If he successfully completes the terms of his sentence, will be allowed to withdraw his previous guilty plea to delivering or manufacturing a controlled substance-marijuana, which is a four-year felony. He will then be able have his plea changed to one of possession of marijuana, a one-year misdemeanor.

wow amazing he can still grow, he was way over his limits, I wonder if his husband is a c.g also, I had to reread the article when it said 1999 suburban belonging to his husband!

 

I wonder if he was given liency because of his new legal same sex marriage?

 

 

How does something like this happen, I am pretty pos I would be serving time for selling a qp to a pt not registered to me,

 

Why on earth would a 63 yr old man narc out his friend like that?

Thats not a friend bro!  The pt wouldnt have gotten in less trouble narcing out his friend!

 

The pt was already breaking the law for having a 1/4 lb, unless he has a pt, im thinking he dont and just willy nilly told leo where he got it from,,,,,,,,,,that is not a friend,,,,,thats a wuss for not taking his own responsiblity for his consqeunces!  A pt can get mm from any one,,,,,,He did not have to squeel like a lil girly man!

Wait just a minute. The patient had ONE OUNCE and thought he and his caregiver were in compliance. He already knew they were watching his caregiver and LEO watched him drive away from the home. So he produced his card and said he made a legal buy from his registered caregiver. Now you want to make fun of him. That's what BAYANET wanted you to do. If you automatically believe proven liars then what legs do any of us have to stand on?

In exchange for Green's prior plea, the prosecution dismissed a seven-year charge of delivering or manufacturing 5 to 45 kilograms of marijuana.

According to court records, officers with the Bay Area Narcotics Enforcement Team, or BAYANET, were conducting surveillance on Green's house in the 5600 block of Garfield Road June 25. They observed a car leaving the house and followed it, eventually pulling it over. A 63-year-old male driver said he just bought 4 ounces of marijuana from Green, adding he is a medical marijuana patient, but does not have a caregiver -- a person registered to grow the plant for him.

Police obtained a search warrant for Green's home. They later observed Green leaving his house in a vehicle, pulled it over, detained him, and brought him back to his house.

In conducting a search, officers found two unsecured grow rooms in the home's basement. They seized 798.9 grams — or 28.18 ounces — of marijuana, 110 marijuana plants, two syringes containing marijuana oil, Rice Krispies treats containing marijuana, dubbed "medibles," a digital scale, $842 in cash, a cell phone and a 1999 Chevrolet Suburban belonging to Green's husband, court records show.

Green told police he has been a registered medical marijuana patient for four years and is a licensed caregiver with the maximum five patients. He said he had only 72 plants and delivers only to his five specific patients, court records show.

Under the state's Medical Marihuana Act, patients can have 2.5 ounces of usable marijuana and caregivers can grow up to 12 plants producing 2.5 ounces of usable marijuana for each of their five patients and themselves.

While on probation, Green can continue growing medical marijuana, so long as he adheres to the law."

ok!  But I thought court papers were public record,  he has been thru most of it and cut a deal, that allows it to be a misd after he finishes probation,  they are not dropping the charge, which is what they always did for me if I accepted that kind of deal!

 

I would assume that the facts are not all factual,,,,,,,,but if he sold 4 oz's to a pt NOT registered to him unfortunatly it is against the law, and he is getting a good deal in his mind,,,,,,,remember the 2nd simple possesion is a fellony if he gets into this kind of mess again!  I would also assume that he lost his driver's liscense for 6 months to a yr,,,,,a judge dont do that the s.o.s does that automaticly for any kind of drug bust.

 

I hate calling marijuana a drug!  I hope it gets taken off of the schedual 1 drug rating!

I can prove that in a previous case the cops lied the same way and the guy won representing himself in front of a jury. The cops said he had 6 ounces and he proved he had 2. 

 

If he hadn't took it in front of a jury folks like you would still believe the cops over him.

 

Believe who ever you want to dude but the cops around here lie every time. It's just how they do business. Lie big and find something like an unlocked door to put you on the ropes so you can't fight them.

Those four ounces were not usable yet, when they become useable they'll weigh one ounce.

His 28 ounces were not useable yet either. Cops broke the law stealing his truck for no reason.

Happens all the time. They think it's some sort of a bargaining game. They start out with a huge whopper lie and then back down from there. What was reported in the article was their opener lie for the case. Like I posted, there's proof this is going on in this same general area. A guy used a jury to prove it. They are proven liars. This patient and caregiver are not proven liars. You should take them at their word against liars. At least until it's proven, not just believing law enforcements opening positional lie.

I agree resto, those things do happen to compliant people unfortunately. I was ribbing phaq a bit, with real life defenses, even. the whole story smells fishy to me, and that generally has meant untruths. I sense police, cannabis, fuzzy neighbors, and a judge who just wants any ole conviction for his prosecutor, regardless of the lies the police told him.

The case is done!  as long as the c.g/pt dont get in trouble on probation!

 

I have been to court cases,,,,,in this case he was told if he pled guilty he would get a delayed sentence, if he makes it through the probation period he can take his guilty plea back and plead to possesion misd.

 

The case is over, court news is court news,,,,,,,so he had locks, he didnt have 28 oz's,,,,,,his wife is his husband lol, it says nothing about 2 c.g's in the house, and says he sold 4oz's,,,,,so you thinking it was 4 wet oz's.......or 4 oz's of unusable, why would the 63 yr old say he bought 4 oz's if it wasnt usable?

 

Wtv,,,,,,Its not like I want the guy to get in trouble any how, im just pointing out what the court records read, I guess it dont realy matter what the truth is, the guy took the deal either way...so he must think he had to deal and did something wrong wouldnt ya think?

I disagree Jim some people have too plea out because of $$$ or just plain stress lots of people don't even know if they did something wrong even after Court it all depends

 

on what Town or City, or County you are inn maybe the Law has turned into a County , by County Law instead of a State Law
