Lake Orion Medical Marijuana Operation Leads To Felony Charge

Prosecutors issued charges this week against a 46-year-old Lake Orion man nearly month after officers reported finding 130 marijuana plants in his home. 

 

 

The investigation started March 18 with a code violation due to abandoned cars on his Northshore Drive property. With officers at the home, they reported they noticed the strong smell of marijuana plants. 

 

 

The arrest comes less than four months after Lake Orion enacted a medical marijuana ordinance that required growers to register with the village. 

 

 

The man, William Russell Davis, had told investigating officers he was a caregiver to three patients and the marijuana they smelled was for them. Officers informed him he had to register with the village, giving him details on the law and a date by which to comply.

“The homeowner did not comply with the registration,” Lake Orion Police Chief Jerry Narsh said in a prepared statement. 

 

 

On March 22, officers executed a search warrant, finding the 130 plants. They also reported finding evidence of illegal drug use inside the home and finding part of the grow operation not enclosed in a locked facility that could be accessed by others in the home — a violation of the law. 

 

 

The Oakland County Prosecutor’s Office charged Davis with a single count of delivery or manufacture of a controlled substance, a potential seven-year felony. Davis turned himself into Lake Orion police officers Monday and was arraigned in the 52nd-3rd District Court in Rochester Hills, then freed on a $25,000 personal bond. He is due back in court on April 25 for a preliminary examination. 

 

 

Narsh said the goal of the Lake Orion ordinance is to “ensure that lawful, licensed caregivers, their patients and the general public are lawfully cared for and protected while also ensuring the safety of the community.”

Why are caregivers waiting to get picked off one by one in these areas with these illegal ordinances why is  someone not fighting to get these ordinances overturned they are not worth the paper they are written on?

some may not have $$$$$$ to do so same as the transport Law people all over our doing jail time for it after they our dragged out of their car's by Leo

Thing is Bob its going to cost a hell of a lot more now that he is facing charges someone needs to grow a pair in these draconian areas and get these conflicting ordinances removed from the books because they are  directly in conflict with the state medical marijuana law.

david rudoi ( http://www.rudoilaw.com) says he will fight these ordinances at the city council meetings. i've been sending him ordinance news/meeting dates/times. if you find any new ordinances in oakland county area , let him know.

 

i sent him this lake orion ordinance notice a while back.

 

 

i know some members on the forum here used to call up city commisioners, mayors, city council members. everyone has to help out. emails, calls, writing, showing up to city council meetings, etc.

 

 

to fight these in court the problem is you need standing. which means you have to live in the city, and you have to out yourself as a pt/cg. then you have to fight it in court...

Doesn't sound like his being in violation of a local ordinance (was it ever tested in court?) has much to do with his legal troubles  3 patients plus himself equals 48 plants allowed. He had 130 plants, and called attention to his property with abandoned cars?

 

Please tell me there is more to the story.

Well my point of view is without the BS ordinance I dont think the warrant would be seen as valid probable cause the cops said

"You do know your suppose to register  right?"

 

I think if he can get a lawyer to  prove that the ordinance was used to gain access to a judge signing the warrant maybe he can get this case tossed as fruit from the poisonous tree?

This is another example of people bringing the law into their life for something other than mm, and they wind up getting popped for mm, maybe it can be thrown out because of the ordinance, but he still was way over his limit! 

 

Most times when people wind up in court for mm violations, They drew the attn of leo, neighbors,ect for other reasons, now the cops give him a chance to bring his numbers to the right amount, he dont do anything and now he is in deep doo doo!  Who do you realy think is at fault when it is all said and done?

 

The ordinance is b.s and goes against the mm law, but the numbers also go against the mm law!

 

im surprised he didnt open a go fund me for phaqing up acct!

I do agree Kingdiamond but with the case People v Brown Leo can get a warrant for just smelling cannabis coming from someones Home and that opinion is going to be in the High Court soon Imho

Just want to give a shout out to bobandtorey thank you for your support today you are truly a great man.

 

 

Thank you for your kind words Sir King Cannabis they do mean a lot to me and i'll be their again for you and your family on June First try and not worry to much and you can call me anytime if you need someone to talk too i'll be right here anytime day or night because i know how you feel i've been their also 

 

i have two more case this week to support it's the only way and it's the right thing to do i wish more people would try to support the sick and the ones that care for them i do believe it can and does make a difference

Ok  I beleive I should not have said what I did above, It is real easy to judge some one when you only hear one side of the story!

 

I would like to appoligize to this person in open forum!  IM SORRY FOR BEING AN A S S HAT!

 

When you hear the other side it sure does make a difference and makes it a whole lot easier to understand!

 

This Guy realy can use some support, He is in oakland county, So I realy dont need to say much more than that eh?

 

News articles realy go strictly by what lying pigs say!
