Colorado Supreme Court Solves Pressing Problem Of Stoner Quadriplegics In The Workplace

Recommended Posts

You would think that someone could argue the law is not being applied equally. Alcohol is also considered a drug and has been proven to be much more harmful than marijuana. If they are firing people for marijuana use, to apply that equally, should they not also be firing people for alcohol use? Zero tolerance is zero tolerance! Or is it just zero tolerance for recreational drugs that the Federal government has deemed legal but not ones the state has?

Federal government backed discrimination......Smh

In Michigan it is perfectly legal for an employer to fire someone for using alcohol, even off work hours.

There are two primary sets of laws which are immediately brought into play when discussing possible workplace protections for an alcoholic worker: (1) Americans with Disabilities Act, (2) Family Medical Leave Act. These federal laws, which might protect an alcoholic worker from being fired, can conflict with the so-called at-will doctrine that allows an employer to terminate an employee for virtually any reason. Because alcoholism can be considered a disease, an employer must consider the circumstances of the employee and any of the above mentioned laws that can preclude an at will termination depending on the situation.

From some research on the subject. I can't find anything that says you can get fired for drinking alcohol in Mich.
