Tonight, Ohio votes to become the fifth US state to legalize adult personal use of marijuana and “Radical” Russ Belville will be in Columbus, Ohio, bringing you the live vote results for MarijuanaPolitics.com and CannabisRadio.com.

Coverage begins at 6pm Eastern with The Russ Belville Show, followed by Toker Talk Radio at 7pm, then Marijuana Election Night 2015 at 8pm as the polls close in Ohio and the results come in. Joining The Russ Belville Show will be campaign representatives from ResponsibleOhio, the group fighting for marijuana legalization.

Garrett Greenlee from the International Cannabinoid Institute (ICI) will be making an appearance during the evening. ICI is planning a $24 million medical cannabis research facility when the vote passes. ICI will be the home of researcher Dr. Sue Sisley, the only federally approved cannabis researcher in the field of medical marijuana for veterans suffering from PTSD.

Other guests will include the parents of desperately ill children who are banking on passage of the measure that also legalizes medical marijuana, specifically the cannabinoid extracts proven helpful for children with seizure disorders, and local Ohio marijuana activists who have fought long and hard to end adult marijuana prohibition.

Toker Talk Radio features the Internet’s only live talk-radio call-in number (971-533-7111) for discussion of marijuana law reform. Callers from across the country are encouraged to call in with their questions and comments about the Ohio marijuana legalization vote, which includes the legalization measure Issue 3 and the anti-monopoly Issue 2, which could undermine and invalidate Issue 3.

Well, IMO Issue 2 (anti-monopoly, personal greed) is not a hindrance at all.  Any MPP or DPA initiative that has ever been proposed would pass muster under Issue 2 easily.

 

 Passing laws based in non selfish altruism.  Doesn't seem so bad aye?

Amendment to Section 1 of Article II of the Ohio Constitution

Section 1e. (A) The powers defined herein as the "initiative" and "referendum" shall not be used to pass a law authorizing any classification of property for the purpose of levying different rates of taxation thereon or of authorizing the levy of any single tax on land or land values or land sites at a higher rate or by a different rule than is or may be applied to improvements thereon or to personal property.

 

(B)(1) Restraint of trade or commerce being injurious to this state and its citizens, the power of the initiative shall not be used to pass an amendment to this constitution that would grant or create a monopoly, oligopoly, or cartel, specify or determine a tax rate, or confer a commercial interest, commercial right, or commercial license to any person, nonpublic entity, or group of persons or nonpublic entities, or any combination thereof, however organized, that is not then available to other similarly situated persons or nonpublic entities.

 

(2) If a constitutional amendment proposed by initiative petition is certified to appear on the ballot and, in the opinion of the Ohio ballot board, the amendment would conflict with division (B)(1) of this section, the board shall prescribe two separate questions to appear on the ballot, as follows:

(a) The first question shall be as follows:

"Shall the petitioner, in violation of division (B)(1) of Section 1e of Article II of the Ohio Constitution, be authorized to initiate a constitutional amendment that grants or creates a monopoly, oligopoly, or cartel, specifies or determines a tax rate, or confers a commercial interest, commercial right, or commercial license that is not available to other similarly situated persons?"

(b) The second question shall describe the proposed constitutional amendment.

© If both questions are approved or affirmed by a majority of the electors voting on them, then the constitutional amendment shall take effect. If only one question is approved or affirmed by a majority of the electors voting on it, then the constitutional amendment shall not take effect.

 

(3) If, at the general election held on November 3, 2015, the electors approve a proposed constitutional amendment that conflicts with division (B)(1) of this section with regard to the creation of a monopoly, oligopoly, or cartel for the sale, distribution, or other use of any federal Schedule I controlled substance, then notwithstanding any severability provision to the contrary, that entire proposed constitutional amendment shall not take effect. If, at any subsequent election, the electors approve a proposed constitutional amendment that was proposed by an initiative petition, that conflicts with division (B)(1) of this section, and that was not subject to the procedure described in division (B)(2) of this section, then notwithstanding any severability provision to the contrary, that entire proposed constitutional amendment shall not take effect.

 

© The supreme court of Ohio shall have original, exclusive jurisdiction in any action that relates to this section.[5]

why were the polls so far off? too small sample size?

the akron poll looks closest to the results. if you change the 11% "good idea" to "bad idea" anyway.

 

if the polls said 60 no / 30 yes i wouldnt have bothered trying to help them.

 

measure 80 in oregon in 2012 lost 53/46, but it didnt lose in every county.

colorado legalization in 2006 lost 58/41, but it didnt lose in every county.

california prop 19 in 2010 lost 53/46, but again, it won a few counties.

 

this wasnt just a loss, but a total loss.

Anyhow, seriously, can we move on and understand the model that was proposed is not the way forward.

What we need to understand is We the People want cannabis decriminalized completely.

A passive view will not suffice. It is time to take action Get off the fence and support Abrogate.

Enough of " it will never work, it won't pass, its a pipe dream".

We the People are willing to come out when the law is for We the People, not a oligopoly or scam like issue 3, 4210, 4209 etc.

We the people will stand united against anyone and anything that opposes us.

It isn't enough to understand issue 3 is bad, we need to understand removing cannabis from the criminal code is the ONLY Solution.

The first step is Voting ALL fknrepublicans from office.

The tide has changed, we are taking our country back.
