Transferring Patients And A Grow

Hello, a close friend of mine is a caregiver with 5 patients and a grow.  Is it possible to transfer the 5 patients to me, with their consent of course, as well as the grow room?  He can no longer be involved and would like me to take over but I am very wary of breaking any laws...

sure, as soon as you send in the change forms and get the cards back from lara, then you will be able to posess those plants.

 

make sure to follow the rules on transporting plants, if the plants need to be moved.

and make sure your grow room is locked, secured and enclosed.

 

if you are just taking over a room, i guess he can hand you the keys after you get your cg cards.

when the patient submits a new change form, lara will issue a card to the new cg who is allowed to posess plants and send a letter to the old cg telling him he is not allowed to posess plants.

 

the old cg is now not allowed to posess any plants.

those plants are the patients plants. the patient has declared that the new cg will posess those plants.

so therefor it is the patient designating his/her plants from the old cg to the new cg.

 

i know a lot of caregivers dont think plants are patients property, but i think thats how the law spells it out.

I don't disagree with your position, but I'm  bit lost on the logistics.  The supreme court says CG2CG transfers are not protected.  So I don't know how the former CG could transfer plants to the new CG. 

 

Similarly, there appears to be some ambiguity with regard to a CG transferring plants to a patient.  Where is the "sweet spot" where it is just about no longer OK for a CG to possess plants yet it is OK for the patient to possess plants even though he designated a CG to possess plants?  So, while exploring your legal theory, maybe you could be a bit more specific about when and how the plant transfer would play out.

Mmmm kay no.

 

the old Cg can't legally transfer his plants to his patients that are not allowed to possess them.

The old CG can't legally transfer his plants to you as you are not allowed to possess them.

 

If you are changing address and plants, I would send in the change forms for the 5 patients, and quietly box up the plants and move them to your new location in a moving van. As the new CG you are allowed to procure plants for your patients, it's the old CG who would technically be breaking the law. And LEO would have to have the will and the evidence to bring him to court... You catch my drift? I wouldn't worry about it excessively personally.

 

I'm not a lawyer and maybe someone can come up with some plan that ensures even the transfer of plants from the old cg to you is 100% above board legal, I just don't see how.

as long as your friends do the change form all is legal, the c.g cant change them to you only the pt can! that is all there is to it!

 

so be sure all pts are on board, your friend can not change them to you only the pt's can do it!
