Teitel: Medical Marijuana License, Regulation Needed For Mich.

Michigan has failed the 180,000 registered medical cannabis patients and 30,000 caregivers in this state.

Michigan is the only state in the country where medical cannabis is legal, but it does not license or set regulations for the growing and sale of medical cannabis. Why does Michigan regulate everything from barbers to interior designers, but not an industry where the lack of regulations can affect the health and safety of patients?

Michigan voters overwhelmingly approved medical cannabis in 2008, so by ignoring the need for sensible regulation, lawmakers are only putting the health and safety of patients at risk.

Plus, absent of any state regulations for dispensaries, cities such as Ann Arbor, Flint, Detroit and Lansing have created their own licensing process, but this has not made these establishments immune from scrutiny by law enforcement.

This lack of regulation is not due to a lack of effort on the part of the medical cannabis industry, but to the indifference of our state legislature.

Numerous bills that address patient safety and safe access have been submitted to our state legislature and have historically passed through the House, only to be hung up in the Senate.

Furthermore, there have been two separate House bills in the last two years alone that would have set standards and improved safe access for the state’s 180,000 registered medical cannabis patients by authorizing legal medical cannabis dispensaries.

In these bills, municipalities would have the option to either zone them or not. There is even a “piggyback bill” that would track cannabis “from seed to sale” to ensure that medical cannabis would not fall into the wrong hands.

Unfortunately, our state lawmakers continue to ignore medical cannabis for fear that a “yes” vote on behalf of badly needed regulation is a death sentence for their political futures.

 

On a national level, states with legal recreational cannabis laws and those with legal medical cannabis laws have standards of cannabis safety that have been established, which include simple labeling information and testing for pesticides, molds and other contaminants. But due to how our courts have interpreted the Michigan Medical Marihuana Act, Michigan only allows for cannabis to be consumed by smoking.

 

This is a shortsighted approach that fails to address the needs of patients that require other forms of this powerful plant – such as oil – to combat potentially life-threatening seizures, the treatment of many forms of cancer and even in topical lotions for pain relief.

Ultimately, the road to safe access and safe medicine is in the hands of our lawmakers. My company has been at the forefront of cannabis testing for the last five years.

We understand the importance of sensible regulation because of our experience operating in a tightly regulated environment and want to work with the state to create regulations that ensure the safety of the public.

I urge you to contact your state representatives and senators to demand that they address the needs of Michigan’s 180,000 registered medical cannabis patients – their safety depends on it!

WOW , like this hasn't been done before,, didn't work out for us then ,, why would it make a difference now.. sorry i  think we need to consider another angle. 

And i  dont have a suggestion.

Teitel is no friend of patients as far as I can tell. Here's his testimony on House Bill 4209;

 

We have reviewed the House Bill 4209 and are in full support of the testing and tracking requirements.

 

Oh wait!

 

I guess all of this is necessary so the government gets their cut of the sales and we can force the public to pay for our services whether they want them or not.

 

What compassion! :wub:  If only everyone cared so much for the sick!

Is there any program available that does not show at least a 1% failure rate?  I think the program serves the bulk of participants well.

it sucks that we allow our prosecutors and judges and leo to act unfairly towards those few  they targeted. This doesnt reflect on the program.

I dont like some court decisions, or some of the Act's rules/definitions either, but I like the Act as a whole.

 

the most angry of all seem to be people that  want or choose to sell outside of their registry.

I'm not angry because some numbskull patient cant find a cg that will put up with his trashy mouth or gram a week needs. theres a whole lot more human injustices to concern ones self with. There are school programs that steal from the children, prison systems that exploit the prisoners, cancer doctors causing cancer, prescriptions that cause disease, insurance used to buy rx to be resold on the street, /////.....not all programs will work for all people it seems.

 

I advise not dabbling in the area of available defenses until lawyers step up their game, until plea bargaining our defenses down is unacceptable. Stick to the available protections for best results.

My card worked fine and dandy for me. Just as advertised.

I do agree the card does and has worked for others like you i'm glad of that so all we need to do is have it work for all because it didn't work for Joel S or Hartwick,  R.Redden. Barb Agro , 

 

This is a State Law not a County, By City, or  By Town  Law

i was told by the C.O.A you don't really need a card for protection 

 

 

 

The article and discussion was about 180,000 REGISTERED patients and 30,000 REGISTERED caregivers being failed by the system though Bob.  ;-)

 

You do not need a card for possible protections under Sec. 8 if all your ducks are in a row and a trier of fact agrees with you. It isn't easy.

Hows the food safety regulations working for you all? Yep how many food recalls do we have, seems like not a week goes by and their is yet another recall -  I notice way after the fact and most folks would have consumed the tainted products. Yep that's what we need more regulation for the sake of safety. The statement "Im from the government and Im here to help you" are the scariest words to hear.

Well, Joel left his plants outside unsecured, Hartwick had more plants than allowed(maybe, maybe not), Redden didn't have a card at the time and Barb Agro got screwed by her own son honestly.

 

Not the best examples on cards working or not Bob.

Why did the police come for Barb and her husband?

 

Because of her son, right? Who was running an illegal dispensary right?  Told his Mom it was legal right? Legal  enough to work there?

 

Please tell me another reason they got busted... other than her son convincing her to illegally be involved in his dispensary?

 

 

 

On Aug. 25, 2010, our home, along with multiple others, including

both of my sons' homes, also medical marijuana patients, was raided

by masked gun-wielding officers from Oakland County Michigan's

Narcotic Enforcement Task Force. In this raid our home was torn into

pieces. Mattresses ripped apart, clothing, cabinets emptied, plants

ripped from their pots and dirt thrown across rooms and even into our

bed. Approximately $11,270 dollars was taken from our home, money

that had been saved and withdrawn to purchase a vehicle. My two sons'

homes were raided at the same time ...

 

A neighbor of my son was brave enough to leave the scene and drive to

my home where he informed my husband of the raid. In his frenzied

haste, my husband grabbed his car keys, leaving his wallet and our

home unlocked and unsecured. After arriving to my son's residence and

checking on his daughter-in-law and grandchildren to ensure they were

protected he returned back home to find his house raided by the same

narcotic enforcement detail.

 

Because the door to their home was unlocked when police arrived,

prosecutors say that Barb Agro was not in compliance with the

Michigan Medical Marihuana Act, which requires that all growing

facilities be inside a "locked enclosed space." Sal, her husband of

45 years, doesn't have to worry about it. He died from a heart attack

at age 67 about a week after the raids.

 

"Our belief is that it was due to the stress from watching his wife

and kids being wrongly prosecuted by an overzealous prosecutor and

sheriff," wrote Agro.

 

Police don't seem inclined to cut her any slack. The Agros also

worked at the Clinical Relief medical marijuana facility in Ferndale

that was busted earlier the same day her home was raided. That was

probably what led to the raids that night. Their son Nick Agro, of

Lake Orion, is a co-owner of Clinical Relief. In all 16 people were

charged from the day's raids including those associated with Herbal

Remedies and Everybody's Cafe in Waterford Township.

 

"She worked the front desk [at Clinical Relief] to make sure nobody

nefarious got through, to make sure they were properly credentialed,"

says her son Nick Agro.

 

Agro was an employee at the facility(clinical relief dispensary) being run by two of her sons.

 

 

 

Agro said his sons Nick and Tony Agro ran the Clinical Relief, at 362 Hilton, in Ferndale. His wife, Barb, was interviewed at the clinic.

 

The Agros’ son Tony was arrested in Ferndale during the raid.

 

Sal Agro said his family had run the Ferndale clinic

 

 

Police laid it all out for everyone to see; three-quarters of a million dollars worth of drugs seized from medical marijuana facilities in Ferndale and Waterford.

 

Thursday, attorneys for the Ferndale clinic's owners and employees were back in court for a hearing after several of them were arrested and charged with violating Michigan's new medical marijuana law.

 

Day, who is a deejay and also known as "Stick" on Channel 955, is a card carrying member of the Medical Marijuana Program. He's a patient at Ferndale's Clinical Relief marijuana dispensary, which sells 20 grades of the drug for up to $700 an ounce.

Karma? Wasn't that the one where the cops had the owner on tape saying to put the pot that was stinking like chemicals in the medibles? I believe so ....... I wonder what else they were up to.
