WEXFORD COUNTY, Mi (WPBN/WGTU)-- Two people were arrested after detectives say they were illegally selling marijuana from a marijuana dispensary. 

The incident happened at Best Cadillac Provisions Marijuana Dispensary in Haring Township. 

 

According to the Traverse Narcotics Team, investigation over the last several months led to the search of Best Cadillac Provisions Marijuana Dispensary. During the search of the business, a 51-year-old Cadillac man and a 23-year-old Manton man were arrested. 

TNT says the 51-year-old man was arrested for delivery of marijuana, conspiracy to deliver marijuana, possession with the intent to deliver marijuana, maintaining a drug house, felon in possession of ammunition and possession of marijuana. 

TNT says the 23-year-old for possession of marijuana. 

TNT also searched a Haring Township house where the dispensary owner lives. Detectives found measurable amounts of processed marijuana, two grow operations and paraphernalia. The dispensary was operating illegally and outside the legal boundaries of the Michigan Medical Marijuana Act. 

TNT was assisted by the Wexford County Sheriff's Department and the Michigan State Police Homeland Security Team.

Dispensary owner faces life on drug, ammunition charges

CADILLAC — A 51-year-old Cadillac man who is running for Haring Township trustee was charged in 84th District Court Tuesday for illegally selling marijuana out of his dispensary business and home as well as a weapons-related charge.

 

Donald Joseph Koshmider II was charged with one count of possession of ammunition by a felon; two counts of delivery/manufacture of marijuana; two counts of conspiracy to commit delivery/manufacture of marijuana; two counts of maintaining a drug house; and possession of marijuana for his alleged role in incidents occurring between April 21 and July 11 in Haring Township.

 

A habitual offender, fourth offense notice was added to the charges, which means Koshmider faces up to life in prison if he is convicted, because the ammunition charge carries a penalty of up to five years.

The Traverse Narcotics Team served two search warrants Monday after it gathered evidence alleging Koshmider was illegally selling marijuana out of the Best Cadillac Provisions dispensary on Plett Road in Haring Township. According to a TNT press release, the dispensary was operating illegally and outside the boundaries of the Michigan Marijuana Act, which permits a caregiver to sell to only a handful of registered patients.

 

The Medical Marijuana Act, approved by voters in 2008, allows licensed medical marijuana caregivers to grow a limited amount of marijuana for each of five patients, or for six people if the caregiver also is a medical marijuana patient. Operators of medical marijuana dispensaries in Michigan could face prosecution for serving more customers than allowed by law.

This wasn’t the first time the dispensary was investigated by TNT. In 2014, Best Cadillac Provisions and several other dispensaries in the county were raided by TNT and instructed to quit illegally selling marijuana. Search warrants were executed in July 2014 at five dispensaries including Best Cadillac Provisions.

 

Best Cadillac Provisions has been located in Haring Township since January 2014. However, dispensaries were required to stop selling marijuana after a Michigan Supreme Court decision and a “legal moratorium” by Wexford County Prosecuting Attorney Anthony Badovinac.

 

In September 2014, Haring Township approved a temporary marijuana moratorium. In September 2015, the township board approved a medical marijuana ordinance that officially put on the township’s ordinance books that medical marijuana dispensaries are not permitted.

 

During Monday’s search, a 23-year-old Manton man also was arrested for possession of marijuana. TNT also conducted a simultaneous search at Koshmider’s Haring Township residence. The execution of both search warrants revealed measurable amounts of processed marijuana, two grow operations and paraphernalia.

 

A $20,000 cash or surety bond was issued, and as a condition of bond, Koshmider is to not consume any illegal drugs and most submit to random testing.

Still sitting here- waiting for the injustice system to understand that the only lives they're ruining are those of non-violent "offenders". Patients who only want medications, at that. Sure seems like they're really keeping the "dangerous" people at bay.

Considering that Cadillac has a crime index of 308-whereas the average is 290 throughout the U.S. according to City-data- I'd say that people smoking pot should be some of the last of their worries.

Cannabis users are simply easy pickins.

Why work hard when you can work easy.

Open a store and put a sign out so leo knows

right where you are and what you are doing,

then cry to the community for support.... bah.

 

I am not in anyway condoning leo's behavior btw.

I do agree but why do you think that the City's are giving out the go ahead to open one ?

Yep, good ole bait and switch.

 

When I signed the petition for prop 1 2008 I did not believe that if voted into law that pt/ cg's would be protected... call me jaded, shrug.

None of what has transpired since the MMMA went into effect has surprised me either.  I knew that once I became a registered pt that

I may be placing a target on my back so... I strive to remain under the radar so to speak.  Imho, all of us that are in the program are all

'rolling the dice' and the more ya roll em, the more chances your number will come up... simple.

Shop owners choose to place a larger target upon themselves.

The disp issue is a double edged sword for me.  I am glad for ppl who push the limits as we would not be where we are today w/ cannabis

if not for those folks.  On the other hand... I feel they have pushed too hard too fast and are profit driven... yadda, yadda... I've said it

all before... anyway... no one should be jailed for a plant and esp. those who have paid the State for the protections we voted to have.

From what I have seen, the local units of government who gave permits to "dispensaries" also included a requirement that said dispensary would comply with the MMMA.  So, in other words, cities and townships gave permits for folks to open a retail storefront with the expectation that said permittee would abide by state law....A place for caregivers to transfer to patients connected to them.  But then the permittee gets a local business license, and transfers to "any patient" and then gets busted and cries that that he had a local permit.  I have never seen any local permit that states that a person can sell MMJ to "any patient."

I understand well enough what the disp peeps have done/ are doing.  My comment was not intended to praise these folks in any way.

I think it took more than 1 billionaire and 5 MPP people to get prop 1 '08 passed... kinda need a whole lot of foot soldiers for such and endeavor.

So... 6 people planted the seed... the rest of us brought that seed to fruition.

It seems though, that no seeds of change will grow without the fertilization of $$ sadly.

So that they can get the money and sell-able assets from raiding the place. They set them up, so they can knock them down. It's pretty disgusting really.

 

imagine if some city/state had an accurate list of cannabis growers, the ones growing since carded , the ones growing for patients(multiple plants).

imagine if they wanted to end it all at once with a crackdown. On one tuesday morning every carded grower could be jailed and robbed of his possessions all at once in a joint state/city venture and multiple leo's, even selectively.   that list, maybe multiple leo lists too, is compiled and maintained and is producing untold statistics no doubt.   

After multiple "set ups" warnings, etc.....dipshitceries seem foolish for continuing. I would guess the cash out daily is worth the risk for them. Big cash made..plea bargain...biz as usual.  I hope they use more cams in the future to catch more leo stealing dildies and abusing the elderly handicapped, you know, for sensitivity training and such. :wacko:
