some of you may remember the defendant in this case being one of three who the supreme court last ruled on.

 

A motion filed last week in a criminal case involving the state’s medical marijuana act seeks dismissal of the charges due to a fired law enforcement officer’s involvement in the investigation.

 

 

 

is scheduled to appear Wednesday morning for a motion hearing in front of Oakland Circuit Judge Cheryl Matthews. It’s the latest hearing in a case that began in 2011 and has gone all the way to the Michigan Supreme Court and back.

 

 

too bad that the court of appeals already ruled that other cases detective mark ferguson was a part of , didnt automatically mean that the other cases could be dismissed. defendant in this case has a serious uphill battle in oakland county!

 

 

Prosecutors reviewed then-active cases Ferguson was involved in after he was fired, Out of about 100 cases, 16 were dismissed.

 

Last week, Oakland Circuit Judge Daniel P. O’Brien denied a Pontiac man’s request for a new trial in another drug case involving Ferguson.
