Common Roadside Drug Tests Routinely Produce False Positives

Recommended Posts

Sorry for posting these anger-inducing news stories, but here's a short paragraph summary of an article that will be sure to pisss you off. (really moderators, "p1ss" is objectionable and it turns into "tinkle"??? THIS IS STUPID STUPID STUPID.)

Tens of thousands of people every year are sent to jail based on the results of a $2 roadside drug test. Widespread evidence shows that these tests routinely produce false positives. Why are police departments and prosecutors still using them?

Full article here.

What isn't said in this article, but which was mentioned in an interview with an author is that evidence is routinely destroyed after a conviction.

I’m sure Rick Jones believes the science is there just like those mouth swabs. Nothing to see here, destruction of evidence is normal behavior…

(False Positive Drug Tests Exposed - 2009)

It is disturbing to see all the injustices happening across the country and the burden placed upon innocent individuals. Once someone is caught up in one of these schemes their going to be punished whether they are guilty or not; same as several other schemes like bogus debt collection. The best word that I have for our justice system is fraudulent. You shouldn’t receive a permanent arrest record based upon inconclusive chemical tests, or be arrested for that matter. You shouldn’t have to drug test during pretrial, especially if you’re a medical marijuana patient with bogus charges. You shouldn’t have to pay for your defense if you are proven innocent or deal with lost income/opportunities.

But these people don’t care about justice, they just want money. It’s like herding cattle to the slaughter house, get in line and wait your turn. Until we start properly funding our law enforcement and courts, this behavior will only become worse; although it is not the only issue that needs to be fixed.

Although I agree with you!  When the mm law was passed crooked dr.'s rented hotel lobby's, golf course lobby's, etc, and would be pt's lined up like cattle to get legal, I went to a few with friends, (i got mine from my primary dr.) and no one was checked for anything, if you had 200 bucks you walked out with a cert!

Leo sucks, but they are not the only ones taking advantage of pt's, we almost lost our law because of circus dr.'s and alot of pt's that truly belong in the mm program are/were getting in trouble because of their bogus money grubbing dr.'s!

I have had a few brushes with the law while being legal, yea it was a pain in my arse but I did get my charges dropped and didnt need an attny to do it!

Peace

True, I knew one or two people who didn’t have a medical condition when the MMMA first came out and they got their cards. In fact, when I was in court the judge asked if I had gotten my card from a ‘drive-through’ clinic. But this is really on the doctors, not the people who were trying to get cards for non-medical purposes nor the legit patients; at least that’s how the bill reads for me. If they went after all the bad doctors, the situation would have cleared up in a year or two like it did. Even if there were only good doctors out there, LEO would still be against MMJ and they would have found another excuse to claim the program is BS.

Before the MMMA though the courts were already set up to convict as many people as possible, not to seek true justice. I say it’s fraudulent because the vast majority cannot afford a private attorney and simply take plea deals. When combined with fraudulent chemical tests that the average person cannot understand, let alone what a false-positive is, you’re going to convict a lot of innocent people (as they have). Highway robbery, shootings, mass falsifying of lab reports, destroying evidence, ect. The system is out of control because it is corrupt, and has been incentivized to become corrupt. We have more important things to deal with than these superficial problems these idiots like to create.
