  1. well, the PD told me the prosecutor thought I had a pretty good case ( thanks to all my bro's providing the reference cases up here!), Except, per the PD: the mmma of 2008 does not cover 'concentrates', so even though I didn't have a concentrate, it was a dliute topical, they were going to try me with posession. It was going to drag on well into the winter, being out of PR bail and risking having to drop pee for any LEO that could pull me over, I plead guilty to the misdemeanor and paid $500, no jail time. Moral of the story: don't smell, keep it locked up, get a haircut and car that won't get you flagged. Thanks for all the help guys, we'll see about this new forthcoming modification of the act, will we be getting 'manifest sheets' for inventory and transportation controls directly from LARA? or can we write out the details on XXL zig-zags? ; ) keep it light ya'll. I love yous guys.
  2. I got a public defender, presented him with copies of the dismissals from Curdrado, Porter and Barber, along with the MMMA act. Several of the dimissals cover art. 4 sec. 25 of the constitution and clearly state the unconstitutionality of the 2012 act. Hurry up and wait I suppose. I have tentative dates next month.... if you all don't hear back late Sept, you can imagine....
  3. we'll just have to see...... I'm still doing dilligence: if I say yes to a meager plea in pre-trial, does that resolve it there, or does it proceed to court to have this completed? I have heard about Judges going against the agreement between prosecutor and defendant...
  4. T, you're alright man. I did read that, and was elated. It was late last night, my browser died several times with all this gleaning and I didn't have any of the links in front of me, I did skim and partially read most of the links you sent, I just need to sit down this weekend and print everything and get a notebook together. I bookmarked everything , so I should be ok. I have one question ya'll: for the sake of convenience: would anyone here cop a petty traffic plea for a fine to forgo more court hassles and fees if they decide the constitution is not the highest law in that court? I think I may know the answer.....

If anyone near Berrien would be willing to come out for support, or to give me a little help if they're capable, please PM me. I have had some one sentence correspondence with Mr. Abel, nothing really helpful to this point, no write backs from a few NORML chapters I've contacted as well. I'm running with it, much printing to do when I have access to one.   7. t-pain: do you know if I could present these forms at pre trial? I don't think the judge is present in the pre trial is he/she? Like I said guys, please PM me if we can get a phone chat going, I'd love to hear of your overcoming this rubbish and the mechanics/routine of the court hearing cycles. I've never been caught up in the system before, nothing but seatbelts and rolled stops back in the day, all wiped. Perfect record, never in court. Etc.
  8. guys, thanks for all the support. I'm in Berrien county, SW MI. I have had a few short chats with a few attorneys. I wish I had the funds to be represented by one, but I may only be able to scrape a few bucks together for a meeting or something limited. Please PM me if you think you can recommend somebody, or to get a phone conversation going with your experiences, I would be grateful, and though I don't have a job presently, I have a mess of organic kale and garlic, and plenty of fruit coming on shortly. ps, I'm really anti-litigation, I was not actually arrested I suppose, even though I was processed like a common criminal in the court system. So.... If a lawyer thinks we can sue the county and win for wrongful arrest, processing, etc. and they think it will be worth their time in the pay out, please contact me, I'd be interested in listening.

  10. so does anybody know any philanthropist pro-bono lawyers in SW MI? 39 DISTRICT COURT DECISIONS People v. Barber, Case No. 14-00098-SM, March 4, 2014 (Ingham County): Issue: Whether Michigan Compiled Law 750.574, (Improper Transportation of Marihuana), is unconstitutional? Holding: The Court held that “So Public Act 460 of 2012 is inconsistent as it limits transportation, a right granted by the Medical Marihuana Act, to certain criteria. Therefore, it’s inconsistent with the act pursuant to Section 7 of the act. The act wins, because it handles all of medical marihuana, the act being the Medical Marihuana Act.” I think its perhaps a question of my delivery/attorney prospect, and the temperment of the prosecutor and judge if it gets that far....

I can't help but wonder if a public defender will try to throw me under the bus. Anybody know if I don't have an attorney at the pre trial if I'll have one assigned if I ask, or would it be too late?
  12. do you have links to the turnout in the senate vote, and the mandatory 3/4 votes needed? sorry, I'm digging, finding plenty on the house, little on the senate..... did the bill retain the 4856 # in the senate?
  13. so, though the law was not 'ammended', can it not be superseded in part by hr4856? anybody with experience with this, please chime in. I'm broke and I can't afford to go in debt for court costs to fight this.
  14. so my immunity is seems pretty clear in sec. 4a of the act, do you know if people are getting dismissal citing these sections?
