Do You Want To Know The Law Or What You Can Get Away With?

As a rule when some one is asking about something about our law, I try to give them the law not what I think I can get away with! 

 

but this thread is for any kind of question about the law, I will not tell you how to try and get around it, I will only speak the truth about the law and questions or comments in this thread, when ever im asked about our law, I do my best to tell them the law, not how to get around it, trying to get around the mm law will most def put you in jail and w/o legal status!  You choose do you want to be legal and out of jail or manipulate the law and take a chance of going to prison for a plant.

I assure you at this time my friend it would not be good if you got caught lol!  now im not preaching from my soap box, im just saying if you feel the need to do what ever you do, well that is your decision, but I know what it is like to have life long friends who dont have loose lips!

 

Take that how you will, I honestly think if I got caught breaking our law I would deserve what ever the courts decided, If I was within the law, I will fight it all the way and I do have faith that the truth would prevail, and of course an awsome attny would help also!

phaque, i closed down the rooms due to overages.. I got enough for my patients now and a month from now.. I needed a good break anyway, 5 yrs straight growing a perpetual.. dam I am tired.. also need to re clean, paint, disinfect, etc, cause its hard to do with a room full of flowers an bunny muffin.... so I'm on vacation .. when the need arises, i will fire up again..

Another scenario to add to the over all concept of being a caregiver full time... it is work!

There is no 'vacation' time.

 

Blessings to you Willy and to all cg's who put their bodies, minds, souls and $$ into this

labor of love.  It is a way of life that is all encompassing, just growing the medicine alone...

then to have leo, our friends, neighbors, family etc... to worry on too...

 

Growing any green thing is not for everyone.  What if a person has a 'black thumb'? There are

a ton of peripheral reasons such as space etc.  I am talking about that curse ^^

It takes passion, a willingness to learn, learn from mistakes, suck it up when a fail happens,

PLAN, then discover plans can and do fail..

I grow green things and am still struggling to be successful at growing my own meds.

 

So... that being said, BLESSINGS to all who grow this plant so lovingly for themselves and/or for others

You know Jim thats the first thing someone says to me when i get that call    i ask them how much money that have they say none i say you'll not going all the way 

 

 

 I do have faith that the truth would prevail        again jim am sorry but if anyone is looking for the truth it's not in a Court room and is #2 mistake that most make

 

I am not a Lawyer but you don't have to be to knows those things     just  go and sit in a few Court rooms only a Few and thats all it takes

The Law wasn't set up that way back in 2008-09 no one knew someone wouldn't be able to have a jury here their stories / and Caregivers Cry's for help inn or out side the Grow room 

 

Yes jury i needed and got help watering the plants because i was too sick to do it that day when Leo came inn or they could all die

Well when a law is passed saying that patients and caregivers can grow cannabis for medical reasons yet they leave out the part of the law where the card holding patients and caregivers can legally acquire their startup genetics they force us to risk becoming criminals just to begin the program .

 

In essence we have to first break the law to be in a position where our cards offer up any type of defense its like a sick game of legal chicken if you cross the street with your genetics and don't get caught your just fine and face no charges.

In a July 9 published opinion regarding Michigan’s Medical Marijuana Act (MMMA), Michigan’s Court of Appeals (COA) reversed a Berrien Circuit Court Judge’s finding and held that the MMMA’s Section 4 “immunity fact-finding is a question for the trial court to decide. Accordingly, the trial court’s decision finding that § 4 immunity fact-finding is a question for the jury is reversed and the case is remanded for further proceedings where the trial court shall determine whether defendant is entitled to § 4 immunity.”

The COA also reasoned that “[a]ssigning the trial court the duty of determining factual questions regarding the applicability of § 4 immunity will result in a more expeditious resolution of immunity claims.”

Another issue in the case was whether the defendant, Cynthia Cherelle Jones, was a resident of Michigan when she obtained her medical marijuana credentials. The COA did not make any finding regarding whether Ms. Jones had established residency in Michigan. However, they did “agree with the trial court that Michigan residency is a prerequisite to the issuance and valid possession of a registry identification card.”

Ms. Jones’ defense attorney, Daniel Grow said today that he does not believe the COA’s opinion would preclude an immediate appeal from being filed, prior to trial, if a judge determines that a person is not entitled to a dismissal of criminal charges under the MMMA’s Section 4 immunity provisions.

The assistant Berrien County prosecutor who handled the appeal in Ms. Jones' case, Aaron J. Mead, had not replied to this reporters voice message seeking comment on this story prior to its publication.

I was only trying to help the new people i send here because i here people tell me when i am out and about there reading of the Law and they say words like curing and clones i say words like that are not in the Law so they would have a hard time telling a judge
