Michigan Supreme Court Chief Justice: 'i'm So Sick Of Medical Marijuana Cases

Recommended Posts

Young said the equally contentious issue of medical marijuana continues to confound proponents and opponents alike.

“I’m so sick of medical marijuana cases,” the judge said.

We're not there to reform the statute, that's the legislature's job -- Chief Michigan Supreme Court Justice Robert Young

He said the Michigan Medical Marijuana Act, passed by voters in 2008, was created by proponents but consisted of parts that were “cut and paste” from legislation in other states and resulted in a confusing hodge-podge.

“It’s no model of clarity,” the judge understated. “It’s a mess.”

Young said it has fallen on the courts to decipher the intent of the muddled law, but it is up to lawmakers in Lansing to make clarifications and changes that can make the law more rational.

“We’re not there to reform the statute, that’s the legislature’s job,” Young said.

yeah why is young complaining about this? thats weird.

the legislators dont want to touch it, supreme court does not want to touch it, the COA is having a field day trying to ignore appeals, then when forced , writing up a bunch of moo poo that the MSC has to fix. lol.

seriously, what kind of cases does he want to hear ?

The original error was in King, in ruling that the Public Health Code statutes prohibiting marijuana as a schedule I controlled substance are still intact and in effect alongside the MMMA. That was the error, and it has been repeated several times now, with other courts picking it up and running with it. If they correct that error, they will stop getting cases.

Could you please go into more detail on this?
