I think that if you have a caregiver who is allowed to possess plants (due to having other patients) and you have retained your right to possess plants then, yes, your caregiver could provide you with cuttings.

 

I also think that the courts would try to say that this isn't legal simply because they don't like the idea of people exchanging plants. Jeesh, these folks really have a stick up their azzes when it comes to cannabis.

Then your breaking the law. period! change plant possesion, not CG then they can give you those cuttings/plants. IMO

Then the answer is no why would your patient be interested in growing without legal access to do so?

not if you have your pt's grow rights!  if you were your pt's c.g and didnt have his grow rights and the pt had the grow rights, you could provide clones or anything else mm related as long as your connected thru the registry!

only the person with plant rights can be in the car when you are moving them to another/new room!  and yes you can transport live plants in a vehicle, I would just try not to let them be seen or break any driving laws lol!

My observation is that cardholders doing things the Act, or tag-along afterward bass turd law, doesn't address (disps, acquisition of clones, concentrates, plants outdoors without the blessing of a top, flashing the public with your plants, transporting embers in your mouth) have a rough time in court; if not in district, in higher courts.  And if not there, in Oakland County. So do you feel lucky today?  Prolly u won't after court.

I have no clue!

 

all I know is people move, or they decide to move their grow room to a place that their wife and kids dont live, and you can transport your live plants in your vehicle,

 

on that note, I would not want to be the one to test what im saying lol!

as for transferring plants... yes i think its legal if you are connected cg>pt transfer.

 

because sec4 permits transfer of marihuana (to a connected patient).

 

and because definition of marihuana is any part of the plant growing or not.

 

this is all assuming that you (cg) have right to possess plant and also the patient you are connected with also have rights to possess plants. and also that both are within your weight and plant count limits.

 

remember only 1 person can be in the car if you are transporting plants.

remember any transfers have to be for the patients' medical use only.

 

keep the car doors locked, make sure turn signals and brake lights work, check license plate for obstructions, no cracks in windshield or windows, keep the windows rolled up, dont speed or violate traffic rules.

 

i am not a lawyer this is just my personal opinion. i have not seen this come up in court yet.

because being in a car has additional restrictions. is why i'd suggest just one person in car at a time. do transfer in building behind locked doors...

 

(2) An individual is not inside the vehicle unless he or she is either the registered qualifying patient to whom the living marihuana plants belong or the individual designated through the departmental registration process as the primary caregiver for the registered qualifying patient.

 

that "either" means either you are the patient or you are the cg. only one person in the car.
