Can We Please Get Away From Using The Term, "donation?"

It seems that there are a lot of folks out there who think that if they try to cloak a sale using the term, "donation" that somehow this makes an otherwise illegal act/sale  OK.

 

The MI supreme court has already stated that "sales" are OK between a patient and CG.  So why the continual and juvenile bend to "donation."

 

"Donation" means that you pay something with no expectation in return. 

 

It is ridiculous to take the position that "if you 'donate' $200 to me, I'll gift you an oz of MMJ in return."  This isn't a donation.  It is a sale. 

 

Please join me in an effort to quash this nonsense.

 

This is a thinly-veiled, and carelessly-veiled SALE.

 

Let's cut through the crap and quit pretending.  No judge is going to say "Oh, well this was a donation so it's OK."

 

The primary issue isn't whether a CG sells MJ.  It is whether a CG sells MMJ to a registered patient or not. 

 

This "donation" crap makes us look like fools.  So can we please find a way to stomp this out?

This is one of the things I get aggravated about also, couple kids go into a hydro store to get a dr rec, come running back to their car all happy and run to a dispensary, then come to me and ask why they got in trouble if they were legal, and I can't even begin to explain how little they really know about the mmmp.... I mean they know nothing, there should be a donation bucket for a t.v ad to educate these people..

It makes no difference Federally either. :-)

 

Donation was just a term coined so dispensaries and law skirters felt they could do commercial business under a guise.

 

it came from a time when they thought interstate commerce wouldnt come into play on donation or club membership.

because it wasnt a 'sale'... the donation thing is older than dirt. plus it sounds good in a jury trial.

 

i'm no fan of the word. every caregiver and dispensary guy who says it sounds so stinking oily.

 

but its something in court you know.

"my client never sold anything"

the lawyer uses it get leverage. a plea bargain.

little things like that may help in court. have to ask a lawyer if its actually true or not.

When I spent 3 to 4 months working in pittsburg the girlie bars inside of city limits had to have paistys on their nips, and out side the city it cost 20 bucks for all the tap beer you wanted and the girls could be naked lol,,,,,I dont know what this has to do with mm!

I always ask for a donation.

 

unfortunately, my patients just pay for their meds. no donations received thus far

 

oh, and this is NOT an offer of prostitution. I make this entry in hopes for a donation for my time. anything that happens between consenting adults in private is.......well, private

Nope we can not get away from it, and we do not have to convince a judge of anything just 12 people who are becoming more informed every passing day and are more likely to be part of the 64% that voted for medical marijauna

Now if your a caregiver with 72 plants for 5 patients and mabee yourself  i think then your going to have a hard time trying to sell it to a jury,

 

On donations, elec bills ,nutrients, gas delivery, time, ect...and showing no profit at end of year, and having patients all with legit medical needs,able to come into court and tell the same story, I think it would sell with an informed jury,  I think some non profit paper work would help aslo.

well the law says we can recoup costs, and that means equpment, time and delivery and it is not taxable, lt is the state that uses the donate or recoup costs which includes a wage for the person growing, no taxes involved, because according their thinking we are not making a living off of it, and most c.g's I know, even if they have 5 pt's and themselves to grow for are not making a good enough living!  when they make supply centers or dispenses legal and let pt growers and c.g growers supply them than maybe it wouldnt be a bad living!  and I mean pts get the same price they have been getting or a lil cheaper from their c.g,  but charge despenses more, if a pt would rather go to a supply/dispense than they must be able to afford it, or they will look for a c.g pretty quick I would think!

The trouble with your approach is that anyone of even below average intelligence knows the difference between a sale and a donation, and non-profit status has nothing to do with it. The Girl Scouts of America is a non-profit organization, and every year they have a cookie sale. They don't take donations and give away free cookies. They sell cookies.

 

Think twice before you decide that telling a jury you accept donations but didn't sell is a good idea. Just about anyone will see this sale for what is is, which means your calling it a donation means you have something to hide. Rather than fool the jury, you will be establishing something called "consciousness of guilt." That is not a good thing. I have heard too many non-MMJ folks snicker when they see a dispensary or other seller accepting "donations." They see right through it.

 

It is really is akin to saying " I didn't steal the car, I was just borrowing it with no intention of returning it."

Maybe people think if they say donation they won't get taxed on their product. Doesn't matter,it's coming and will be a high tax. Turn your grow into a Church and be a Reverand on line. Works for Al not-so sharpton......................
