Marijuana Growing Facility Coming To Fenton

Although the ordinance has been on the books since January, no one has until now requested approval for a medical marijuana growing facility in the city of Fenton.

 On Thursday, July 23, at 7 p.m., the Fenton Planning Commission will, after a public hearing, entertain a special land use request, followed by site plan approval for the construction of a new medical marijuana growing facility called the Fenton Greenhouse.

 If approved, the 9,000-square-foot building will be located at 130 Alloy Drive in the industrial park. The property is currently undeveloped and located north of the Hamilton Propane site and south of the Canela Tool building.

 The property is on 1.71 acres and will accommodate a possible 18,000-square-foot addition in the future. The plan also calls for a 13-space parking lot and possible 16-space expansion when the addition is constructed.

 According to the site plan review report by Carmine Avantini, the city’s planning consultant, the request meets all but one of the criteria outlined in Ordinance 687, which was adopted by the City Council on January 26.

 The medical marijuana ordinance has spacing requirements, which dictate that no medical marijuana growing facility be located within 1,000 feet from any school, day care facility, church, house of worship or other religious facility, or public or private park.

 The proposed Fenton Greenhouse is located 965 feet from a day care center, the Rainbow Child Care Center on Owen Road by Target. That hiccup was resolved, however, when the Zoning Board of Appeals approved a variance at its June meeting.

 If Fenton Greenhouse owners gain the necessary approvals, they will be permitted by the ordinance to grow up to a maximum 60 plants and 12.5 ounces of usable marijuana. They are only permitted to service five medical marijuana patients to whom the caregiver is lawfully connected. Each patient is restricted to a maximum of 12 plants with 2.5 ounces of usable marijuana.

 Avantini’s review of the proposed project states that all aspects of the ordinance must be in compliance at all times. The medical marijuana growing facility will be subject to annual inspections to ensure compliance with code and state law.

 Fenton Police Chief Rick Aro said the proposed facility is something very new in this area and relatively new to the state of Michigan.

 “As long as this facility is operated properly and in a lawful manner, I don’t anticipate any problems,” Aro said.

 Should the Fenton Greenhouse obtain special land use and site plan approval Thursday night, it will be the green light to go forward with construction.

 “If they are approved, they will not go to the City Council,” said Avantini.

Who can grow where?

 According to Fenton Ordinance 687, medical marijuana patients are the only individuals allowed to grow in a residential district. Caregivers only are allowed to grow in the industrial district. When the ordinance was passed on Jan. 26, 2015, both Mayor Sue Osborn and Councilwoman Cheryl King voted against it. According to the minutes of that meeting, “Osborn stated she cannot vote for the ordinance with growing being allowed in apartment buildings. She feels the owners of the buildings do not live in the buildings and there are too many children in the vicinity.” King cited similar concerns about allowing growing in apartment buildings because of odor and ventilation issues. Council members Bradley Jacob, Les Bland, Pat Lockwood, Scott Grossmeyer and David McDermott voted to approve the ordinance.

Something doesn't make any sense here. We can already do that and growing 60 plants at a time isn't going to be worth all this trouble.

It makes sense if the owner(caregiver) has 5 patients that are all have caregiver status....and the logistics are worked out...

60 plants total and 12.5 ounces total at the facility. What part of that is new? The Act already does that. Why kiss arse to do it? Just do it. Am I missing something here?

its probably going unsaid that this will be a dispensary. but really, they are going to build a new building just for that? thats a huge, incredibly stupid investment.

This reeks of crooked, back room deals. There are plenty of real caregivers in that area doing a fine job. Yet we have these smoozes asking for something, on the surface, that is already alive and well. When someone asks for something we already have you have to know there are many lies involved. When someone pretends they will support that kind of a business on just the model of one legal caregiver it just makes me want to puke. Tell it like it is you filthy, lying bastages.

My guess is they are either counting on the addendum to 4209 passing or one of the legalization bills passing so that they will be first inline for a commercial license.

Where does this kind of twisted logic come from? Why would it put them ahead of caregivers that are not bribing and lying their arses off? They should get to the back of the line behind the caregivers that have been working hard since '08.

supply and demand I guess.  Patients have spoken with millions of dollars spent at these facilities. Overwhelming patient support funds these cats and they just are not going away. City by city is going broke, a perfect time for lawlessness to present itself.  If there are patients willing to form lines at the cash register supporting this model, then the need will be filled, as it has over and over in many cities.

How do you know the guy is not a caregiver from 2008 who is first in line?

 

You guys assume a lot..........

Because a real caregiver wouldn't ask for something that they already know is their legal right. Just some dumb arse sucker move buster would ask for it, not someone who is The Real Deal. 

 

When you ask for something to be legal that already is, you undermine everyone who is enjoying what they didn't have to ask for, in an attempt to put yourself above everyone else. It's called busting a move at everyone else's expense. Don't expect people to like it or you once you do that.

Maybe they need an occupancy permit? Anyone wanting to put up a facility needs to jump through hoops in any business. I'd rather have all the permits necessary and be ready to go.

 crooked, back room deals.  I agree of course because i see the writing as you do They want are / our grow rights and for the ones that say I will still Grow cannabis no matter if their isn't any Law that says i can Grow cannabis theirs a Jail sell waiting Imo

Because the caregivers in Michigan can't make the State any $$$$ and a warehouse full of cannabis grown by someone under the Governments control will

They are fooling a lot of people there are a lot more people then most think that knows nothing about whats going on and could care less most are just growing weed and making lots of cash

If the owner/caregiver is relying on having five patients who have caregiver status, such that the owner/caregiver/grower will grow for five patient/caregivers who then transfer to others, then this is a pyramid scheme and is not at all complaint with Section 4 of the MMMA.  This is a disaster waiting to happen.

Maybe not.  But the taxes alone on an industrial-zoned property in Fenton of this size will be at least $20,000/year.  Let alone water/sewer/electrical, and the cost of the property.  If you consider the cost of the property, utilities, and taxes, this endeavor will cost at least $70,000 per year.  And five patients are gonna cover that?
