Fact Sheet on Resumption of Equitable Sharing Payments

 

1. When will equitable sharing payments resume?

The equitable sharing disposal and disbursement process will resume immediately; therefore,

state, local, and tribal law enforcement agencies will begin receiving equitable sharing payments

in April, and the payments will continue after that as we process the claims.

 

2. Will state, local and tribal law enforcement agencies receive full equitable sharing

payments or reduced payments when equitable sharing is resumed?

Agencies will receive the full amount of their share of any approved equitable sharing payments.

 

3. How is the Department going to prioritize the backlog of equitable sharing payments?

The Department will first process payments that were ready for payment prior to the deferral

decision on December 21, 2015, but were suspended mid-process. Any sharing payments

approved after December 21, 2015 will be paid on a “first in, first out” basis.

 

4. How long will it take the Department to pay all the deferred equitable sharing

payments?

The Department is restarting the Equitable Sharing payment process immediately. In addition,

we are modifying the current system in order to streamline and speed up the large number of

payments that are expected to be processed from now until the end of the fiscal year. We are

centralizing our payment distribution process to ensure that both the deferred payments, as well

as the future disbursements, are made as quickly as possible.

 

5. How will individual state, local, and tribal law enforcement agencies know when a

specific equitable sharing payment will be made?

As is usually the case in equitable sharing, the recipient agency will receive an email notification

alerting it to a payment, unless the agency previously opted out of receiving these notifications.

In addition, agencies can view the status of all pending and disbursed equitable sharing payments

in the eShare portal.

 

6. Is there a risk that equitable sharing payments will need to be deferred, again, this year?

We would not have restarted equitable sharing payments right now unless we were confident the

Assets Forfeiture Fund will remain solvent through remainder of the fiscal year, which ends on

September 30, 2016. At the end of any fiscal year, total Assets Forfeiture Fund expenses and

rescission amounts cannot exceed resources available in the fund. This is why the combined and

unanticipated impact of $1.2 billion in rescissions three months into the fiscal year forced us to

defer payments until additional deposits could replenish the loss.

 

7. What will happen in 2017?

Assuming our budget request to Congress is enacted, we also anticipate fully funding the

Equitable Sharing Program in Fiscal Year 2017.

We have a criminal gang in this country that likes to tell themselves it’s OK to steal from or kill law abiding citizens as long as they can get away with it. The war on drugs and the war on terror were never about public health or safety; they were about taking away power and freedom from the people. They are perpetual wars that by themselves make the underlying problems worse over time.

 

We are 58 times more likely to be killed by a police officer than a terrorist and since 2014 civil forfeiture has now surpassed losses from all burglaries combined. So who really are the terrorist here?

 

Terrorism, in its broadest sense, is defined as the use of violence, or threatened use of violence, in order to achieve a political, religious, or ideological aim”

 

Unfortunately, the masses do not stand up for their rights unless there is no drinkable water, food or shelter, which all will be coming in the not so distant future due to decisions made by an insane minority that has failed to take all factors into consideration. Why? Because these decision makers are not scientists, and therefore have no meaningful way to verify or properly act on the various information given to them. I don't know who could support funding the war on drugs by robbing citizens who have broken no laws, but little has been done to stop it for more than a decade now. If you wanted to destroy the morale and patriotism of a country, there is no better way to do it.

This video hits the problems head on with civil forfeiture; it was before Canada implemented a similar forfeiture law as the US (https://www.youtube.com/watch?v=XVVruOX_MhY). They are now having identical problems.

 

Some key points,

 

“I don’t think there is anything you could do, any minor or major amendments, that would make this ok.”

 

“[This bill] is one step further down the already slippery slope that Canada is taking towards becoming a police state.”

 

“This bill will give the government a stake, a very big stake in organized crime… In effect it will make the government a senior silent partner to organized crime.”

 

“[The government] will become addicted to that source of funds just like any junky and then we will never be able to repeal this law, no matter how much evil we see it doing, no matter how many police officers or judges it corrupts…”

 

Notice how the legislatures are getting hammered from both sides (the people v LEO) and promise to fix the law, but only make some minor amendment? It’s because they are not really trying to fix it, they are trying to get both the people and LEO to shut up. The only way to fix this law is to completely get rid of it.

 

She also hits the problem head on where LEO is now allowing crimes to happen so that they can take the proceeds of those crimes. For example, in several states they are only patrolling traffic going into Mexico (money side) rather than the drug side. As she said, our government(s) have become senior silent partners to organized crime. They rely on crime to fund themselves and thus allow it to happen or they make up new/false crimes themselves, an addiction just like any junky.

 

Is it true that we will never be able to repeal this evil? Kinda feels like it.
