Hey everyone. Wondering if it is legal to sell my seeds to others. Who may I sell to? Can I set up a website and sell them online?

selling seeds across state lines runs into federal jurisdiction, would not recommend it.

It is not legal in MI. Doesn't make a lot of sense but only a caregiver can legally sell to their own registered patient. The law does not cover the how of of how to get genetics.

Its ok for a patient to obtain genetics but not for anyone to transfer to them other than their own CG.  What comes first the chicken or the egg!

 The law does not cover the how of of how to get genetics. 

nor the how of how to weigh the thc ingredient, the how of how to justify a disp, or the how of how to transfer genetics,  yet peeps figger out both seed and clone transfers and retail weed for the masses as well as finding actual evidence of a plant as its particulate dust lies baked within chocolate...behold the paradigm upon which our law was torqued; suppose by defining nothing we allow everything?

Would you tell us of your efforts to produce special genetics for the masses? More important than the genetics used may be the condition of your breeding room, timing of your pollination, and room parameters throughout the seed development. How far did you go to stabilize the genetic pair?

I would tend to agree with selling seeds to your 5 patients, but if they plan on doing anything with them, they must possess the plants.  Actually you can sell to 4 of 5, because you need to possess the 5th's plants to produce the seeds.

 

Commercial sales to others is a little hairier.  Seeds and stems are incidental under the act and don't count for weigh, but is a 'commercial byproduct' you intent to sell really 'incidental'?  My opinion is that you are on risky ground making the argument that seeds don't count for weigh BUT you can sell them.

If your a patient with your own plant count you could sell to all 5.  I don't think you would have a problem selling incidental seeds to all your patients regardless.  A plant is defined as past the cotyledons so seeds wouldn't be considered a plant.  Which is why laws suck.  The people did not intend on splitting hairs over seeds. They voted for us to be able to use.  The gov't just uses this crap to persecute.

 

Sorry I just realized how insane this situation is.  Asking questions on a website about legality of seeds. When o' when will we get our day!!   One could argue that without seeds the program is screwed and they use it as a loophole.  Any sane person would see it's integral to the running of the program.

Good points.  Keep it in the family and you may be ok.  Your safety goes down if you go outside of your patients though.

Has there ever been an arrest or prosecution for buying or selling seeds by a patient or caregiver in the state of Michigan?

Not sure.  If the answer is yes (conviction or not) I would say it argues against it.  If no, then it simply may not have been addressed and really doesn't tell us much.

I think seeds can be sold as novelty items.

I've seen them on ebay, and amazon as fish bait. with al-luring names like afghan kush fish bait, and Plushberry fish food. I'd refer to Doc Bob's post though, before I figure that legal. not sure. they are in Chinese bird seed at Walmart and some will sprout and grow. I've done it.
