Legal Guide Lines?

What are the legal guide lines for medical users whome are there own care givers as far as growing?

For instance when building a green house can I:

1. Use 1/2 plexi glass for the walls and ceiling.

2. Have it in my back yards.

3. Its 13 plants right?

4. How much dried product can I store?

5. Can I sotre the finished product in a deep freezer with a padalock on it?

6. Am I risking problems with the feds if the police get mad at me?

 

Any and all information would be helpfull. I just recently got my card for epilepsy and the doctors did not seem to want to tell me any specifics when it comes to the law.

6. You would have to be outside the state law to have the feds bother you. They only mess with hogs that are obviously trying to go around state law to supply more than 5 people.

Those are all great questions I would start by reading the law cover to cover and then a few days later read it again and again.

Do your best to not get caught with more than 2.5 ounces. Either don't grow too much or figure out another way to not get caught over. If you do get caught over itcould cost you over 10 grand (for a section 8 defense) to get yourself out of trouble.

plexi glass is fine, as long as its translucent not transparent. or put a window film on it to diffuse the light. e.g. no one can see thru your window and observe your plants.

you can store dried product any way you want. probably child-proof container for best results. but a lock is not required by law.

no, if the police get mad at you, its very unlikely that they will bring it to the feds. as long as you stay near 10 plants. if you start getting more plants on the property, around 100+ then theres more interest from feds.

the 2.5oz of dried usable marijuana is protected by section4 of the law. sec4 protects under arrest. sec8 protects any amount required for uninterrupted supply of medicine, but thats only in court, sec8 does not protect against arrest.

 

as for having more when harvesting, it has been suggested to harvest buds as you go. leave them on the 'plant' until you want to use it. that way its still counting as your 'plant' and not as your weight.

Only if you are not smart or extremely unlucky. If your life style involves a good chance of being searched then you should weigh that in.

I will definately look into that. Also is it legal to (Rent) a chunk of property for growing of someone else (with a lease agreement)?

That should be fine for a single patient grow. There's a court case like that for a caregiver, multi patient, big grow and it didn't go well. The property owner was a felon and things went down hill from there. Stay small and you will have a better position of strength to work from.

Keep in mind if the helo flies over they might send boots to see your card. They were doing that a couple years ago. If they can't find anyone producing paperwork then they will probably tear it down.

the 'legal' thing is where a lot of people get confused with our law.

medical marijuana is not 'legal' here. the MMMA only provides a little protection from arrest and prosecution with a drs recomendation.

 

most people dont run into problems.

 

if you and your car smell like weed, you can expect problems.

if you send your kid to school, and he smells like weed, you can expect problems.

if you mail weed and your mail smells like weed, you can expect problems.

if you have a reoommate or ex-partner who hates you and knows you have marijuana , you can expect problems.

 

its all in how you conduct your life.

 

quick guidelines:

1. dont smoke in your car

2. dont tell anyone you grow

3. make sure to keep your greenhouse locked (and make sure it has a roof or a fence over the top), and like resto says, some cheap fencing around the greenhouse will go a long way... cops just dont want people able to reach over and grab a plant. or see a plant.

4. make sure to have a qualified doctor keep your records up to date with the law. dont use a doctor unless he has a medical clinic.

5. dont sweat it so much. joining this program was one of the more stressful parts of my life , it takes a good 6 months - 1 year to feel 'normal' again. am i a monster for using marijuana to treat my self? hell no..

I understood it completely, and suggested simply to read and follow the law, instead of worrying of getting away with something or not getting caught. might be a glass half full thing ? I don't know. It is better to be pro peace than anti war you know.
