Only Dried Marijuana Counts. What About "frozen Wet" ?

Recommended Posts

Here is a question:

What if you harvest it, trim it, use air tight packaging, and toss it in the freezer ??

In it's current frozen wet state, it's not useable.

If LEO confiscates it, puts it in evidence, and hauls it out for your court date, it will be moldy rotten.  Not useable.

If LEO were to thaw and dry it, that might be considered to be "tampering with evidence".

Yes, your intent is to use it, at some point in the future.  However, frozen wet, it is not useable.

This would be great for those of you who do outdoor grows, and harvest once per year.  Or want to do it this way.

You would still be allowed to have a max of 2.5 oz DRIED per Patient, as the "frozen wet" wouldn't count.

So, blow this thread up.  Tell me I'm an idiot.  Get into fights about other topics.  Arm chair lawyers unite !!

of course I believe too that nobody should care. however there would need to be some level of limitation I suspect?  like a warehouse full of frozen cannabis maybe? or a basement freezer? etc.   I know of no limit set currently, so somebody would need to play it in court maybe.

on another note frozen mj thawed for use as smoke/vape tastes like crap. I suppose it could be extracted from after thawed/dried and used that way in edibles without off issues not sure.

and another thang, 2.5 ounces of cannabis extract is legal stores well and will last until next season most likely...a score for the seasonal cropper.

"and that definition does not include wet, frozen marijuana."

Correct.  So, that means it is not useable.  That should mean that wet frozen MMJ, is as non-useable as seeds, stems, and stalks ??

That means you can't count the weight as useable, as it is not dried.

Seems like it. However, I can not imagine the courts allowing this. They would confiscate it, dry it, and count it. Marijuana is marijuana in their eyes and they aren't going to allow someone to get around the weight restrictions by maintaining marijuana in a wet state. If a person had 12 ounces of wet bud drying in their dry box, wouldn't LEO confiscate the wet bud and hold it till dry before weighing it?

(k) "Usable marihuana" means the dried leaves and flowers of the marihuana plant, and any mixture or preparation thereof, but does not include the seeds, stalks, and roots of the plant.

So, if it's wet/frozen, it's not Useable.

So, does that mean it's not MMJ ??

Is wet/frozen MMJ, not really MMJ, but illegal marijuana, not covered by MMJ laws ?

Not a lawyer but wouldn't a PA claim it IS usable because it was being stored with the intent to thaw and consume.

Maybe a jury would agree, maybe not but one would be guaranteed an unpleasant and expensive experience finding out.

Stay safe and be discreet. The MMMA Act has its obvious flaws but it remains better than those that preceded it.

It is in that grey area between "plant" and "dried bud". Is this shite crazy or what?

"If a person had 12 ounces of wet bud drying in their dry box, wouldn't LEO confiscate the wet bud and hold it till dry before weighing it?" - but in your example, you are in the process of drying it.

In my example, it is not in a drying box.  I'm saying longer term storage. WET/Frozen.  Not Dried.  Not "drying".

I'm saying if LEO thawed it, then LEO dried it, then one could say LEO tampered with the evidence, and made it Useable.

You froze it wet, so you could dry it out later, and then at that point, when dried, it would be useable, and only then count towards your 2.5 oz.

Pot "decriminalization" or "medicalization" laws have limited plant numbers and low dry weights, because large amounts of legal, medical pot growing or in storage would be too dangerous, since the medical weed could too easily be diverted to the illegal market.

But, if you try to store huge quantities of raw, wet medical pot in giant, expensive refrigerators for illegal purposes, the profit motive would be lacking, even for the dumbest of criminals.

The only reason to wet freeze pot would be to get around the law in a small-scale otherwise legal medical pot scenario where you had harvested too much pot for whatever reason.

I don't think leo would dry it if it were vac sealed and if they didn't know it was wet, no prosocutor will throw away weight on purpose. so moldy bud may work, but you wouldn't be able to use that as a defense w/out telling them its wet? or they could butt out of my life and weights! easier to tip toe with the rules now than to be the one to try it in court.

who needs "loopholes" ?  Our law might shine compared to other states the moment we cease trying to skirt it.

12-72 plants, 15 ounces of dried rtu, and misc drying too......that's plenty for this cat and his patients. I feel sorry for those

needing to exploit the law with court cash just to get their needed medicine, and hope for universal change soon.

I admit I am scared of

neighbors noticing the smell

meter reader noticing the smell

being over weight at harvest time

kids discovering/stealing plants

attracting criminals with smells

helicopter fly by's

I didn't need to read too many stories of outdoor grows and the hassles they could bring compared to controlled indoor gardens.

After I froze fresh harvested marijuana once then tried to use it I realized the futility of my folly. yuck

Why not just put in work and remove the vegetative material with rosintech? It's solventless, and has about a 10 percent return.

Dry your cannabis out to whatever amout your allowed to have, take 15 minutes to press it out and you're way under limits again Repeat the process until you reach your "actual" allowed limit.

It leaves behind plant markers so when tested they'll know its cannabis, and not a synthetic, plus you don't have to involve your self with chemicals.

Dry sifting is another solventless technique that is pretty easy to do, and can help get rid of excess plant materials.

There's really no magic involved, it just takes a little work to keep under limits.
