Caregiver Change Process

Hello,

 

I'm a new medical marijuana patient awaiting the arrival of my card.

 

When I submitted the application, I designated myself as care provider just so I could get things moving forward. However, I cannot grow my own medication and am working to find a caregiver.

 

I understand that I need to wait for 21 days after my MMMP application check is cashed before being considered approved. However, the caregiver change process has me a little confused. Do I need to wait for my card before I can designate a caregiver, since the change form itself requires a registry ID (card number)?

 

Also, a question on the amount of waiting involved. Once I find a caregiver and we agree to work together, do I have to wait another 21 days (or some other period of time) after the $10 change fee check is cashed before the caregiver can supply me with medication? I can't seem to find a definitive answer to this question.

welcome to the boards.

 

i will caution you to always be safe when dealing with medications.

 

i agree with KING above.. send in a change form when you want to dedicate a caregiver.. it's not your responsibility to wait for LARA to get their operations in order.

 

the 20 day rule applies only to LARA and your ability to prove your compliant to LEO.

 

you are legally allowed to use and grow cannabis the moment the Doctor signs your recommendation.  

 

understand the card only clears up any questions for Law enforcement and shows your application has been checked by LARA.. the doctors signature on your recommendation is the authorizing entity for allowed cannabis use.

 

the only time you need to worry about the 20 day rule is if your approached by law enforcement... it makes no difference other than that so long as you did not make any mistakes on your application.. (and even if you did you will be given the appropriate time to correct and resubmit it..) but the only thing that says you can or cannot use, acquire, or grow your cannabis for medicine is the doctor approving your condition.

 

grass i don't understand why you would wait if a patient has a card and you file the paperwork for the change of caregiver.. makes no sense to me ?  particularly on a change form?

ah, let  me explain.

waiting 20 days after a check is cashed, or a form is mailed IS NOT the go ahead to use or grow cannabis. A card protects us from arrest, not necessarily a return mailing receipt or a cancelled check.

I falsely believe that 21 or so days gives me a better chance of intercepting a registry issue if one arises, than say, a day or two after the check is cashed.( had a cashed check, disqualified registry, at the same time in the past) I whole heartedly know that only a card offers me protection. I do however call lara monthly, and with each new registry, and inquire

 

I do not believe we have  right to grow cannabis with only a doc rec, but I do believe we can use it legally with only a doc rec. I think the state is adamant bout knowing exactly where cannabis is growing(?)

We have no way of knowing though, if the physician is qualified to give that rec, until the lara does their check(had a doc disqualified in my registry), making mailing it in, receiving a go ahead, safer. A doc rec will not protect us from arrest, but a card is supposed to, if we are compliant. I call LARA at the near 21 day for each new applicant and verify my caregiver registry status before I meet them for the first time. Lara says accepted most often by this day, but has said we didn't get to that one yet also, and I wont deliver then, until it clears lara.  sorry to my new  patients, but that's how serious I am.

 

I'm the one responsible for covering my own azz. If I don't do it, who will pay for my defense? :judge:

Prior to starting the process for certification/registration, I was able to validate my potential certification doctor's license with the state.  Notwithstanding the process that LARA uses, I felt reasonably certain that the doctor was fully qualified.

I had an issue with my paper work the first yr, It was at least 55 days after check cashed, and I didnt recieve a letter saying I didnt qualify!

 

I went in front of a judge with my paper work, he asked me how am I supposed to know if you got your letter of disaproval?  Which is a good question for a judge to ask, I had no registry # yet and no one could find out, I told him I hadnt gotten my plastic yet and it was taking like 90 days at that time, he gave me 100 days from check cashed to produce plastic card or report to do my probation violation jail time, I got my card before said date and all was good after,

 

Im betting a few people have used that paperwork even after they had gotten a denial letter, (i said betting not sure lol)

I personaly think the paper work is only good for wiping my butt or starting a fire!

 the physician in question was performing surgery the day before and the day after my cert. I had no reason to doubt him. It was lara that required an up to date class credit, and let me know they didn't have it. The credit was fulfilled, and he has been my doctor for years with no issue. He gave me a free pass to his office for the following year certification for my troubles. Lara was understanding and I was in no real trouble, but could have been confusing for an investigating officer on the phone with lara.

the paperwork should be more bullet proof than the card... considering that they have had 6 years to buy a new computer and printer and 30 million dollars would pay for it all in a new building.... we didn't ask for paperwork the original mma demanded cards fast
