Out Of State Grower Protected By Mmma

HI

I spend several months of the year at my uncles in michigan ( i live couple hours away in IL) and im going to purchase a house in michigan (kalamazoo area). MY job is in IL so  im not sure if i should make MI my primary residence since i spend time in IL with family/job and would prefer to keep IL residency. I would also first have to ask my job if there are any issues with me switching states. Are there benefits to switching residency? would i pay IL income tax and MI property tax? I also have OMMP card which protects me as medical marijuana patient under 4(j) of MMMA but DOES THIS INCLUDE PROTECTION AS A GROWER ALSO? Can I legaly grow in MI wth my ommp card. Im stuck in IL with not so friendly MMP and cops still arrest 90% of small posessions eventhough they can give tickets instead. IL mmp requires a few million $ to start a desp, and wont allow self cultivation.  i really cant afford 350-400 per ouce when it can be grown for 40-50$ per ouce and you know exactly how it was grown as small grows need little to no pest spaying.

 under Section 4(j) of the MMMA, a registry identification card or its equivalent issued by another
state government to permit the medical use of marihuana by a qualifying patient or to permit a person to assist with a qualify patient's medical use of marihuana has the same force and effect as a registry identification card issued by the department.

you'd only be a visiting qualifying patient if you dont have residence here, or less than 30 days.

 

(l) "Visiting qualifying patient" means a patient who is not a resident of this state or who has been a resident of this state for less than 30 days.

 

so if you changed residencies to mi, you'd have to get a mmmp card.

 

its my non-legal opinion that you are protected , as long as you have a valid ommp card to grow in michigan.

as long as you follow the michigan rules secured enclosed facility and all that.

it hasnt been tested in court. i am not a lawyer this is not legal advice.

 

but yeah it'd be much cheaper, as long as you dont mind paying for a house haha.

thank you t-pain for educated answer, many many calls and emails even to multiple attorny in MI only resulted in spam calls to my cell the next day(i beleive one attorney office signed my cell for telemarketing calls because i said i would call back and didnt, im sure of who it was :)) most laweyrs i called (norml listed) didnt seam to know about the mmma, as if they didnt even read the law. all the talk about compasion, medical, caregiver, support the community :money:

You can be MI resident and spend over 6months at a time out of state as long as you keep MI Drivers license etc. If you work out of state you must still pay MI income taxes. it seams MI will be my new state! do you know if you have joint pain or migriane headaches you qualify for mmma? does artheritis have to be diagnosed? would my IL medical papers qualify so the MI medical marijuana doctor can write recomendation or must i be rediagnosed by MI primary doctor? Can my future primary doctor in MI be a mm doctor who can also give me a recomendation? sorry for so many questions, many more calls needed

call a certification center, and follow their directions exactly. Pests use plant for survival, regardless of the size of agarden. Controlling them begins with proper garden atmosphere controls and habits. I've seen huge gardens controlling the issue with natural means instead of sprays. A really good growing resource, sure to be a table favorite, is Jorge Cervantes Grow Bible, 25 bucks new or free online somewhere. A total proper garden experience will be explained and designed in the book for you, with glossy pics, thick pages, and coverage of most everything medical marijuana.

no problem. finding a lawyer who knows the mmma is kind of rare. probably a dozen or so in this state really know it.

nice job calling treasury about residency requirements. i wasnt sure where to go for that hah!

 

joint pain, arthritis and migarine headaches qualify as long as they are debilitating.

arthritis has to be diagnosed by a dr. xrays or other tests will prove this to a dr if you have them already.

IL medical charts, notes, tests, etc are good for drs here. the dr will read your history, make his diagnosis and give you his rec to use mmj. if your charts or notes are more than a year old the dr may need you to do new tests.

you can be diagnosed and treated by a cert dr only if you wish.

make sure you get follow up appointments to stay within bonafied dr-pt relationship.

 

edit: oh yeah, any MD or DO can write a medical marijuana recommendation. most drs do not write them due to hospitals setting policies against it...

 

and feel free to ask more questions. theres a lot to figure out, its not easy jumping into the program...
