How One Man Destroyed Michigans Medical Marijuana Program

The residents of Michigan have enjoyed a liberally drafted and likely one of the most progressive cannabis laws in the whole of the United States. The problem is, one man has taken the task of destroying the will of Michigan citizens and in the process, destroying Michigan’s marijuana law.

In 2008, just before the Michigan Medical Marihuana Act was passed by a large number of Michiganders, a Michigan judge, Bill Schuette spoke on television and in the papers urging voters to vote ‘NO’ on the ballot proposal that legalized the sale, possession and use of marijuana.

Many people including local sheriffs, businessmen, mayors, landlords and prosecutors relied upon information provided by William Schuette, then a Michigan appellate court judge and chief opponent to Proposal 1.

Judge Schuette was quoted by the Detroit Free Press in an October 25, 2008 article, “Is Marijuana Good Medicine?” as saying that “not explicitly outlawing pot shops implicitly allows them.”

And again in a October 29, 2008 press release, titled, “California Experience + Proposal 1 = Michigan Pot Shops” Judge Schuette states, “There is not a single paragraph, sentence or word within Proposal 1 that prohibits pot shops from opening in Michigan, just like they did in California,” said Judge Bill Schuette, co-chair of Citizens Protecting Michigan’s Kids and a member of Michigan’s Court of Appeals.

“Proposal 1 is a loophole-ridden proposal that brings dangerous unintended consequences that put our kids and communities at risk. Voters should say ‘No’.”

It should be noted that then-Judge Shuette’s statements were made in potential violation of Canon 4 of the Michigan Code of Judicial Conduct, which states that “As a judicial officer and person specially learned in the law, a judge is in a unique position to contribute to the improvement of the law, the legal system, and the administration of justice, including revision of substantive and procedural law and improvement of criminal and juvenile justice. To the extent that time permits, the judge is encouraged to do so, either independently or through a bar association, judicial conference, or other organization dedicated to the improvement of the law. A judge should regulate extrajudicial activities to minimize the risk of conflict with judicial duties.

The MCJC goes on to list activities in which a judge may engage, and none of those activities include making off-the-cuff comments to a prominent newspaper regarding the potential interpretation of an initiative that would almost certainly (and in fact did in many cases) appear before the very court on which a judge sits.

This was just the beginning of statements made by Bill Schuette. Fast forward to 2010 when Mr Schuette was campaigning for elected office, this time as Michigans Attorney General. As a candidate for political office and an attorney, Mr. Schuette is once again in a position where his professional ethics could easily be compromised. Schuette again sided against caution and makes the following statements:

“And, far from limiting the usage of marijuana to a small, select group of patients, the pot industry has become one of the fastest growing industries in Michigan. State government is receiving more than 1,000 medical marijuana patient applications each week. And less than two years after the ballot proposal was approved, there are more than 8,000 so-called caregivers in Michigan — people who grow and harvest marijuana plants.”

Schuette went on to say “Pot shops are literally sprouting up everywhere. One in Lansing is less than 100 feet from a Catholic middle school, and oftentimes those who attend night classes at the pot shop park in the church and school’s parking lot.”

First actions as Attorney General – Destroy the Michigan Medical Marihuana Act through written opinions and cooperation with conservative prosecuting attorneys and judges. And the cops. “Dispensaries – what are those? Arrest everyone, patients too!”

If that is not bad enough, the Republican Schuette shifted control of the state Marihuana program under his administrations direct control. A job that once resided with the Department of Community Health now is overseen by the States ‘Top Cop”? That’s not a conflict, right?

Since Bill Schuette took office medical marijuana patients have been plagued by crooked cops that intimidate and steal assets, zealous prosecutors with nothing to lose, and a master mind Attorney General who once went by the name Billy Bong during his high school years in the 1970’s. 

Children have literally been taken from patients and just for possessing a state issued medical marijuana card. Despite a law aimed at lowering arrests for cannabis, marijuana arrests have shot up significantly and ‘Michigans Top Cop’ is to blame fully.

Now, with a lead poisoning in Flint, Michigan and a worldwide audience, our Attorney General is asked to investigate the situation, unbiased.

Starting with inquiries made in February, the federal agency battled Michigan’s Department of Environmental Quality behind the scenes for at least six months over whether Flint needed to use chemical treatments to keep lead lines and plumbing connections from leaching into drinking water. The EPA did not publicize its concern that Flint residents’ health was jeopardized by the state’s insistence that such controls were not required by law.

 

 

We know who must have given the advice on state law. We know who coached them through this. We know who decided to strictly follow the bare minimums that state law would allow and poison the children of Flint. It needs to come out that Bill Schuette was the legal council and coach all through the crisis and cover up. It might not put him in prison, but it might be our only chance to be set free from him being our next governor. Call for the real ring leader to be exposed.

Attorney General Bill Schuette's opposition to medical marijuana has been described by some observers as bordering on an obsession.

 

Why is Schuette so obsessed? Perhaps the real reason is to prevent industrial uses of the hemp plant, from which marijuana is derived, from competing with products of the Dow Chemical Company, in which Schuette's family has a large financial stake, while producing top executives. Schuette's stepfather, Carl Gerstacker, was a Dow CEO, and his father, William Schuette, Sr., was in line to become CEO when he died of a heart attack in 1959. The Schuette family's Dow-based wealth has helped to bankroll a long political career that began in 1984, when he was elected to Congress at 31.

 

Dishonestly demonizing the use of marijuana, which is for the most part benign, as a cover for crushing potential competition from industrial hemp, is nothing new. Back in the 1930s, one of the most successful campaigns that resulted in the 1937 federal marijuana prohibition was run by newspaper magnate William Randolph Hearst, who used his newspaper chain to spread lies about alleged harmful effects of marijuana. But Hearst's real concern was that using hemp fiber to produce paper pulp for newspapers would cut into his own paper pulp business derived from extensive timber holdings. At the same time, the DuPont family and financier Andrew Mellon wanted marijuana banned to prevent hemp fiber from competing with DuPont's nylon.

 

So it is with Dow today. Industrial uses of hemp include plastics, water purification and weed control that could compete with Dow products and perhaps cause its business to decline, costing the Schuette family a lot of money. As such, Schuette, who led the failed campaign against Proposal 1 in 2008, is now doing all he can to undermine medical marijuana, interpreting the Michigan Medical Marijuana Act as narrowly as possible. After all, if medical marijuana were to become solidly established as a legal business in Michigan, there would be no excuse not to allow industrial hemp, which has a THC level too low for recreational use.

 

So the next time you hear Schuette, a hypocrite who has admitted smoking marijuana in college, dishonestly attack medical marijuana, understand that he isn't out to protect the public. He's just in it for the money.

schuettes in laws may be related to the very same groups that made cannabis a crime in the 30's. I'd expect  this would be influential in his decisions made from day to day.

Human(s) killed at least 9 humans with bad water. 

 

You were serious about the marital status. I had no idea what you were talking about. Can you elaborate on your research of his family tree?

the ops article makes no mention of the Flint water crimes, but it does discuss the harm to our medical marijuana program that this man may have done during his career. I added to his most recent marijuana blunders by tracing his roots a little. should make more sense to those who didn't know, how and why this man hates the cannabis plant.

I think he's a bully that hates a certain type of person. In his mind he sees those types in marijuana and in Flint. I don't think he's about money all that much unless it can be used to hate on people. He brings out the worst in the people around him. Like the head of the DEQ that resigned. I bet he has some things to say about the advice he got from the Michigan's head legal mind.  Then maybe Snyder will open up about the terrible legal advice he got also.

With most everybody, it is all about money. With Republicans, and especially rich Republicans, money is an obsession.

Yup. Been saying that. What good does it do to get something on the ballot when they will just make it their way? It's like begging to get something good on the menu at a bad restaurant. Ask for tacos and you get old meatloaf in a moldy tortilla.

Ahhh, you are on to something but getting something on the ballot is the perfect way to get the right people to show up and vote. Even if the initiative fails, we could win.

Hate. He's practically dripping with hate. 

 

I don't think DOW has to worry about hemp plants. Not in Schuette's life time. It's a huge stretch of the imagination. I don't think he's capable of thinking that far ahead(worm). He's proven that with his legal advice given to folks making the decisions about Flint.

and then theres the merging of the two companies possibly happening .  Each makes pharmaceuticals among other chemicals textiles etc. Big Pharma may be marijuana's biggest anti today. Most investments, portfolios, investment firms, corporate investments etc are largely influence by big pharm/rx, and the private prison complex. Dow/DuPont are large corporations visible in many investment portfolios. Neither supports legal cannabis. They help lobby against it. One could say that anyone who is deriving an income from their 401k/investment/retirement fund which is heavily invested in the two above areas, is a supporter of anti cannabis companies . When we purchase products and services from our enemies we financially support their war against us imo. Dow and Dupont are enemies to cannabis today.
