OMNI was a legal criminal organization once headed by former police officer Luke Davis

MONROE (WWJ/AP) – A Michigan State Police lieutenant has reached a plea deal after being accused of stealing property seized during drug operations and other crimes.

Emmanuel Riopelle, a 44-year-old Grosse Ile resident, pleaded no contest Friday in Monroe Circuit Court to one count misconduct in office, a five-year felony.

Michigan Attorney General Bill Schuette said the conviction effectively ends Riopelle’s law enforcement career. Because Riopelle’s misconduct occurred while he served in a position of public trust, state law requires him to also forfeit his pension.

“Law enforcement officials who abuse their position for personal gain undermine public safety for everyone,” Schuette said in a statement. “We will hold corrupt officials accountable, wherever they are found.”

Schuette said Riopelle was charged in Feb. 2011 for coordinating an extensive scheme to systematically embezzle property and money seized from suspects from March 2006 to December 2008.

Former Michigan State Police Lt. Luke Davis, 50, of Monroe, and Monroe County resident Lawrence Dusseau, 44, were also charged in Feb. 2011 for their roles in the scheme.

Affidavits police submitted to obtain the search warrants are defective, Komorn stated in the written motion.Defense attorney Michael Komorn of Southfield filed a motion Monday, Dec. 7, to suppress evidence obtained in the searches.A preliminary examination begun Friday, Dec. 4, is to continue Jan. 14 and 15 for Paul Alan Williams, 55. A defense motion to throw out evidence police gathered in three searches conducted on Oct. 22 is also to be heard by Judge Laura J. Schaedler.A hearing that was to continue Tuesday for a Hudson man charged with illegally growing and selling marijuana was delayed to January in Lenawee County District Court.

The volume of marijuana involved, he said, also exceeds the limits of the state law.“If we thought he was within the parameters of the medical marijuana law we would not have charged him,” Castleberry said. Being a registered caregiver, he said, “does not give you the right to sell marijuana to anyone.”“We obviously do not agree,” said Lenawee County Prosecutor Burke Castleberry.Williams is a registered medical marijuana patient and registered caregiver for five other patients, Komorn stated in the brief. There is no evidence in the search warrant affidavits that Williams acted illegally, he argued.

The investigation was started after the drug unit received tips Williams was selling marijuana to buyers without regard to their medical marijuana status, Whittemore testified.Michigan State Police Trooper Craig Whittemore testified Friday he was in charge of the investigation that included three controlled marijuana buys by a confidential informant. The searches and arrest resulted from an investigation by the Region of the Irish Hills Narcotics Office.Williams was arrested in a building at 553 S. Meridian Road in Hudson where one of the search warrants was executed. A building in Rollin and a house on Rome Road were also searched.

Search warrant affidavits are void of “any personal information of Paul Williams ever being at, within or going to or from these locations,” Komorn stated in his motion to suppress the seized evidence.During the searches, police seized nearly 21 pounds of marijuana from the building in Hudson, he said. At the building in Rollin, he said, 34 marijuana plants and processed marijuana weighing 91.5 ounces was seized, along with 7.2 pounds swept from a trailer and pickup bed.He described to the court controlled buys at the building in Hudson. An informant purchased 8, 12 and 16 ounces of marijuana on Sept. 2 and 16 and Oct. 21, he said.

Wow !

He said a confidential informant bought 8 ounces, 12 ounces and 16 ounces of marijuana during three trips to the building on U.S. 127 in Hudson. Nearly 21 pounds of marijuana was seized from that building during the Oct. 22 search. The building in Rollin had 34 plants and 91.5 ounces of processed marijuana, he said.

usually, it will be in the complaint, unless it's an undercover cop. then it won't.

regular police undercover for one case will be identified in the court documents, but undercover narc police who are involved in many cases will not be identified.

in a bunch of these cases it's just a patient who got in some trouble, the cops say make a deal, do a job for us and we drop your charges or give you a sweet plea deal.
