Drug Testing for Welfare Recipients and Public Assistance

It is based on this decision out of the 11th circuit stating they needed "suspicion".

 I still believe it to be unconstitutional.  It needs to be challenged.

The 11th Circuit got it right. Has the case been appealed by the Florida Department?

Yep, the welfare people get free rides to the doctor, every month, free doctors visites, every month, and free Norcos, every month and then sell half. They have a doctors excuse to test dirty and the doctors have an excuse to bill over a thousand, every month. Making Norco schedule II has providers laughing, all the way to the bank. Drug testing will do the same.

 

OK, so what we see is that some people - just some - might sell some pills...yeah, it might happen.  But if we decriminalized drug use, then there would be no need or motivation for legit patients to defer pills to the black market.  I have no problem with sick people getting free rides to a Dr.

No need to appeal.  Mandatory drug testing is unconstitutional.

 

 I do not believe "suspicion" should be the bar. Probable cause should be the bar. The drug war has done such wonderful things to constitutional rights.

FYI, most doctors don't accept the "welfare people" because the government only pays the doctors enough to cover their expenses. I have just recently been able to get Medicaid after months of trying and can no longer go to the doctors I've been with for  thirty years or my orthopedic doctor because they don't accept Medicaid. Thankfully my pulmonary specialist accepts it.

 

If you are ever forced to go on one of these programs, good luck in finding a doctor that was educated in the United States, they are few and far between.

 

How many people do you personally know that are in dire financial straits and need to have government assistance? Or do you just get your info from the internet?

These are not arguments, but unfounded speculation and hyperbole, both which are a failure of dialogue.

 

Here you go. Some math homework. You will find that benefits are pretty scant.

Does not the defendant, the State of Florida, which lost, have the option to appeal? I understand that the plaintiffs do not need to because the court found for them.

"Why is he smiling? We are not smiling. So why is he smiling?" The power junkies would have him drug tested. That will wipe the smile off his face!

First off, if a person is getting high at his work and it affects the performance of his job you don't drug test him or call the police. You fire him! You don’t need him and his liability. Common sense. Secondly, drug testing randomly in the work place or as a government requirement presumes you are guilty of being under the influence of something possibly illegal. This is an insult to every one of us. If there is a drug problem the proper avenue is to see a doctor and pursue a cure. Common sense.
