Medical Marijuana Moratorium In Fenton Could Be Nearing End After Four Years

FENTON, MI – A four-year moratorium on medical marijuana in Fenton could be nearing an end, opening the door for legal distribution in the city.

 

City Manager Lynn Markland said the city council could soon begin drafting a zoning ordinance for the use and/or sale of medical marijuana at its July 7 meeting.

 

Residents holding their medical marijuana card are currently allowed to use and carry authorized amounts of marijuana in Fenton, according to Michigan law, but the moratorium stops the distribution.

 

"I think what we'll be doing is proposing something to the city council that they can consider approving for probably zoning," he said.

 

In 2010, the city placed its first moratorium on certain land uses connected with the use of marijuana for medical purposes. The moratorium has been continued several times and is still in place.

 

In February, the Michigan Supreme Court invalidated the city of Wyoming's ordinance which strictly regulated medical marijuana and the city had to rewrite an ordinance regarding growth and use of it.

 

"We were waiting on case law that further defined the state law," said Markland, adding the February decision makes it easier to look at an ordinance.

Fenton Police Chief Rick Aro said there have been few arrests in regard issues with medical marijuana.

 

"We've had a couple of instances with people in possession and in violation of the medical marijuana requirements," he said.

 

Aro added there hasn't been issues with distribution during the moratorium.

 

Several municipalities in Genesee County have looked seen discussions about medical marijuana since the passing of the Michigan Medical Marihuana Act of 2008.

 

Swartz Creek officials passed an zoning ordinance to allow for dispensaries in the general business district and growing facilities in the heavy industrial district.

 

Meanwhile in Davison, their moratorium expired in September 2013 and, in March, a caregiver opened the first dispensary business in the community.

Yea, that is all whack, they want people to open their doors for business just so they can kick it in and steal everything..

 

The main problem is the Township of Fenton, which is a different entity than the City of Fenton. More important that's two distinctly different police departments. Township has the GC Sherrifs, who just upgraded their accomadations from the Fenton Township Hall ,  to the recently fazed out, since we built them a huge new one, former Fenton High School. (Reassesing the situation, later in the day, Ive determined they have an office in the building, which is now the Fenton Middle School )

 

You will rarely see a City Cop, less you start getting loud. Sheriffs though is another story, they work the freeway, stop signs, etc... watch out.
