The wording in the law is, as one judge said of the entire MMMA, inartfully drafted.

 

Look at many homes in Mexico and Central America. They are on small lots surrounded by concrete or masonry walls that are 8 feet or even taller, sometimes with broken glass or other sharp things along the top of the wall. All this is designed to keep the general public out. Now imagine living in such an enclosure with a concrete floor. You tell a painter that you want all sides of your yard enclosure painted except for the base. So you end up with painted walls. The question "what about the top" never surfaces because there is no top. A top can't be considered a side if there isn't a top to begin with.
