Bay County Couple Charged With Marijuana, Gun Felonies 16 Months After Police Raid

BAY CITY, MI — A police investigation into a complaint against a Bay County business led to unearthing an alleged marijuana-growing operation, resulting in a husband-and-wife duo facing felony charges, police report.

Michigan State Police at the Tri-City Post in early 2014 were investigating a complaint made against Linwood-based Michigan Building Supply LLC, court records indicate. Stemming from this, troopers on March 19 executed a search warrant at the home of LLC's owners, Charles W. and Kathryn M. Riggie, in the 700 block of North Bay-Midland County Line Road in Garfield Township.

Inside the dining room of the Riggies' home, police found eight potted marijuana plants. They also found materials in the house and an apparatus in a nearby shed typically used for growing marijuana. However, there was no actual marijuana in the shed, police reports state.

Troopers also found a Ruger semiautomatic pistol in a dresser drawer and a Springfield semiautomatic pistol in a pickup truck on the premises, court records show. Both Riggies were licensed concealed pistol holders at the time, police reports state.

Police read both Riggies their Miranda rights. Charles Riggie declined to speak with police, while his wife went ahead with an interview, police reports state.

Kathryn Riggie told police she was aware of her husband growing marijuana, though she was not involved with it herself and voiced her disapproval to him, police reports state. She went on to say that she accepted he was going to keep growing, as it wasn't worth the fight, reports state.

Bay County court records do not specify how the initial complaint investigation was resolved. Bay County Prosecutor Kurt C. Asbury said police did not send paperwork on the case to his office until July 1, 2015. 

Authorities issued warrants for the Riggies on Thursday, July 9, of this year, more than a year after the search of their home occurred. They voluntarily appeared for arraignment in Bay County District Court on Tuesday, July 14.

Both Riggies are charged with single counts of delivering or manufacturing marijuana, as well as felony firearm, which is added because the couple had firearms while being charged with another felony, according to prosecutors. The former is a four-year felony, while the latter is punishable by a mandatory minimum two-year sentence, to be served consecutively to any other sentence.

The Riggies are free on personal recognizance bonds. They are to appear for a preliminary examination before District Judge Dawn A. Klida at 8:30 a.m. on Thursday, July 30.

just the other day they had a guy shoot 2 people that he caught robbing his grow in his garage, the guy who owned the home and grow took off after shooting the two guys, leo dont  know if he is a legal grower or not, Im sure we will here more about this as time goes on, I heard it on 9 &10 news, they have a web page for the news story'

are we legally allowed to shoot someone with a shotgun when we see them removing plants from our gardens?

I've seen someone shot with a shotgun I wonder if maybe the guy had it loaded with salt or dirt or maybe he was far away(enough to not be threatened by the intruders?)  nothing generally  survives in front of a 12 gauge

 

I am so happy they got these thugs. I hope they get charged for cultivation, possession, intent to deliver, manufacturing....just like the guys wife would have been if  she was watering, or removing plants from the garage...

I dont know if I would have left like he did,  but if I did it would be to go straight to my attny and turn my self in with the attny!

 

It's one of the first times I have seen somthing like this, and I am sure there will be more repuctions for him leaving than if he had just called the law and stayed home!

p.s the only thing I heard about weapons and pt's or c.g's were hand guns and not being able to register for a one!

 

there is no waiting period for shot guns at wall mart, or at least there wasnt when I purchashed a 410/.22 long gun a few yrs back!

thugs= robbers

 

sorta  scarcasm........but I mean to say why would the robbers not be charged with those charges?   If the home owners wife was caught with plants not hers, while she was not allowed in the grow area, she could be charged with those charges right? so why not a thief caught with the plants, in the grow area, and unlawful entry?

 

When thieves steal drugs form a pharmacy do the robbers get charged with possession of the drugs they stole, or just the theft of them?
