Can A Cg Trade Genetics With Another Cg?

Hey everyone I was curious wether or not trading genetics between caregivers is protected under law if no money exchanges hands? My patient is looking for something a little different and I have an elite clone for trade but not at the expense of my freedom of course so any input would be appreciated thanks in advance

Thanks for the info and time it is appreciated. Hopefully they address this issue at some point as certain local elite cuts are known to treat specific conditions, and seeds while they can reward you in my personal experience can be hit or miss. Is there a local source you may be able to recommend that provides stable genetics with a reasonably consistant representation of itself? Might seem like a strange question but I have seen a few questionable strains from several reputable sources. Thanks again for your time and any advice you have to offer.

Hopefully they address this issue at some point

the michigan supreme court has addressed this in people v mcqueen. cg2cg transfers do not protect the transferor. transferee is protected of course.

 

getting genetics might be addressed in michigan legislature house bill 4209

but we dont know where the bill is right now. many people think it will be against patients when/if it does come out of the secret backroom committees that are against the open meetings acts.

Buying cuttings from black market sellers can also be hit or miss. Genotyping is only a part of consistent results, the other part depends on phenotyping. Each type of garden space may differ. I've never been in a room that is run like mine for instance. My garden habits do affect the resulting phenotypes of the same strains you may grow in yours. A strain famous for "treating" migraines for instance will not alleviate eveyrones migraines, or every type of migraine. Some strains may shrink tumors some of the time. We don't know why that is just yet. Acquiring plants from those profiting by selling them on the black market may not be the most sound way to guarantee results. Maybe finding a caregiver who grows what you are looking for, the way you would want, with samples to try of the finished product? Get those cuttings from that person legally for best results. where did he get them....well, that's a CGIS- caregiver illuminati secret.

Many questionable strains in question can be found at a dispensary. try googling the strain/dispensary availability.   stay safe, welcome to the forum

Thanks for the replies everyone but shady back alley deals for buggy clones is what I was trying to avoid by swapping tried and true for tried and true through a CG as dilligent as myself. And as for my environment if you trust any well known and respected books on the topic of cultivation my environment is dandy yet i have spent well over 300+$ for 20 seeds from NGSC having almost everyone of them being immature with slightly over a 50%germ. rate the best grower in the world can't reanimate the dead, and at any rate seeds take time to ship, grow, sex, and clone i'm sure we all agree for a patient that needs speedy relief taylored to them a couple months longer for seeds feels like an eternity. This to me is the biggest flaw in the program, you can have it and or grow it but good luck finding it. Again thx for all the input and your time, sorry about the rant folks have a nice night.

It would be awesome if the law allowed even uncompensated transfers between card-holding folks. Every now and then I want new strains. I'm bad at starting seeds because my DWC system doesn't require daily attention, but new sprouts do and I don't have the time or ambition for daily care of plants. So I have about a 10% success rate starting seeds.

 

Just today I picked up 12 clones of four different strains..actually they were all at least 16" tall (so teens as they say) from a craigslist seller for $200. I had no legal concerns, because as a patient and CG, I can legally acquire the plants. When buying MJ from strangers, your bigger concern should be personal safety because you never know who you might encounter when meeting an on-line stranger. Same goes with buying anything on craigslist and meeting a stranger.

 

I'm 6' tall and 220 pounds and grew up in Flint. I know how to talk to and make friends with thugs and also how to use my size to keep thugs in check. So I have a lot of confidence when meeting with a craigslist seller.

 

Other people might be freaked-out about meeting a stranger to buy clones. If any of the members of this board want to acquire clones in Genesee County, but are nervous about it, just PM me. I'd be happy to ride along with you and provide backup and help you make a safe transaction.

People v McQueen did indeed deny transfers between caregivers in a public storefront as a public nuisance and, subsequently, a civil infraction. Criminality is not an issue. The decision in Hartwick/Tuttle may open options. Maybe not. I remain optimistic. Can we count a transfer between two discrete individuals who remain compliant with the law a public nuisance?

i dont believe the court has asked any questions as to transfers in hartwick/tuttle. afaict there wont be any reversals of mcqueen any time soon.

In looking at evidentiary matters in regard to the Affirmative defense, the court may rule that transfers between card members are permitted under sec. 8 because a seller would be acting as a patient's caregiver under the statutory definition of "caregiver" in any transaction with a qualifying patient.
