Recreational Dispensaries Legal In Detroit...

Curious if anyone else has come across this.

 

The other day I was talking to a Detroit dispensary owner and he was lamenting that a large majority of the Detroit dispensary owners feel that it is legal for them to act as a "Recreational" dispensary for Detroit residents.  He was telling me that most of his competitors look at Detroit's decriminalization law as authorizing them to sell up to 1 ounce to non-medical customers as long as they have a Detroit driver's license.

 

While I first thought it to be over the top, on reflection it seems a perfectly logical conclusion.   First you are willing to believe that it is legal to own operate a medical marijuana dispensary even though the State Supreme Court has said no.  And two, you are willing to sell edibles even though the court has said no.   It does not seem to be much of a logical disconnect to conclude that recreational is legal too.

 

Anyway, thought I would put this out there.  I have never been in a Detroit dispensary and most of what I hear is 2nd or third hand.   I have not heard the "recreational is legal" argument before regarding Detroit so I thought it would be interesting to see what everyone else has heard.

the 2 detroit police officers i talk with frequently about disps have relatives running disps, so they know the legal side (they get a memo or email from Detroit Police HQ with address and owners name) every time a new disp opens.  on the business side they lament that a disp cannot pay the overhead without selling to non-card holders, which is why the use of the 'we can legally sell 1 oz to every adult with id showing a detroit address.'' both officers also say they have the right without a warrant to march into every disp and search w/o warrant, cause they wouldn't be is biz unless they were selling an oz to non-card holders.

a detroit officer on loan to the wayne county sheriff's office says the count of disspensaries in detroit as of january 2, is 250 storefronts, making competition a great driver of the self-serving interpretation of it's legal to sell one oz to every adult detroit resident.   for this reason I have turned down the offer i had of 100% per cent financing for me to open a disp.  It just is not the right time, given that to make a profit one must sell to non-card holders.

I've wondered about that. There never seem to be enough cars in their parking lots to sustain a business.

We used to have a couple pawn shops like that. The cops were running them. 

 

We have to keep in mind that only medical sales protect the buyer as a patient. Step outside of that and you are just part of a drug felony and lose all of your medical rights.

The Detroit law to my knowledge doesnt address anything about sales .

 

Does the MMMA say anything about opening a mj dispensary?  

 

Seems once you have drawn the conclusion that MMMA says mj dispensaries are legal, it is a simple next logical step to conclude that the Detroit decrim law makes recreational sales legal.  

 

I agree with the posters that are quoting chapter and verse, I was just trying to see if anyone else was aware of the unique legal twists that are going on in Detroit.   I was certainly not aware of it until this past weekend.

Isn't this the same mentality that got Young, Kilpatrick, the school system and the city as a whole, in trouble??  Duh!!
