Hershey Sues Edible Marijuana Company

DENVER (AP) — The Hershey Co. has sued a Colorado marijuana edibles maker, claiming it makes four pot-infused candies that too closely resemble iconic products of the chocolate maker.

The trademark infringement lawsuit was filed in U.S. District Court in Denver this week against TinctureBelle LLC and TinctureBelle Marijuanka LLC.

 

It alleges TinctureBelle's Ganja Joy, Hasheath, Hashees and Dabby Patty mimic Hershey's Almond Joy, Heath, Reese's peanut butter cups and York peppermint patty candies, respectively.

TinctureBelle did not immediately return messages seeking comment. The Denver Business Journal first reported about the lawsuit filed Tuesday.

 

The company's website says its products, which include lotions and balms, are "diabetic safe and delicious" and helpful with a variety of issues, including pain, headaches and insomnia.

The edibles are sold in Colorado's legal pot shops and medical marijuana dispensaries.

 

Pennsylvania-based Hershey says TinctureBelle products are packaged in a way that will confuse consumers, including children. Hershey's suit says TinctureBelle "creates a genuine safety risk with regard to consumers" who may inadvertently eat them thinking they are ordinary chocolate candy.

The lawsuit was filed as Colorado lawmakers look to tighten safety regulations for largely unmonitored marijuana snacks that can be indistinguishable from regular candies and baked goods.

Parents and doctors have said some children are eating the highly potent gummy bears, cookies, brownies and other items by mistake, sending them to hospitals in increasing numbers.

 

Hershey wants a judge to order TinctureBelle to stop selling the items. It is also seeking damages.

"Individuals and families the world over trust Hershey and its various brands as signifying safe and delicious treats for people of all ages," the lawsuit says.

 

More than two dozen people had reported poisonings from marijuana edibles to the Rocky Mountain Poison and Drug Center as of April, citing dizziness, nausea and hallucinations. At least six were children who swallowed innocent-looking edibles, the poison center said.

 

Pot critics' concerns about the marijuana-laced products were stoked by the March death of a college student who authorities said ate more than the recommended dose of a marijuana-laced cookie and jumped to his death from a hotel balcony. In April, a woman told a 911 dispatcher that her husband was hallucinating and talking about the end of the world after he had eaten a marijuana-infused candy and taken pain pills shortly before allegedly shooting her.

 

Supporters of the new marijuana law and some experts say alcohol causes far more problems among users, and the issues with pot can be largely addressed through better regulations.

Like I have always advised; Eat your cannabis oil in a gel cap and then enjoy your favorite snack. Knowing that oil in a gel cap will nail the dosage better than an infused product, I do not understand the need to mix the two, other than someone's money making scheme. Making a proper dose of cannabis is always job one. Deciding how much candy, cookies, or brownies to eat is a lot harder than eating a gel cap dosed and tailored to you specifically.

 

Solves so many problems. Patent holders and parents can relax.

Im hungy too, man I most def like all hersheys but my bellie and head dont (thats where my weight gain shows up first)  I can see making sure the packaging dont look anything like any candy out there that  has been out there, Like why cant they be in clear packaging with the ingredients on it and not for use for children, or the rx sign on it, come on lets face it we all want good medibles, I truly could give up smoking for the most part giggle  but I do enjoy the taiste of a good strain just like cigar people love the taiste of cubans!

 

This can all be worked out, id have to say if I knew my kid got a hold of a peice of hard candy and I knew what it was, I would probably wait it out for the most part, Im not talking a 2 or4 yr old but by the time I was 6 I was already smoking tabbaco that I stole from my parents!

I would have to think if a 5 yr old got a hold of a small amount of candy that making sure the kid got plenty of water and juices would be fine, I mean the parents should know how their kids are, if you realy think they need medical help well seek it,,,,,look at that idiot cop that ate mm he was hilarious, but he was also scared, did anything happen the the jerk off? lmao  yea I know he wasnt a kid,

 

Parents do need to be responsible, if you have medications you dont keep them  in the kitchen cupboard do you? if your kid got ahold of some morphine it would not be good, as a parent we need to make sure our children cant get a hold of our meds, if we make brownies at home, we make a batch for the kids (no mm duh) and we make a batch for us pts and it dont stay in the kitchen, I have a fridge and cabinets in my man cave along with my g.r, none of my kids have ever gotten any of my methadones or xanax or any of my rx's, because I make sure I count them and keep them where they can not get them, and I have step kids who are addicted to opoids, the only way they can get to my stuff is with a sawz all!

 

mm edibles should be marketed as such and not be able to make no mistake what it is!

mixed feelings about infused candy. like the candy cigs of yesteryear....prolly not a good idea as it turns out. maybe someone could make a mini whisky bottle(think airline hooch) with kool aid in it?   Or syringes with candy syrup in them?  well, I guess they do already have morphine suckers I hear.  its a brand new world
