Ohio Says Hell No To Legal Lies....

Ohio voted Tuesday against legalizing recreational and medical marijuana via an amendment to the state's constitution, shooting down a proposal to grant a small number of wealthy investors sole permission to operate commercial marijuana farms. 

 

"The people of Ohio have understandably rejected a deeply flawed, monopolistic approach to marijuana reform that failed to garner broad support from advocates or industry leaders," National Cannabis Industry Association executive director Aaron Smith said in a statement after Tuesday's vote. "This debate has shown that there is a strong base of support for legalizing, taxing, and regulating marijuana. Now the foundation has been laid for a potential 2016 effort that would put forward a more common-sense initiative and have a major impact on the presidential conversation in the process."

 

The amendment sought to allow licensed individuals to possess, grow, share and cultivate up to eight ounces of marijuana and four marijuana plants in the state. Additionally, the law would have allowed anyone over the age of 21 without a license to possess up to an ounce of marijuana, and would have allowed individuals with a physician-certified medical condition to use medical cannabis.

 

The Ohio proposal differed from policies passed in other states, like Colorado and Washington, by creating 10 Marijuana Growth, Cultivation and Extraction facilities that would have had exclusive rights to grow plants for commercial use. The designated farms were backed by a number of notable Ohioans, including one-time boy band star Nick Lachey, fashion designer Nanette Lepore and retired NBA player Oscar Robertson.

 

The owners of each MGCE facility bankrolled the legalization effort -- as the Washington Post reported, each MGCE's investors were asked to put up $4 million to help fund ResponsibleOhio, the group backing the Yes on 3 effort.

 

This unusual aspect of the amendment gave legalization advocates pause, as it would have put the state's entire marijuana industry in the hands of a few wealthy individuals. Prominent advocacy groups like the Drug Policy Alliance and the Marijuana Policy Project remained neutral on the measure. NORML, however, lent its support to the issue -- with caveats -- acknowledging it would be an opportunity to end marijuana prohibition in the state. 

 

"It was, as the saying goes, 'a bitter pill to swallow,' and the board wanted to make it clear we do not consider the Ohio proposal the best model for other states to follow," read the board's endorsement. "There are far better ways to legalize marijuana."

 

ResponsibleOhio, meanwhile, argued that the MGCE structure would help the state regulate the industry. They also made a case for the potential financial windfall associated with legal pot: According to the group's estimates, the marijuana industry could bring in $554 million in tax revenue annually by 2020.

 

“That money could be in the hands of local governments and small businesses instead of drug dealers," spokesperson Lydia Bolander said.

 

Law Enforcement Against Prohibition made a similar case in favor of Issue 3.

 

"Legalization will take money away from the cartels, provide funding for public safety and health services, and reduce the violence associated with the illegal drug market," retired Cincinnati Police Captain Howard Rahtz said in a statement for LEAP. "Passage of Issue Three puts us in charge, not the dealers"

Sorry, I don't want to work that hard to be free for a day and then hand it over to the legislature to ruin it overnite.  I'd rather vote for the final product than have it imposed on us by the powers that be.  Does anyone trust the legislature to have free reign after we work to have it decriminalized.  At least with a law they would have to get the #'s to change it.

I'm voting for MiLegalize.

Listen to who you want, everyone has the right to their view, but don't cry when you get decrim for a day and then the legislature takes it all away from you the next day with transport laws, loss of drivers license for over 5 nanograms, etc.etc.etc.

You realize that the legislature wants to pass shiitty laws but want to do all that work for decrim and hand it over to them?  Where is my guarantee the legislature won't undo it the next day.

And a 1/4lb will still get you jail time and a misdemeanor, esp if in more than one bag.  Where did you get your info  cristenew?

BB why not make a post with substance?  If you want people to follow you, you should try to convince them with knowledge.  What you are doing now is the same as the republicans.  You throw out jargon and spiffy words with no substance.

Here's your chance.  I have never heard of abrogate.  Why don't you explain it to me and see if I'm on board?

I at least condemned what I didn't like about the Ohio bill and stated exactly why I'd vote for it since there waas nothing else coming down the pipe.  And I also stood up for the numerous patients and smokers who wanted something to take away the penalties for med patients who have to worry about a felony for 2 gr of oil.  I didn't just put people down over MY view.  Besides it was Ohio.  Why someone here would push people away from their cause by mocking someone who's view is slightly different than theirs is pretty counterproductive over something that doesn't matter to you since you live in MI.

There are some flaws in the language, but it is generally headed the right direction. Certainly it should amend the public health code in the final language.

R there protections from teh legislature making laws against it the next day?

Isn't it just like wiping the slate clean but the legislature can then make any laws against MJ the next day?

Wouldn't an initiative like the MMMP, have more protections in it since the legislature would have to get 75% and insert it in the act instead of just needing a 50% to pass laws against mj?

How do you not give a foothold to put penalties back on us?  The dems voted with the republicans for the transport law and didn't put it in the mmma.  Wouldn't it be harder for them to overturn an initiative rather than decriminalization?  I'd VOTE for a decrim initiative if there were the same protections or more than MiLegalize.

And thanks Zap for answering my questions.  I want to vote right but I have to critically understand what I'm voting for and there doesn't seem to be the answers and teaching methods out there to learn the whole process and make a good decision.  Maybe that should be first and foremost for changing minds and furthering the cause?

Don't make legality of cannabis a box, then continue to arrest and prosecute everybody that gets out of that box. I don't think a cannabis legalization initiative should declare new penalties for behavior with cannabis; it should remove existing penalties.

Ok, so now it's not in a box with decrim, will it be easier or harder for Legislature to impose worse laws back on us than something like MiLegalize(if it had taken MJ out of the healthcode)?

I did not post in any thread about the ohio mj vote, I dont care one way or the other, Im not moving to ohio, I live in MI  I will die im MI!

 

I dont say alot about milegallize or any of the MI bills, all I say is I dont want to lose my pt/c.g rights for it to become legal for all!

 

I hope they completely legalize it in MI but I dont want my pt rights or c.g rights taken away for it to be legal recreationaly!

 

I dont make any money off of mm, I try and support others who get caught up in the law!
