He was honest, cooperative and respectful, when he answered that he did have a locked case of his medical marijuana and had medicated earlier in the day. For this he was arrested, jailed overnight and is now awaiting a hearing to determine his fate.

If we could reach every single patient or caregiver in the state with one important message regarding the illegal transport law, would it be:

1) keep it in the trunk because they are trying to getcha;

2) the law is unconstitutional, fight it if they getcha?

 

1 is important. I drive an SUV but have a box and a compartment for it in the far rear. We know the first question "Do you have anything illegal in the vehicle?" the wording of the MMMA is very specific in indicating that marihuana is still illegal but its illegality is ignored when possessed by a LARA Registered Card Holder. I will admit I don't know the right thing to answer to that question. I would say "No" today. Interested to other people's thoughts.

 

2. The illegal transport seems like a plea option but the volume of cases makes me think it is the primary charge at the time of arrest. Wouldn't want to argue that the plea you reached was unconstitutional and thus stand trial to the original, likely worse, charges. I know you know but in case some others reading wonder why someone wouldn't fight it.

 

Driving the speed limit, being insured, having current plates, securing your frags (material) and not smoking and driving are the best ways to avoid any conversations all together. I notice the other citations issued in these cases and am renewed in my efforts to avoid being a person of any interest.

 

Amazing that the government cares about us hurting ourselves with medical marihuana that they will strip us of our Rights and Liberty in the name of "protection from yourself" but who protects us from them? Lawyers if you pay them enough. Not the politicians, prosecutors or cops, we pay to imprison us.
