Let me be the first to say that p2p is not legal. Period. If a patient has a caregiver s/he must, by law, obtain it there. Period. If you are a registered patient who has no caregiver you are legal. Period. As a patient you can have any allowed amount and be legal. Period.

Uhhhh wow not really sure what to say........  A patient is protected NO MATTER WHERE they get it and no matter IF they have a CAREGIVER OR NOT...... All as long it is for their own medical use. This is supposed to give them protection of the card (section 4) anything outside of that and they are still supposed to have a section 8 defense.

I hear people say that p2p is a gray area all the time. They say that the patient doing the selling is in the wrong but the patient doing the buying is in the clear. I don't see how any of it could be legal. Just like I don't understand what happens if you get busted with mmj but don't have a caregiver. Dispensaries are not legal so you must have got it illegally.

Why is there P2P discussions in this thread ?

We have at least ??? P2P discussion threads on the Forums.

AWW Good idea Doc. In fact if the back seats are missing there could possibly be hooks where the seats were.

Thanks ozz.. I got thinking that same thing so... went out to take a peak at ole bessie... sure nuff I can latch some sort of lock to

where the furthest back seat would be. There are metal 'bars' there for the seats to latch to.

I also found an old rubber maid container with a lid but there is a nice crack in the bottom.  I am going to make a couple of cuts to

the bottom and hose clamp that puppy to the back end, wallah... I now have a trunk of sorts , LOL

 

I have been thinking tackle boxes that lock or for the ladies, those cosmetic cases for traveling that lock may not draw undue attention.

'Not readily accessible' just means out of reach from the driver. It will boil down to not be able to 'easily use it' while driving. Just like a gun. They just didn't want a joint at ready while you are driving. It's really in your best interests anyway.  It was a common sense thing because it avoids having to get a blood test for impaired driving because the cop 'saw it'. It's actually a win win when you look at it that way.

Ok, the changes take effect 4-1-13.  That answers your first question.

 

Second, in a pickup, you need a locked container.  You can get one at Walmart for $15.  I carry something like that and use a bike lock to secure it to a tie down in the back.  Getting a bed box or something would would 'create' a trunk, and it is lockable.  Unless anyone else has something to say different, I think if you got one of those walmart lockboxes and bike locked it to the rear of the driver's seat frame you would be just fine, gas stops and all.

 

Really not worth stressing over, very easy to comply with the rule.

it feels more oppressive every day. im really amazed people didnt object to this. I could dump out a 1k oxies in my lap and drive around the town and im ok, a half gram in the pocket of a dieing cancer pt and they are off to jail....wtf?

Truly sad isnt it?  Good thing they passed these bills to help the patients, caregivers and public huh?

Exactly why you DO NOT ask this legislature for ANYTHING. We want nothing from them. Because they work for law enforcement, not patients. When they are mostly gone, THEN we might be able to safely ask them for something for patients.

 

Agreed..... I would suggest not asking ANY legislation for anything. NONE of them can be trusted Republican and Democrats alike. And yes that goes for the so called independants too..

what makes you think the system will change after the next election cycle? hasn't shown any difference so far. just look at the national level, record number of arrest, and you guys swore we had change coming. we can keep doing that same thing and hoping for different results but it hasn't worked so far.

Hmm, so I have been reading for a while now.. where can I find answers about meds and my motorcycle?

I do use a backpack when I'm traveling with anything I have to carry, though I cannot ride around with a lock box strapped to my back. It's sketchy enough zipping around on that thing without riding uncomfortably to boot.

This was an old post but considering that it it still ranks #1 on google when searching "transporting marijuana in Michigan", and because there have been "Developments" over the past few years I thought I would weigh in, with the hopes that users have the most current information.

 

OK let's get to the guts of it.  I think if you do not have a car trunk or truly outside of car, locked case, you are screwed. 

 

Screwed = getting Medicine seized along with all cash or other subjectively deemed "contraband" from the vehicle and person.  then, "maybe"...arrested.

 

Screwed does not equal = going to jail.

 

I do not think in 2016 that anyone will go to jail anymore for anything lower than a half a million dollar issue when it comes to Medicinal Marijuana in Michigan.

 

The law is vague....INTENTIONALLY SO!!!  It gives the government the ability to interpret it in THEIR FAVOR as needed.  You REALLY have to get this.  If you have to argue the point, then the police...and this is important...had "probable cause" (PC) and a "reasonable" case for an arrest and search and seizure. Once the police have seized all your stuff and ruined your day, they won, you lost.  You "may" have a case but not a slam dunk, and let's be clear, how many of you are going to file suit and spend 50k (REALLY low estimate) to actually sue the police department...on a "maybe?"  (that's what I thought, ya me either)

 

The only way you can sue is if you have a solid case, that under the law, there was JUST NO WAY the police could have possibly interpreted the law in a way that any remotely sane person would agree that a law had been violated.  If they have even a half way decent argument...they win.  You are a "filthy drug using addict/dealer", police are doing their best to serve the community, sorry you day was ruined, but, well, shoot, mistakes happen... end of story.

 

All of these posts are talking about interpretation. Once you go there, the police win and you are screwed, why?  Because they already took all your stuff and ruined your day...all the while, they got paid their salary, that your tax dollars paid for...see?  You screwed, they, paid.

 

Now, a locked container in a locked trunk, leaves no where for the police to go.  If they smell the medicine, and you show your Card, you have removed PC form them...if they open your trunk, that was a violation of civil rights plain and clear...you will have to sue, but now you have a real case. 

 

Look at the Warren bust, look at the Fowlerville bust...no one is in jail awaiting trial...the cops came, took everything, frustrated their business venture and left the private citizen to do all the leg work to get any justice.  Warren may prevail, Fowlerville, less likely, but those are other conversations...the point is they got railroaded because the laws are vague.  They got everything seized and the police go watch football...no skin off their back.

 

Go with the strictest insanely punishing version of the law and follow that route.

P.S.  There is one single person that stands in the way of real progress...that is "Senator Rick Jones" former Sheriff.  Crazy Eaton County nut who "re" outlawed anal sex and prevented poor people from using their bridge card at a casino (which they already couldn't), and started self deputizing citizens to protect from the imminent Obama invasion several years ago.  He is in charge of the committee that has the new marijuana bill, and has already said he is concerned for law enforcement with the new law.  He cannot be reelected but has like 4-5 years to go before he is out.  Learn about Rick Jones.
