Is Sanilac County Leading The State In Illegal Transport Mcl 750.474 Tickets?

illegal transport victims. (a violation of MCL 750.474 which should not affect MMMA patients, just needs a supreme court challenge...)

a wise lawyer would pick up one (or a dozen) of these cases probono and appeal it to the supreme court.

i'm not sure if its wise to link to these terrible mugshot websites. let me know if we should just count the number of arrests and county name?

Even though the people have spoken, our state lawyer led a three-county raid without bothering to notify our county’s law enforcement that it was happening. It took over a year to return an indictment that was thrown out by the court. We see in the court blotter that people have been charged with improper transport of medical marijuana. (What the heck is that, anyway?) We fund a separate drug enforcement unit that reports its success as cottage garden yields they have seized that legally can’t be sold. How do they know the value of this stuff?)

the only other stats i can find , look up marijuana arrests by county :

Nice info assembly !

I wouldn't be worried, everyone knows how to legally transport marijuana, we even have to sign an agreement with the state stating so.

I'd like to know how these cops always know just who to pull over, which "compliant" houses to raid....after all how would a cop know about that extra clone, or unlocked door, rogue brownie, or that joint in a drivers pocket or dufflebag.  Those guys are psychic maybe :P

April 05, 2013 ELMIRA TWP. — Troopers initiated a traffic stop around 6:30 a.m. March 28 on M-32 in Elmira Township for a vehicle displaying a continuous turn signal.
According to reports, troopers detected the odor of marijuana on the driver, a 58-year-old Elmira man, and questioned him. He produced an expired medical marijuana card and retrieved a pouch of marijuana from the front seat of the vehicle.
The subject became confrontational and was handcuffed by troopers.
Further investigation by troopers produced a mechanical knife inside the pouch of marijuana. The subject was arrested for possession of marijuana and for possession of a mechanical knife. Troopers gave him a ticket to appear in 87th District Court.

Expired license plate leads to marijuana citation
• Troopers conducted a traffic stop around 4:15 p.m. March 29 on I-75 near Charles Brink Road for an expired license plate. After interviewing the driver, a 22-year-old Lansing man, and the passenger, a 22-year-old DeWitt man, troopers discovered the passenger possessed a valid medical marijuana card.
According to reports, the passenger volunteered that he had marijuana in the vehicle and retrieved it from his backpack which was on the front passenger floor of the vehicle. Troopers advised the subject that he was transporting the marijuana illegally, as it must be enclosed and not readily available from the interior of the vehicle. The marijuana was confiscated and the passenger was cited for illegal transport. The driver was cited for driving with an expired license plate.

^^^^ this is an interesting one. people were wondering if the case/trunk thing applied to passengers, like on a bus.

Do all of these say how the po po's pulled them over and what for?  if you are going down the road and not violating any traffic or equipment laws you usualy dont get pulled over and get a ticker for transporting mm, something I would say got the people pulled over other than what these convictions say, I didnt read anything accept for what was written on this thread, and read the charges in the dif countys!

If you truly want to know why these folks got transporting, than finding out how leo got interested in them would realy help,

Im willing to bet over 90% of them were pulled over for something other than mmj related!  I hope some one can tell me im so wrong, but I doubt it!

One night about 1am I got pulled over (before the transport law) and had a bunch of hydro equipment and small bag of meds in the back seat. I rolled the window down about 1 inch to hand my DL and registration to the LEO. He came back a few minutes later and told me that he stopped me because I had a crack in a taillight and there was white light shining through. I asked him if he felt that a quick repair with red tape would bring me back to the right side of the law. He replied, "well, it isn't that bad so don't worry about it. I'm just looking for people with guns and drugs." We both went on our merry ways.

My son was picked up for improper transport of medical marijuana when he and his friends where stopped for speeding. He wasn't driving. The cops ran their ID's. When he came back to the car, he asked my son to step out of the car. He said when he ran his ID and it came back saying he was a medical patient and his card was expired and his check hadn't cleared yet. We got the new ones in the mail 3 days later. He then asked to search the car. They found less than a gram. Was this a legal search? How does a cop get that kind of info running a state id? I've been told they can't.

Driver claims to use medical marijuana. While patrolling the area on West State Road near Woodschool Road, deputies stopped the driver of a black Chevrolet Impala that was weaving from the center line to the fog line. The 22-year-old Middleville man presented the deputy with a paper license. The man explained he was driving on a doughnut spare tire and that was the reason for his weaving. Deputies noticed the man was aggressively smoking a cigarette and had bloodshot eyes. Deputies also noticed a blue glass pipe on the vehicle’s center console. When asked about the pipe, the man said he had a medical marijuana card and used the pipe for that purpose. He also said he was allowed to operate a vehicle after using medical marijuana and quoted the "law" which said it was allowed. He presented the deputy with his Michigan Department of Community Health paperwork. The deputy said he assumed the man had his medical marijuana with him, and the man produced a baggy of apparent marijuana from under the driver’s seat. Reportedly, the man confirmed he was smoking marijuana at work. The subject also said he had a few sips of wine before driving. After taking sobriety tests, the driver was placed under arrest for operating a vehicle in the presence of drugs. When asked if he had any more marijuana in the vehicle, the driver affirmed there was but did not know where. According to the report, two more baggies and a glass jar containing marijuana, a digital scale and a pill grinder. An open bottle of wine, unopened bottles of wine and rum also were found in the vehicle. A total of 1.7 ounces of marijuana was present in the vehicle. The man was arrested, and a blood test was conducted. The case was forwarded to the prosecutor’s office for review.

Wow, they are tearing it up out there. I know that some of these locations are major drug interdiction routes, so they are crawling with MSP and Feds, and they are focused on it. Perhaps that has something to do with it? Are these all along I-75? I wonder if they are driving north or south, generally?

posted some more that define what street these people were pulled over on. no, i dont think they are all on i-75.

sanilac county is not anywhere near i-75, of course not all of these are in sanilac county, i guess i was just going by that one newspaper with all of the court reports instead of looking at what cities were involved.

According to the Farmington Public Safety Department, the driver was pulled over for speeding shortly after 3:30 a.m. The patrol officer reportedly smelled marijuana and alcohol in the vehicle, but the driver denied drinking. He did, however, pull a baggie of marijuana from his pants. The driver stated he had a medical marijuana card and knew that the requirement is to transport marijuana in an enclosed case in the trunk.

now c'mon....the police have no idea that a schmuck is driving around with a sack in his shirt pocket, until they pull them over right?  Now, why did they get pulled over in the first place?  Sure seems that the unfortunate few who decide to disrespect our simple transportation rules are the exact types of drivers who alert the popo enough to get pulled over. I'm sick of the black eye these goofs paint on our majority of law abiding medical patients. If police are somehow psychic enough to locate violators of the law, this mess should be cleaned up soon. I wish registrants would concentrate on following the laws, rather than breaking them only to plea bargain.

Don't do the crime, if you can't do the time. Sanilac county allows dispensaries, doesn't routinely raid law abiding gardens, and the DTF head is medical marijuana friendly. He urged us all to "play by the rules" or get busted, again(he LoL'd) at a city hall meeting. It's so much easier to comply, stay out of the news, and maintain good standing statistics, a pro vote for our program in the state.
