HAZEL PARK, MI -- A civil complaint filed in Detroit federal court Tuesday alleges disturbing behavior by a police officer.

Megan Pearce, identified in the lawsuit as a 911 dispatcher for Warren police, claims Hazel Park Police officer Michael Emmi used a cell phone application to spy on her while she breast-fed her son while undressed.

The lawsuit claims the officer used a cell phone application on her fiancé's phone and a baby-monitoring camera to watch her.

Hazel Park's police chief said he doubts the allegations will be substantiated.

Pearce claims Emmi, along with other police from Hazel Park, New Baltimore and the Oakland County Sheriff's Office, searched her home March 2 in relatation to a narcotics investigation focused on her fiance, Cody Fuhrman, who's since been charged with felony possession of a controlled substance and delivery of or manufacturing marijuana.

Court records also show the county has initiated forfeiture proceedings to take ownership of Fuhrman's 2010 Dodge Ram.

According to the complaint, police jailed Fuhrman and seized his phone March 2.

The phone contained an application that linked to a baby monitor, called the Nest Cam, in Pearce's home. When the Nest Cam detected motion, it would send an alert the phone and allow access to a live stream of the video monitor.

Only three devices -- Pearce's iPhone and iPad, as well as the iPhone police confiscated from Furhman -- had access to the monitoring application, according to the lawsuit.

"Ms. Pearce had a daily routine where she would take her infant son into the bath tub,

bathe him, nurse him, and put him to bed," the complaint claims. "At least one day after her fiancé's phone was seized ... Ms. Pearce noticed a small green light flashing on her Nest Cam baby monitor while she was nursing her son in the sanctity of his nursery ... just leaving the bath tub.

" ... Shortly after she saw the light flashing, it occurred to Ms. Peace that since her fiancé had been arrested ... she was being watched by someone else; someone was violating the sanctity and privacy of her home and watching her nurse her son in the nude."

Pearce used the phone's Find My iPhone tracking application that used GPS to locate missing Apple products, and allegedly traced the her fiancé's phone to Emmi's home residence.

Pearce then attempted to disable the monitoring capability of her fiancé's phone.

"However, later on, while she was lying there nude nursing her infant son and talking to her brother on her cell phone about the events surrounding her fiancé's arrest, she noticed the Nest Cam light flashing again," the lawsuit says. "She sat there momentarily in shock and then cried out to her brother, 'Oh my God, someone is watching me again.'"

Hazel Park Police Chief Martin Barner said Emmi, a 15-year veteran with the Department, has an "exemplary record."

"I don't know how she actually found somebody to file the lawsuit," the chief said. "There are a lot of questions that need to be answered."

What is a dispatcher for the city of Warren Police Department doing with someone who had their phones seized and is the focus of a narcotics investigation, he asked.

"I seriously doubt that the allegations in this lawsuit will be substantiated," Barner said. "There's no internal investigation at this time" and "this isn't a criminal complaint ...

"However, I'm a firm believer that what's right is right and wrong is wrong, and if there is any protocol or policy that was violated here, then he'll be held accountable."

Barner added: "That being said, he has due process rights as well as anyone else and the court of public opinion" tends to judge police too quickly.

The lawsuit, filed by Detroit-based attorneys, Kevin Ernst and Jonathan R. Marko, alleges a violation of Pearce's Fourth Amendment rights; violation of the federal Wiretapping Act; eavesdropping and invasion of privacy.

"Ms. Pearce's world has been shattered," the complaint says. "She no longer feels safe and secure in her own home. Defendant Emmi, who is paid to uphold the law, perversely and illegally spied on her and her infant son, in one of the most intimate and private moments between a mother and her baby imaginable, to satisfy his prurient voyeurism.

"She suffers daily from the memory of the events of that day and lives in constant fear that the footage from the Nest Cam will wind up on the internet."

The lawsuit calls for a jury trial.

A veteran Hazel Park police officer is facing a federal lawsuit from a woman who says she was spied on after her fiance’s cellphone was seized by authorities.

 

Megan Pearce, a dispatcher for the Warren Police Department, filed the suit Tuesday against Michael Emmi, a 15-year veteran of Hazel Park’s police force.

 

During a news conference Wednesday at her attorneys’ office, Pearce said she was “shocked, devastated and sad.”

 

“This is very difficult to make these accusations against someone that’s also a fellow law enforcement member,” she said. “It’s very difficult. However, this is such a serious violation of my family’s privacy, including myself and my son. It is absolutely necessary to take this action to prevent this from happening to any future individuals.”

 

In her suit, Pearce alleges Emmi used the phone and a baby-monitoring device to spy on her three times, once when she was cleaning the nursery after police searched her home and two other times while she was naked and nursing her infant son after she got out of the bathtub.

 

According to the lawsuit, Pearce’s fiance was arrested on marijuana charges at about 2 p.m. March 2, despite having a card allowing him to serve as a caregiver under the Michigan Medical Marihuana Program.

 

Hazel Park police and the Oakland County Narcotics Enforcement Team “executed search warrants on several locations related to marijuana allegations against (the fiance) and arrested him,” according to the suit.

 

Though the couple lives in New Baltimore, one of the locations searched was a workshop at 1638 Nine Mile in Hazel Park, where Emmi took the fiance’s phone, according to the suit. Emmi and police also searched the couple’s home, the suit claims.

 

After the police search, Pearce began cleaning the nursery room, which had been left in “total disarray.” She noticed the light flashing on her Nest Cam baby monitor. According to the suit, her fiance’s phone showed data usage at a cell tower near Emmi’s home in Macomb.

 

The next day, Pearce noticed the green light flashing on her Nest Cam in her nursery, where she breastfeeds her son. The Nest Cam sends alerts to connected devices when there is movement in the room.

 

The complaint says only three devices were connected to the camera, which sends notifications when a connected device accesses it. Those devices were Pearce’s iPhone, her iPad and the fiance’s iPhone. But her phone was off and the iPad wasn’t monitoring the Nest Cam, the lawsuit alleges.

 

After using a “Find My iPhone” search, Pearce discovered the fiance’s phone traced back to Emmi’s residence, the complaint says.

 

According to the suit, Pearce tried to and thought she had successfully disabled monitoring from the iPhone. However, the light began flashing on the Nest Cam again when Pearce was nursing her son after his evening bath, the suit says.

 

Pearce, who was speaking with her brother on the phone at the time, yelled that someone was watching her again, according to the suit. The light on the camera, which also has audio capability, then shut off.

 

Police Chief Martin Barner, a 22-year veteran of the force, describes Emmi’s service as “exemplary” and told The Detroit News there has been no change in his working status.

 

Barner says he has spoken with Emmi about the matter, but told The News “it’s tough to comment when you haven’t been served anything. I want to see what everybody’s talking about.”

 

The lawsuit only lists Emmi “in his individual capacity” as a defendant and does not name the Hazel Park Police Department.

 

One of Pearce’s attorneys, Kevin Ernst, said a lawsuit could also be brought against the Police Department as the investigation continues.

 

“(Emmi) is probably not acting alone if he got the cellphone out of the crime lab,” Ernst said adding there could be a systemic problem in the police department that would “turn a blind eye and allow him to take a piece of evidence.”

For that exact reason maybe?   mlive, purposeful omissions, etc? 

I didnt hide the caregiver status, neither did the news on television. besides, I added the info for clarity.

I saw a clip on the morning news. I finished my coffee, googled "cop, spy, baby cam, mlive, and the article which I posted came up. I posted it here as a relevant piece showing mlive and their ommission, as well as the subject of the omission itself being medical marijuana, in michigan even.

Yep, I was sure I'd heard the name before.

 

Emmi was sued in 2011 for allegedly using a Taser on a mentally ill man during a forced hospitalization, and that case is still pending.

 

He was sued the previous year for a warrantless search he conducted during a welfare check that turned up marijuana plants, but an appeals court later upheld the search as legal.

You can get phone history and find out if it was being used and when etc.

 

 I would also add that anyone with the slightest bit of knowledge can break into those nanny monitoring devices.

 

Half the time the ports are left open etc.

 

People really need to be more careful with their devices.

for some reason its a few bad apples doing all of the making whoopee trouble.

 

like 1 officer can be involved in like 10 settlements in one city and they cant fire him

right.  and then, even though we are not allowed to interview the monsters like human resources.... we are forced to pay their liabilities when they snap.

Their HR dept should be replaced and re trained each time they fail in this manner. I can tell if a potential cop is good for the job or not.....just like a potential politician....

 

If he's vying for the position, he aint good for it!  anyone smart enough to do the job correctly today would be inherently smart enough to avoid it!

 Your right , but it was stolen from her partner,  She is the victim here, the cop is the criminal ,, just cause the door is unlocked doesn't mean go in and steal sheit...

well she did say she used find her phone, (i have an iphone) and if I lose my phone as long as the battery still has juice it tells me right where it is, down to the adress!

 

yes I agree, 12 yr old kids can hack into your pc or phone and open your cams, always lay them down so no one can see you if they do hack it, and always close your laptops that have cams, I honestly know of young teen agers who get off on blowing up peoples computers in russia!  I am truly tired of being strapped to my phone, pc, tv, my phone can do everything!  When I go on vacation or out camping I dont want to be contacted, if something bad happens to my family while im on vacation, I cant do anything about it, so I dont need to know untill I get home!

 

apple tells fbi they cant let them have info for a crooks phone, fbi hacks it, now they wont tell apple how they have a glitch or how it was hacked, that realy helps the normal person with an apple phone eh?

 

It is time to over arm our selves, it wont be long and they will want to come get our guns, and they think we will give them up voluntarily!  has any one tried buying .22 bullets latley?  If you get to a store early enough they may have a few boxes, but they only sell you one, it is so hard to get a box of .22 shots than you can get all kinds of .38, 40's, 12 guage 20 guage, just about all other ammo!   People own more .22's than any other guns made!  and the gov wants to make sure we cant have enough to fight them with!

 

heck with the mm law it is time to form militia's!

how do we know the government has anything to do with the .22 round shortages going on for close to a decade ?

I love a good conspiracy, but why not clamp down on the rounds most responsible for deaths first? unless of course .22 's are responsible.....doh////

a .22 is a deadly weapon, if I was a crook I would have a .22 rouger, most times when some one is shot with a .22 it doesnt go thru and thru, it goes in and bounces around on your bones and messes up all of your organs on its travels, I would rather have a .22 long gun than a 9mm pistol, a .22 could kill you before you could get close enough to me to hit me with a 9mm!

 

I dont think the gov is all to blame for lack of .22, I think people trying to stock pile them is more likely the reason!

 

When you have presidents who talk gun control you wind up with a whole lot of people purchasing guns and ammo!
