I get where you are coming from but it doesn't answer my question. Anybody out there have an answer for me?

yeah sometimes poster just offer supportive posts to newer members. I really believe this is a great question, one I've asked for years with no definitive answer. Could federal funds can be used to supplement your rent and accommodate your use of a scheduled drug on premises ? I hope so. Feds threw a hissy over card holding patients that wanted to purchase a hunting rifle a couple years back, based on federal drug laws. good luck, stay safe

some landlords are ok with it, some are not.

so the question is are the feds allowing mmj patients in sec8 housing yes or no?

and the answer is sometimes yes and sometimes no

 

just depends how discreet you are about it.

 

can you have a mmj card and live in fed housing? absolutely.

can you eat edibles and use topicals in fed housing ? easily.

 

can you smoke or grow in your apartment? not easily. not recommended. no.

 

your other question is, will the state law protect me from getting evicted? maybe? after some court case.

but, will the state law keep the fed dollars paying for your apt? no. feds can and have removed support of mmj patients before.

 What I can overall say about it is...

 

 It is not allowed(doesn't mean ya cant get away with it),  a landlord can deny initial rental outright.  If already renting, the landlord should help you find different accomodations(if they are nice).

 

 Most of this is generally discretion of landlord, but a knowing landlord could be putting themselves at risk as well by turning a blind eye(highly unlikely risk and highly unlikely a 'blind eyed' willing landlord).  :-)

Keep it Secret. Keep it Safe.

 

 Not that I 'like' giving that advice,... just,.... it is the best advice in the current environment, espescially those  dealing with this topic.  Your "use' is "ok" if it is not being done in your apartment or landlords property so to speak.  Possession of a card means nothing and causes no detriment.  Use of illegal drugs generally does not effect your eligibility unless the drugs are specifically keeping you from working or specifically causing your disability. (generally and for the most part.) Small disclaimer). ;-)

Not sure if this helps, but my sister has subsidized housing and it is stated in her lease that she can NOT have a FEDERAL ILLEGAL DRUG in her possession in her apartment or on her premises. She lives in Monroe, it that helps. Also, she has had an anonymous call to the office about her MEDICAL MARIJUANA,  and the office told her if she gets one more call, she will get an unexpected search and if found with anything then she will have 10 days to move out. Hit me up in pm if you have any further questions about this. Don't want to say to much out here for the sake of my sister and her home. 

 

Edit to add: The apartment complex did not care that she is a cardholder, it is against Federal Law so they told her it does not matter if she has a card, if she is caught with any of it, she will be evicted in 10 days upon their random search.

I would say, the answer is NO based on information I know from my sister whom is in Section 8.

Many of these apartment are moving to a "No Smoking" policy. Most, if not all, have you sign paperwork  where you agree not to use illegal drugs on the premise.

Most, if not all rental agreements states that the owners may do a yearly inspection (this is to insure that you have not caused any damages. with 24-48 house, the owner reserve the right to enter the apartment.

You also agree not do to anything that disturbed your neighbors. your smoke could do this.

 

MSHDA does not allow for cannabis smoking in its apartments.

 Read your lease/rental agreement, it most definitely should state all conditions of the rental there. Also remember this adage from WWII, "Loose lips sinks ships!" No one needs to know anything about your private life or medical conditions unless you deem it necessary. Tell people about your mmj use at your own risk!
