

I have, since the law passed, had an enclosed (chain link top and sides with plastic cover), locked (self explanatory), secured (alarmed and secured to the property) facility. A greenhouse by any definition.

All of my patients are on very limited income. To be able to take advantage of natural sunlight, enables them to at least keep the cost down during summer months.

Where do you see the courts going on this?

I waited for most the show to talk, it was very interesting and I never did get to ask my question but that's ok. I was too upset to talk anyway so I hung up because I felt like I was gonna break down and cry. I am so upset right now. No one wants to hear someone crying, I wouldn't either so I didn't wanna subject anyone to it. I had written a question down but something went wrong and so I was gonna ask it on the air.
