Advice Request Re: Removing A Patient

What would you advise for this hypothetical scenario?...

 

You're a Caregiver for a Patient but you no longer want to be his or her Caregiver (getting out of the biz, leaving the state, change of career plans, etc.). You've settled any and all contractual obligations between you two, but for whatever reason the Patient won't send in a Change of Caregiver form to the state to revert the rights to their plants back to themselves or to another caregiver.

 

How can you remove them without them mailing a Change of Caregiver form to the state? Since it requires their signature and a copy of their license, it seems as if you would be stuck. Please advise.

 

Also, if the Caregiver had their maximum of five Patients (including the Patient who is no longer desired, who happens to be the Patient the Caregiver has had for the longest time), I assume signing up a sixth would result in denial of the sixth vs. "bumping off" of the undesired patient. Correct?

 

Thanks for any insight into this situation. I'm sure it must have come up before, but I didn't find anything in the forum.

It's upto the patient too change their caegiver, if you getting out of the business it's not a big deal to you. Obviously You don't have to grow just becaues your still listed as a caregiver.

 

If your trying to add another patient and you are at your limit then your Screwed unless you can have that patient assign another caregiver.

I sincerely apologize for the lengthy delay in response. As I'm sure you can imagine, we are extremely busy here in our department.

 

If the patient is not willing to (or cannot) complete the Change Form to remove a caregiver, the caregiver can submit a completed Change Form to remove him/herself as a patient’s primary caregiver. This must be submitted with a signed letter stating the patient was unwilling to submit the form him/herself, along with the $10 fee, photo ID of caregiver, and return of their caregiver registry ID card.

I don't think he's really getting out of the business (moving, career change, etc.). He just wants to replace this patient.

 

If you are actually getting out of the business, just don't worry about it. It shouldn't be an issue. Just forget about em' and cut off communication.

 

 

Most likely though, you're trying to replace. The only thing I could suggest is when you go to sign up your 6th patient, you include a letter of explanation saying you are dropping your 1st patient. I would think this should work, but who knows. It's worth a shot though. Just remember to keep copies of everything you send in to the state.

Thanks for this excellent info!

 

My only remaining question/concern is that it takes so long to receive a Caregiver card this effectively means Patients can't be dropped during that waiting period. No so bad all considered - just seems like room for improvement in the system. Regardless, thanks very much for this info.!

Ok not getting on my soap box here but some free advise.

Make dated copies of EVERYTHING x3 or more

I know the world is full of people that cannot get along for what ever reason so..... Gte to know the patient before signing them.

Make sure the patient and you have a clear understanding of what is and will be. Misunderstandings are the #1 reason for problems.

 

There is no clear cut way around the time leg with MDCH as of yet, but I am hopefull the recent move to LARA will speed up the cards (well thats what i am told by the people in the know).

this means this came from the new Schnieder ruling body in the state.

 

So in the last 2 days, I have seen two things about the new LARA administration.

1. they have assumed control. lol

2. they are seemingly prompt in making it known WHERE this information is filtering down from.

 

so i would ask Welj, when did you originally send in your question about dropping the patient?

 

considering LARA just assumed control, (love the use of the word ASSUMED in this instance), then it seems they may be on top of the game a bit more than MDCH, or atleast not as overwhelmed by it.

 

will have to see how it plays out.
