If they want to start saying the stems are not protected then they would have to separate every stem out to obtain the correct weight. They've already been told they can't weigh dirt and roots.

 

If your lawyer sees stems the size of gnats hairs in the product then LEO would need to sift it again.

They are going to need to settle for one of the three categories;

 

A plant. Subject to plant count.

 

Usable that is protected if legal.

 

Unusable (that is protected if the grower is legal). Unusable has no limits on it. 

 

To say that all unusable is not protected is just plain stupid. It's totally unworkable for anyone. It might fly as a lie to get a plea bargain. That's one bluff everyone must fight.

We actually did have a court case, local to me, that the usable amount was reduced by 2/3 when the case went to jury. Which made the patient not guilty.

 I hang the whole plant to dry no roots cut off at stem.  when stems crack or close to cracking i start trimming however i leave buds on the stem and size them to fit into 2 pint mason jars.  then i put lid on jar and burp 2 or 3 times per day as needed sometimes i leave lids off if humidity high.   and as needed i trim the buds off for my 5 patients. 

 

 Question is the buds on the stems inside the mason jar usable or unusable?
