Recommended Posts

Nearly three months to the day after a medical marijuana raid thatresulted in a conviction against a Lake Orion woman, the case was back in court Friday for an evidentiary hearing.

Agro’s conviction for delivery or manufacture of marijuana wassent back to Oakland County Circuit Judge Wendy Potts’ courtroom by the Michigan Court of Appeals.

Prosecutors conceded that the trial court’s conclusion was valid at the time of the July 2011 conviction but is contrary to a 2012 Supreme Court ruling on the law.Agro asked for a new trial but the Court of Appeals agreed with the prosecution, which argued that a pretrial hearing should be continued.

If the Supreme Court's ruling in 2012 was contrary to the trial court's conclusion in 2011, how could the trial court's conclusion have been valid in 2011?

I think you would have a better chance with a jury........... With the high percentage of people that understand and are for marijuana. I would imagine that you would have a better chance of a jury not convicting you on a biased personal opinion on MJ over a judge.......

I noticed a report today the Zimmerman attorney (remember him?) is asking the State of Florida for $300,000 for legal expenses. Since the jury ruled Zimmerman was not guilty, the State must pay the defendants legal costs in Florida.

Would this same situation occur if the State of Michigan or a PA loses a mmj case? Does the State of Michigan pay the defendants legal fees if they lose a case after a jury trial?
