Help Me Be Legal Please!

Howdy all,

So I just moved back to MI from IN and I'd like to get my cookies in the market up here but I want to do it on the up n up with the law now. I'm not sure where to start. The cookies I've developed are pretty much a miracle treatment for inflammatory pain of all sorts and I know a lot of people would benefit from them. Do I need to become a caregiver? Patient? Something I don't know about? What's the process I need to go through?

I know all about the plant but nadda about the laws regarding it. Any advice on where to start would be much appreciated!

got any drug felonies or violent felonies? then you cant be a caregiver.

 

otherwise you have to fill out a form with a patient to become a caregiver for them.

the forms are on the website http://michigan.gov/mmp , click forms at the bottom of the page, then you want the change form.

 

if you want to become a patient, you have to have medical records proving qualifying condition and bring them to a doctor to certify you. there are benefits to being a caregiver and patient, like being able to posess 2.5 oz yourself and 2.5 oz for any patients you are registered with (up to 5 patients).

 

currently theres a nasty anti-extract court ruling, people vs carruthers. it should get overturned in the mich supreme court, but thats going to take a while.

 

other things to note:

caregivers are not making much money off of sick people here in the state.

its suggested to only be a caregiver for friends or family.

Currently edibles are considered illegal unless they actually contain leaves and flowers.

If they contain an extract like cannaoil or cannabutter they have been ruled outside the Michigan Medical Marihuana Act by the Court of Appeals.

 

If they are made with leaves and flowers then you can legally transfer them to the five patients that are connected to you by the State registry. You must have a card saying that you are their caregiver.

 

You cannot currently transfer to anyone other than your five patients.

Patient to patient, caregiver to caregiver and caregiver to non-connected patients are all illegal.

 

Patients can acquire cannabis from anywhere and are protected, the seller however is in legal jeopardy.

 

Dispensaries are technically illegal although some communities tolerate them.

You cannot legally transfer anything to dispensaries.

Looks like I'll have to sit on my recipe until the laws change then. It's really unfortunate that cookies made with an extract oil aren't legal. In my experience (which is very extensive) extract based edibles are the most effective way to use the plant for pain relief. I personally have an old injury in my lower back muscles and I'd take one of my cookies over a morphine any day of the week. Oh well. I'll have to follow the laws until they change.

My specific cookie recipe uses infused coconut oil. So where do I find a list of what's legal and not? I have recipes for everything from hash to green dragon tincture to pen-vape cartridges, so I want to know what I can do while staying inside the bounds of the law (once I've obtained my cards of course). Thanks for the advice so far :)

Our Court of Appeals has an anti cannabis agenda. They twist the law to take away our rights and then each case must be appealed to the Supreme Court. Most of their decisions are then struck down or returned to a lower court. This thread should help explain the current state of confusion.

I guess you're going to have to wait with the rest of us for the upcoming Michigan Supreme Court decision in State v Carruthers. Reactionary idiots who know no end in twisting jurisprudence beyond any semblance of reason on the Court of Appeals have ruled concentrates to be illegal. We know better, the SC has pretty judiciously found for us in a number of cases, and we are pretty confident that our arguments will again permit them.
